RESOLUTION OF THE MAYOR AND COMMON COUNCIL
OF THE CITY OF SAN BERNARDINO, CALIFORNIA,
AUTHORIZING THE USE OF HOME FUNDS FOR THE
REHABILITATION OF CERTAIN MOBILE HOME PARKS
WHEREAS, the City of San Bernardino is a municipal
corporation and charter city (the "City") duly organized and
existing pursuant to the Constitution and laws of the State of
California; and
WHEREAS,the City receives funds from the federal
government under the HOME Investment Partnerships Program,
codified at 24 CFR Part 92 (~HOME Funds") established under the
HOME Investment Partnership Act (42 USC Section 12701, et ~.)
(the ~HOME Program"), which is administered by the Redevelopment
Agency of the City of San Bernardino (the ~Agency"); and
WHEREAS, pursuant to 24 CFR Section 92.205, HOME Funds
may be used by the City to provide incentives to develop and
support affordable rental housing and homeownership affordability
21 through the acquisition, new construction, reconstruction, or
22 rehabilitation of non-luxury housing with suitable amenities,

including
real
acquisition,
site
improvements,
property
conversion, demolition and other expenses; and
WHEREAS, the Agency desires, at this time, to use HOME
Funds for rehabilitation of the following mobile home parks

commonly known as: Rancho Meridian Mobilehome Park located at
2686 West Mill street, San Bernardino; Glen Aire Mobile Estates
located at 222 South Rancho Avenue, San Bernardino; Sequoia Plaza
Mobile Home Community located at 2505 West Foothill Boulevard,
San Bernardino; Friendly Village located at 2151 West Rialto
Avenue, San Bernardino; Tropicana Mobile Estates located at 721
East Ninth Street, San Bernardino; Orangewood Mobile Estates
located at 2160 West Ria1to Avenue, San Bernardino; Ninth Street
located at 780 East Ninth Street, San Bernardino; and Pacific
Palms located at 2727 East Pacific Street, Highland
(collectively, the "Parks"); and
WHEREAS, the budget for the Economic Development Agency
1997-98 fiscal year includes a line item equal to One Million One
Hundred Ninety-Six Thousand Four Hundred Dollars ($1,196,400) in
HOME Funds identified as "Prior Carry Over" attributable to
unused HOME Funds, from fiscal years 1995-96 and 1996-97, which
were originally budgeted for the Mobile Home Park Conversion
Program established by the Agency in December 1993 (the "Prior
HOME Funds"); and
WHEREAS, in order to promote affordable housing, the
City desires to assist the Agency in rehabilitating the Parks
with a portion of the Prior HOME Funds, in accordance with the
eligible rehabilitation activities set forth in the regulations
governing the HOME Program.

NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO, CALIFORNIA, DOES HEREBY RESOLVE,
DETERMINE AND ORDER AS FOLLOWS:
SECTION 1.
Recitals. The Recitals contained herein
and are incorporated herein by this
are true and correct
reference.
SECTION 2. Determinations. The Mayor and Common
Council hereby finds and determines that assistance to the Agency
for the rehabilitation of the Parks through the use of HOME Funds
will result in significant public benefits by increasing the
availability of affordable housing within the City and improving
housing conditions, thereby enhancing the health, safety and
welfare of the residents of the City.
SECTION 3. Use of HOME Funds. The Mayor and Common
Council hereby authorizes the assistance to the Agency and the
use of HOME Funds by the Agency for the purposes hereinabove set
forth in the sum of Five Hundred Thousand Dollars ($500,000).
The actual transfer of such funds from the City to the Agency
shall be evidenced by an agreement providing for the grant or
loan of such HOME Funds under such terms and conditions and
pursuant to such instructions as set forth therein to be prepared
and executed by the City and the Agency. Such agreement between

the city and the Agency shall provide for the City's
authorization of Economic Development Agency staff to request
draws of HOME Funds and to execute documents as required on
behalf of the City. The Conunission hereby authorizes the
preparation of such agreement and further authorizes its
execution by the Mayor and the City Clerk on behalf of the City.
SECTION 4. Limitation on Use of HOME Funds. HOME
Funds shall only be used for such rehabilitation projects as are
prioritized by the Agency. Expenditures for rehabilitation of
the Parks shall average approximately Sixty-Two Thousand Five
Hundred Dollars ($62,500) and shall not exceed One Hundred
Thousand Dollars ($100,000) for any of the Parks. Authorization
for the Agency's use of HOME Funds to rehabilitate the Parks is
limited to expenditures made in accordance with the provisions of
the HOME Program. Said HOME Funds may only be utilized in a
manner consistent with those eligible activities set forth in 24
CFR Section 92.205, and may not be used in furtherance of
activities prohibited by 24 CFR Section 92.214.
SECTION 5. Source of HOME Funds for Rehabilitation.
The moneys for rehabilitation of the Parks shall only be drawn
from HOME Funds included in the Economic Development Agency
budget for the 1997-98 fiscal year identified as "Prior Carry
Over." Such Prior Carry Over amount consists of HOME Funds
budgeted for the Agency's Mobile Home Park Conversion Program in

1 prior fiscal years 1995-1996 and 1996-1997, which have not been
2 used to implement the HOME Program.

Effective Date.

6 Resolution shall take effect upon the date of its passage and
