RESOLUTION NO. 1999-331 RESOLUTION OF THE CITY OF SAN BERNARDINO CERTIFYING THAT SAN BERNARDINO HAS THE RESOURCES TO FUND THE PROJECTS SUBMITTED FOR INCLUSION IN THE FY 2000/2001-2005/2006 TRANSPORTATION IMPROVEMENT PROGRAM AND AFFIRMING ITS COMMITMENT TO IMPLEMENT ALL OF THE PROJECTS SUBMITTED IN THE PROGRAM, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: (a) WHEREAS, the City of San Bernardino desires to include the submitted projects in the San Bernardino County Transportation Improvement Program; and (b) WHEREAS, the City of San Bernardino warrants that full funding is committed and available for projects submitted for programming in the first three years (FY 2000/02, 2002/03) of the Regional Transportation Improvement Program; and that the City of San Bernardino accepts responsibility for full funding of said projects and warrants that no additional funding allocations are required of SANBAG for the City of San Bernardino to fully 16 implement said projects therefore committing that the first three years of the RTIP are 17 financially constrained; and 18 19 20 21 22 23 24 25 (c) WHEREAS, projects programmed in years 2003/04-2005/06 are projects expected to receive future funding through anticipated revenues; therefore, all projects submitted for inclusion in the 2000/01-2005/06 RTIP are financially constrained; and (d) WHEREAS, the San Bernardino Associated Governments (SANBAG), as agency responsible for short-range capital and service planning and programming for the San Bernardino County area, requires an approved Resolution from the governing body of the Lead 26 Agency for all projects included in the Transportation Improvement Program; and 27 (e) WHEREAS, SANBAG also requires that the Lead Agency include a financial plan 28 I 1999-331 1 that demonstrates how the projects submitted for inclusion in the Transportation Improvement 2 Program can be implemented; and 3 4 5 6 7 NOW, THEREFORE, BE IT RESOLVED that the Mayor and Common Council of the 8 City of San Bernardino does hereby: 9 A. 10 11 12 B. 13 14 C. 15 16 17 (t) WHEREAS, the City of San Bernardino, as the Lead Agency, possesses the legal authority to submit the project for inclusion in the Transportation Improvement Program and to finance, acquire, and construct the project. Affirm its continuing commitment to the projects submitted for inclusion In the 200012001 -2005/06 Transportation Program; and Commit that the City of San Bernardino, as Lead Agency for the projects, will carry out the projects consistent with the project implementation schedule; and Certify that the City of San Bernardino will enter into a contract with SANBAG committing that it will carry out the projects identified as transportation control measures (TCM) in the South Coast Air Basin consistent with the project implementation schedule; and Certify that the City of San Bernardino will allocate the necessary local match funds contained within the project to carry out any federally approved project; and Certify that the City of San Bernardino, as Lead Agency, will comply with applicable provisions of the California Environmental Quality Act, the National Environmental Policy Act, the Americans with Disabilities Act, the Secretary of the Interior's Standards and Guidelines for Archaeology and Historic Preservation, and any other Federal, State, and/or local laws, rules and regulations. 2 1999-331 1 RESOLUTION, . .CERTIFYING THAT SAN BERNARDINO HAS THE RESOURCES TO FUND THE PROJECTS SUBMITTED FOR INCLUSION IN THE FY 2 2000/2001-2005/2006 TRANSPORTATION IMPROVEMENT PROGRAM AND 3 AFFIRMING ITS COMMITMENT TO IMPLEMENT ALL OF THE PROJECTS SUBMITTED IN THE PROGRAM, 4 5 I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and 6 Common Council of the City of San Bernardino at a joint regular meeting thereof, 18 19 20 21 1999. 22 23 24 25 26 27 28 , 1999, by the following vote, to wit: NAYS ABSTAIN ABSENT x ~k_~ The foregoing resolution is hereby approved this olth1 day of Approved as to form and legal content: JAMES F.
