RESOLUTION NO. 98-15 2 3 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE MAYOR TO EXECUTE SUCH DOCUMENTS AND TAKE SUCH ACTIONS AS MAY BE DEEMED NECESSARY TO IMPLEMENT THE CITY'S SECOND AMENDMENT TO THE CONSOLIDATED PLAN FOR FISCAL YEAR 1997-1998 4 5 6 7 8 WHEREAS, the City of San Bernardino, California (the "City"), is a municipal corporation and a charter city duly created and existing pursuant to the Constitution and the laws of the State of California; and WHEREAS, the Community Development Commission of the City of San Bernardino (the "Commission") on behalf of the Redevelopment Agency of the City of San Bernardino (the "Agency"), is a redevelopment Agency, a public body, corporate and politic of the State of California, organized and existing pursuant to the Community Redevelopment Law (Part 1 of Division 24) commencing with Section 33000 of the Health and Safety Code ofthe State of California (the "Act"); and WHEREAS, the City Council has previously authorized the establishment ofan Amended Consolidated Plan for fiscal year 1997-98 pertaining to the receipt and use by the Development Department of the City's Economic Development Agency of Federal Grant Funds; and 9 10 II 12 13 \4 15 16 17 18 \9 20 2\ WHEREAS, the Amended Consolidated Plan seeks to use Federal Grant fund from various sources, including but not limited to Community Development Block Grant Funds, and in order to implement said programs, the City deems it necessary to authorize the Mayor to execute such documents with subrecipients of the Federal grant fund monies as may be deemed 22 23 24 25 appropriate by City Staff. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF TIffi CITY OF SAN BERNARDINO, AS FOLLOWS: 26 27 28 SECTION 1. The Council hereby authorizes the Mayor to execute any and all subcontracts and for memoranda of understanding with prospective fund recipients as well as -1- 98-15 such documents as may be necessary in order to implement the City's Second Amendment to the 2 Consolidated Plan and further authorizes the Mayor and the Director of the City's Development 3 Department to take such actions as may be deemed necessary in order to implement the terms 4 and conditions ofthe City's Second Amendment to the Consolidated Plan. 5 SECTION 2. The fmdings and determinations herein shall be final and conclusive. LAURIN, DIRECTOR DEPARTMENT OF ECONOMIC AND COMMUNITY DEVELOPMENT SUBJECT: SUBSTANTIAL AMENDMENTS TO THE COUNTY'S 1997-98 CONSOLIDATED PLAN - CDBG PROGRAM ACTION PLAN RECOMMENDATION: 1) Conduct a public hearing to obtain the views of citizens and review proposed substantial amendments to the Action Plan for the Community Development Block Grant (CDBG) portion of the County's 1997-98 Consolidated Plan; 2) Approve the following substantial amendments to the Action Plan for the CDBG portion of the County's 1997-98 Consolidated Plan: A) Barstow: Reprogram $80,000 to a new project (#102-23125) for construction of a facility for the W.I.C. (Women with Infants and Children) Program in the City of Barstow, from Unprogrammed Funds for the First Supervisorial District (# 310- 12129), and add the construction project to the list of CDBG funded activities. B) Twentynine Palms: Reprogram $4,050 to a new project (#119-23227) for providing a roller hockey recreation program in the City of Twentynine Palms, from the Twentynine Palms Blight and Graffiti Abatement Program (#119-21427). C) Twentynine Palms: Reprogram $595 to the Twentynine Palms "Choices" At-Risk Youth Counseling Program (#119-21327), from the Twentynine Palms Dispute Resolution Program (#119-23127), and cancel the dispute resolution program as a CDBG funded activity. Handicapped Training Facility Expansion Project (#208-19307) in the City of Hesperia, and $20,000 to the Senior Nutrition! Outreach Programs in Phelan and in Pinon Hills (#219-18227) and in EI Mirage (#219-22327), from the Lucerne Valley Water System Rehabilitation _ Stewart Water Company Project (#212-23406), and cancel the water system project as a CDBG funded activity. F) Yucaipa: Reprogram $30,000 to a new project for resurfacing tennis courts at Seventh Street Park (#122-23202), from Yucaipa Unprogrammed Funds (#122- 00020), and add the resurfacing project to the list of CDBG funded activities. G) Yucaipa: Reprogram $7,000 to a new project (#122-23111) to construct handicapped access entry ramps and double doors at the Seventh Street Park recreation building, from Yucipa Unprogrammed Funds (#122-00020), and add the handicapped access project the list of CDBG funded activities. H) Town of Yucca Valley: Reprogram $5,000 to a new project (#123-23427) to increase the Yucca Valley Citizen's Patrol Program, from Unprogrammed Funds for the Third Supervisorial District (#330-12129), and add the patrol program to the list of CDBG funded activities. I) Landers: Reprogram $3,611 to the Bellfield Hall Energy Efficient Windows Project (#238-23102), from Unprogrammed Funds for the Third Supervisorial District (#310-12129). J) Colton: Reprogram $44,855 to the Pennsylvania Avenue Street Improvements Project (#104-21905), from Colton Unprogrammed Funds (#104-00020). K) Fifth District: Reprogram $43,000 to a new project (#350-23118) to acquire property on 19th Street in the City of San Bernardino, occupied by the Provisional Accelerated Learning (PAL) child care facility, from Unprogrammed Funds for the Fifth Supervisorial District (#350-11129). BACKGROUND INFORMATION: The proposed substantial amendments have come about as a result of changing priorities for meeting the community development needs of San Bernardino County. The specific reasons for each proposed amendment are as follows: 2A) CDBG funds are needed to construct a 1,400 square foot facility needed in order to provide a W.I.C. Program in the City of Barstow. 2B) The City of Twentynine Palms has requested the reprogramming of the balance of CDBG funds remaining in the blight and graffiti abatement program in order to provide a roller hockey recreation program to local youths. 1/27/98 Iw #81 98-15 . SUBSTANTIAL AMENDMENTS TO THE COUNTY'S 1997-98 CONSOLIDATED PLAN - CDBG PROGRAM ACTION PLAN January 27, 1998 Page 3 of 3 2C) The City of Twentynine Palms has requested the cancellation of the dispute resolution program and the reprogramming of its funds to increase the amount of CDBG funds provided to the "Choices" At-Risk Youth Counseling Program. 2D) Additional CDBG funds are needed in order to continue the Lady "B" Ranch Therapeutic Horseback Riding Program through to the end of the 1997-98 Program Year. 2E) CDBG funds are needed in order to fully fund the J.O.B. facility expansion project and to extend the three senior outreach/nutrition programs through the end of the 1997-98 program year. 2F) The City of Yucaipa has requested reprogramming of CDBG funds to resurface the tennis courts in order to provide a multi-purpose recreational court facility at Seventh Street Park. 2G) The City of Yucaipa has requested reprogramming of CDBG funds to construct improvements to the Seventh Street Park recreation building so that it will meet Americans With Disabilities Act (ADA) access requirements. 2H) The Town of Yucca Valley has requested CDBG funds to purchase a vehicle needed in order to expand the Yucca Valley Citizens' Patrol Program to low - and moderate-income areas of the town. 21) Additional CDBG funds are needed to replace the fan in the commercial kitchen in Bellfield Hall. 2J) The City of Colton has requested the reprogramming of CDBG funds in order to proceed with construction of improvements to Pennsylvania Avenue. REVIEW BY OTHERS: Amendments affecting Supervisorial Districts have been reviewed by the staff of those Districts. The Cities of Barstow, Colton, Twentynine Palms and Yuciapa, and the Town of Yucca Valley have approved the actions affecting their jurisdictions. FINANCIAL IMPACT: The proposed substantial amendments to the 1997-98 Consolidated Plan involve CDBG funds only, and will not affect the County General Fund.
