RESOLUTION NO. 1999-298
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
3 SUBMITTAL OF SIX (6) CONGESTION MITIGATION/AIR QUALITY (CMAQ)
PROGRAM PROJECT PROPOSALS AND COMMITMENT OF $144,000 IN
4 MATCHING FUNDS TO SAID PROJECT PROPOSALS.
5 WHEREAS, the City of San Bernardino desires to submit six (6) project proposals for

the Fiscal Year 1997/98-2000/01 CMAQ funding cycle listed as follows:

WHEREAS, the City of San Bernardino warrants that local matching funding is
committed and available for those six (6) projects submitted for consideration in the current

CMAQ funding cycle; and that the City of San Bernardino is committed to implementing any

project that is awarded CMAQ funding; and
24 WHEREAS, the San Bernardino Associated Governments (SANBAG), as the agency
25 responsible for short-range capital and service planning and programming for the San
26

Bernardino County area, requires an approved Resolution from the governing body of the Lead
Agency for all projects submitted for CMAQ funding; and

Resolution...authorizing the submittal of six (6) Congestion Mitigation/Air Quality
(CMAQ) Program Project Proposals and commitment of $144,000 in Matching Funds to
said Project Proposals.
WHEREAS, the City of San Bernardino, as the Lead Agency, possesses the legal authority to
submit project proposals for CMAQ funding consideration, and to finance, acquire, and

5 construct said projects.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Common Council of the City
of San Bernardino do hereby:

Affirm its continuing commitment to the project proposals submitted for Congestion
9 Mitigation/Air Quality (CMAQ) Program funding: and

Commit the City of San Bernardino, as the Lead Agency for the projects, to carry out
the project consistent with the CMAQ Program administrative guidelines implementation
schedule; and
Certify that the City of San Bernardino will enter into a contract with SANBAG
committing to carry out the execution of project development, construction, and completion of
14 any project that is awarded CMAQ funding appropriations; and

Certify that the City of San Bernardino will allocate the necessary portion of local
match funds ($144,000) contained within the project to complete said project; and
Certify that the City of San Bernardino, as the Lead Agency, will comply with
applicable provisions of the California Environmental Quality Act, the National Environmental
Policy Act, the Americans with Disabilities Act, the Secretary of the Interior's Standards and
Guidelines for Archeology and Historic Preservation, and any other Federal, State, and/or
local laws , rules, and regulations.
