RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT
WITH THE STURGES ACADEMY FOR THE PROMOTION OF ARTS AND
CUL TURE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor of the City of San Bernardino is hereby authorize
and direct to execute on behalf of said City an Agreement with Sturges Academy, a copy
of which is attached hereto marked Exhibit "A" and incorporate herein by references as
fully as though set forth at length.
SECTION 2.
The authorization to execute the above referenced agreement
is rescinded if the parties to the agreement fail to execute it within sixty (60) days of the
passage of this resolution.

Fine Arts Fundinq
THIS AGREEMENT is entered into between the CITY OF
SAN BERNARDINO, a municipal corporation, referred to as
"City" and the Sturges Academy, a non-profit
organization, referred to an "Organization"
The parties agree as follow:
1. Recitals.
A. Organization has requested financial
Assistance from City for fiscal year 1999-00, in order to
assist in defraying the expense of certain concerts,
shows, festivals, or events of activities sponsored by
Organizations as set forth Organization's grant proposal
(hereinafter "the proposal") approved by the Fine Arts
Commission of the City. A copy of said proposal is on
file in the Mayor's Office of Cultural Affairs. The terms
of the proposal are incorporated herein by reference and
shall govern the uses of the funds provided herein. The
financial assistance provided for this agreement is made
on a one-time only basis, and receipt of said funds shall
not imply a continuing obligation of the City beyond the
terms of this Agreement.
B. The expenditure is for valid municipal public
purpose, to wit: for the promotion of art appreciation in
San Bernardino, as more fully set forth in the proposal
submitted by Organization.

budget for the 1999-00 fiscal year, the total sum of
4 $10,000.00 dollars, to cover the costs per Fine Arts
grant application agreement.

3. Use of Funds. The funds paid to Organization
shall be used solely for the purposes set forth in
Paragraph 1 and in strict compliance with the provisions
set forth in the agreement. No deviation from the
agreement shall be made without the expressed approval of
the City of San Bernardino. Said funds shall be expended
by June 30, 2000, and any unexpended funds shall be
returned to City by Organization.
4. Accountinq. Within 20 days after the
completion of the event, the Organization shall submit to
the Mayor's Office, with copy to the Director of Finance,
an accounting of the actual expenditures connected with
said event as it relates to the fund which were provided
by the City. Financial records shall be maintained in
accordance with generally accepted accounting principles
by Organization in such manner as to permit City to
easily trace the expenditures of the funds. All books and
records of Organization are to be kept open for
inspection at any time during the business day by the
City or its officers or agents. Failure to submit the
financial records in accordance with this section will
result in the Organization reimbursing the City.
5. Hold Harmless. Organization covenants and
agrees to defend, indemnify, and hold harmless the City
and its employees and agents from all liabilities and
charges,

expenses (including counsel fees), suits or losses
however occurring, or damages arising or growing out of
the use or receipt of the funds paid hereunder and all
operations under this agreement. Payments hereunder are
made with the understanding that the City is not involved
in the performance of services or other activities of
Organization. Organization and its employees and agents
are independent contractors and are not employees or
agents of the City in performing said services. The
costs, salary and expenses of the City Attorney and
members of his office in enforcing this agreement on
behalf of the City shall be considered as "counsel fees"
for the purposes of this paragraph.
6. Termination. City shall have the right to
terminate this Agreement and any funding remaining unpaid
hereunder for any reason by mailing a ten-day written
notice to Organization and this agreement shall terminate
ten days after the mailing of such notice. In event this
Agreement is terminated for reasons of improper use of
funds or use of funds for any purpose other than those
authorized, any unexpended portion of funds provided by
City shall be returned to City. In addition, Organization
shall reimburse to City any funds expended which were
used for any purpose other than those authorized under
this Agreement.
7. Assiqnment. Organization shall not assign
its interest in this Agreement without the prior written
approval of City.
8. Insurance. Organization shall take out and
maintain during the life of this Agreement such public
liability and property damage insurance naming as
additional insured the City, its elective and appointive
boards, commissions, officers,

Agents and employees, Organization and its agents
performing act covered by this Agreement from the claims
for property damage for personal injury, including death,
as well as from claims for property damage which may
arise from Organization's or its agents' operation
hereunder, whether such operations be by Organization or
its agent or by anyone directly or indirectly employed by
either Organization or its agents, and the amounts of
such insurance shall be as follows:
(a) Public Liability Insurance. In an amount not
less that $1,000,000 for injuries, including, but not
limited to, death, to any person, and subject to the same
limit for each person, in an amount not less than
$100,000 on account of anyone occurrence.
(b)

(c) Workers Compensation. Organization shall
provide worker compensation insurance in the amount
required by state law if the funds provided hereunder are

9. Obliqation. Organization hereby convenants
that it has taken all actions necessary to make the
adherence to the obligations imposed by this agreement a
binding obligation of the organization.
10. Notices. All notices herein required shall be
in writing and delivered in person or sent by certified
mail, postage prepaid addressed as follows:

11. Entire Aqreement. This Agreement and any
other documents of instruments attached hereto or
referred to herein integrate all terms and conditions
mentioned herein or incidental hereto, and supersede all
negotiations and prior writing in respect to the subject
matter hereof. In the event of conflict between the terms
conditions or provisions of this Agreement, and any such
document or instrument, the terms and conditions of this
Agreement shall prevail.
12. Non-Discrimination. Organization agrees that
for the term of this Agreement it shall not discriminate
in employment recruitment, hiring, admission practices,
advertising or in an other manner on the basis of race,
color, creed, religion, national origin, sex, physical
handicap, or marital status.

Sturges Academy offers training and participation in performinglstage arts and crafts
for inner city children. These children have little to no exposure to the arts. The
Sturges Academy provides training in voice, dance, acting, stage techica1 craft (sound,
lights, makeup, costume, set design). At the end of the class period of 6 weeks the
children are cast in a musical stage production, which includes rehearsals and per-
formance of at least two performanmces. All children involved in the Academy are
involved in the production.

Need Sta~eme"_~:
The need for programs at low or no cost to the children and their families in the inner
city of San Bernardino, especially within the close proximity of Sturges Center for the
Fine Arts, is tremendous. Exposure to the fine arts, whether performing or technical,
is invaluable to these children. Aproductive and fun training program along with per-
formance time, enhances self-esteem, provide gaols, friendship and new directions
in these young people's lives.

The Sturges Academy provides as diverse culturally and ethnically group of children
with an opportunity to experience abilities undiscovered. The children come together
and learn new skills and share talents. The program raise self-esteem which will aid

The Sturges Academy was founded in 1998/1999 through a grant from the City of San
Bernardino Fine Arts Commission. The program is joint enture with the Sturges Center for
the Fine Arts and Sturges Family Playhouse. with the playhouse responsible for the
final production at the end of the academy. Sturges Center provides the space and admin_
administrative needs and adminis ters the actual Academy program.

Dear Mayor Judith Valles:
I just wanted to express my gratitude for the city- sponsored
Academy for the Arts Summer program. The teachers have been
helpful and cooperative in demonstrating so many aspects of
theatre production. They have been able to take so many children,
of so many diverse backgrounds and personalities, and transform
them into one cooperative team. My children, of which there were
five involved in this years production, have come to understand
that it takes a lot more then just being on stage to produce a
succesiful musical play. Especially when there is so much "raw"
talent! My children have blossomed on stage; singing outloud in a
large group is no longer an obstacle. It is a talent to be cultured
rather than be suppressed. They have learned that parts in a play
are given to those best suited to fulfill a specified need. As such,
favoritism is non-existent. But most importantly they have come to
appreciate the fact that there are "stars" waiting to shine within
us all. I thank the city and the Academy staff for offering such a
wonderful summer class. I hope that this is the first of many great
summer musicals to be presented at the Sturges Theatre; of which
there is no other greater in San Bernardino!

Dear Mayor,
I want to express my appreciation to the Sturges Art Center for their program for kids. My daughter Ryan
took part in this summer program. It has been an excellent learning experience for her. She has learned all
the parts of working on a play, including the background areas. She has learned to work with all kinds of
people and take direction. Her self confidence has improves. She is not afraid to get in front of a large
group of people. I bope that the Sturges Art Center can offer this program again, as my daughter is eager to
get up on stage again.

To Mayor Valles,
I would like to thank you and the city of San Bernardino for such a wonderful
experience for my two children this summer at the Summer Academy. Our
family has never been involved in anything like this before and actually we
never knew how to become involved until this summer.
Everyone at the Academy was professional and very caring towards the kids
and their parents. I always felt welcome whenever I was there, and I knew my
kids were safe with the teachers and staff. It is rare to have that trust and
confidence in people you barely know, but we all did.
I cannot tell you in words how my children have grown and changed during
those 6 weeks, but it is amazing to see the difference. They enjoy music,
singing, and pretending they are putting on a show for our family, and with their
friends. They use vocabulary they learned at the Academy about theater. Their
teachers even have noticed a difference with their self-confidence and
willingness to participate in class and especially in front of people. They would
NEVER have done it without the Academy program.
We are looking forward to next summer. We hope you have the same teachers,
if possible. The children are very attached to them, and you couldn't have
picked better people.

Dear Mayor:
We would like to thank you to all invo1ed in making
our little Heathers dream come true.
She has always wanted to take acting classes, but,
we could never afford acting classes let alone 12 plus
hours a week acting classes.
From the first day we entered the Sturges Academy
and a soft spoken voice greeted us with a warm smile we
knew this was going to be a great experience. And It has
Mrs. Lindsey and her staff have taught our Heather so much
about Theater that she has brighten up and feels so confident
about herself.
Thank you for choosing the best people to work with our
child. We trusted them and they proved to us they are very
trust worthy people. We are forever greatfu1.

To Whom It May Concern;
I would like to convey my deepest regards for giving my children the opportunity
of participating in the Sturges Center For the Fine Arts. My children have benefited
greatly from the Sturges program. They have learned what it means to be apart of a
team all working together with one goal in mind, that is to preform for their audience to
the best of their ability. The Program of the Arts has also helped with my childrens self
-esteem, they now believe that they can do anything they put their minds to. They have
learned the importance of hard work and listening and taking instructions from their
peers and other adults. The staff worked well with the children, they were patient
understanding and communicated well with the parents. My children have met many
new friends and have been exposed to a great experience that will be remembered for
years to come. I once again would like to thank you because without this wonderful
low cost program my children would not be able to participate in such a wonderful
learning experience. I hope the Sturges summer program will continue ,next summer
and the summers to come, so that other children along with mine, will experience this
great opportunity of the arts.

Dear Mayor Valles,
1999-291
We are so thankful that you had this program this summer. All of the
children and teenagers at the academy had a ball! Everyone is so nice at
the Sturges Center and the teachers were fantastic! You could really tell
from the first day that they loved kids and knew how to teach a large (and
difficult at times) group of kids of all ages and backgrounds. They all got
very close to each other when they were put into family groups. My
daughter is very shy, and we didn't think she would keep going each day,
but she loved it, and was very bored on the days the academy was not
held. We are moving this October and are so glad she had the chance to
go to such a wonderful theater to be trained for such a small cost. There
is no other kind of program we have ever heard of to do this. Thank you
to everybody who thought of this program, and who made it happen for
my daughter andall the other kids.

To the Acadamy Staff
Thank you for having my son Carlos at your acadamy this year. He enjoyed it so
much, and can;'t waot until it starts again. He is very interested in drama now,
and is going to try out for plays at his school this year. Our family really loved
the play Castlerock and all the costumes and everything on stage was great.
Carlos made many new friends and that is very hard for him, but not at the
acadamy. The teachers were so kind to him and all of other kids, and I knew
there were some problems with dangerous kids but the teachers took care of
everything so it was fun and everyone felt good about themselves.
Also, Carlos told' me many times that so many nice things were said to him, that
he felt like a different person when he was there because he has had some
problems at his schools but never at the acadamy.
Thank you for all the teachers, the special treats, the letters to parents, and the
beautiful awards for all the kids.
