RESOLUTION NO. 1999-273 RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE VACATION OF A PORTION OF BELLE VIEW STREET, BETWEEN RANCHO AVENUE AND PENNSYL VANIA AVENUE AND RESERVING PUBLIC UTILITY EASEMENTS AND AN EASEMENT FOR EGRESS AND INGRESS. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino having heard the evidence offered in relation to the proposed vacation of portions of Belleview Street, between Rancho Avenue and Pennsylvania Avenue, described in Resolution ofIntention No. 1999-232, hereby find from all of the evidence submitted that such street proposed to be vacated by said Resolution is unnecessary for present and prospective street purposes. SECTION 2, The Mayor and Common Council of said City do hereby vacate a portion of Belleview Street, between Rancho Avenue and Pennsylvania Avenue, more fully described as follows: That portion of Belle view Street lying within the Rancho San Bernardino, as per plat recorded in book 7 of Maps , page 2, records of the County Recorder of San Bernardino County, State of California, described as follows: Beginning at the intersection of the north line of Belle view Street, 62.5 feet wide and the east line of Rancho Avenue, 66 feet wide; thence east, along said north line of Belleview Street, a distance of 935 feet; thence, southerly, at right angles, a distance of 62.5 feet to the south line of said Belleview Street; thence west, along said south line, to the east line of said Rancho Avenue; thence northerly, along the northerly prolongation of said east line, to the point of be ginning. EXCEPTING THEREFROM, the westerly 11 feet, parallel with said east line of Rancho Avenue. and also described in said Resolution ofIntention No. 1999-232. SECTION 3. Nothing in this Resolution shall in any way affect or disturb any existing easements for public utility purposes belonging either to the City of San Bernardino or to any September 28, 1999 I ------- ~ 1999-273 1 2 RESOLUTION ORDERING VACATION --- PORTIONS OF BELLEVIEW STREET BETWEEN RANCHO A VENUE AND PENNSYLVANIA AVENUE. 3 public utility and there is hereby specifically reserved for the City of San Bernardino, its 4 5 successors and assigns, an easement for water utility purposes over the entire area proposed to be vacated, including the right at any time, or from time to time, to construct, maintain, operate, 6 7 replace and renew one or more pipelines or appurtenances thereto for the transportation of water 8 and for the construction and maintenance of water wells and related incidental purposes, 12 13 transmission and/or distribution structure consisting of wires, cables, conduits, poles, pole 14 anchors and guy wires, manhole markers and necessary fixtures and appurtenances and said 15 easement shall include rights of ingress and egress; and there is specifically reserved for GST 16 17 18 19 necessary fixtures and appurtenances and said easement shall includes rights of ingress and Telecom, its successors, heirs and assigns, an easement to construct, place, operate, inspect, maintain, repair and replace underground and overhead structures consisting of wires, cables and 20 egress; and there is specifically reserved for GTE, its successors, heirs and assigns, an easement 21 to construct, place, operate, inspect, maintain, repair and replace underground and overhead 22 structures consisting of wires, cables and necessary fixtures and appurtenances and said easement 23 24 25 26 shall include rights of ingress and egress; and there is hereby specifically reserved for Southern California Gas Company, its successors, heirs and assigns, an easement over the entire area proposed to be vacated, including the right at any time, or from time to time, to construct, 27 maintain, operate, replace and renew one or more pipelines or appurtenances thereto for the 28 transportation of natural gas, including the right of ingress and egress thereto; and there is hereby 10/14/99 2 - 1999-273 1 RESOLUTION ORDERING V ACA TION --- PORTIONS OF BELLEVIEW STREET BETWEEN RANCHO AVENUE AND PENNSYLVANIA A VENUE. 2 3 specifically reserved an easement over the entire portion to be vacated, for the rights of ingress 4 and egress for all parcels of land adjacent to the area proposed to be vacated, said parcels of land 5 known as Assessor's Parcel No. (APN) 0142-213-04, more fully described in a Deed recorded in 6 Book 7801, Page 884, Official Records of San Bernardino County, State of California and in 7 8 Judgement Quieting Title, Case No. 234035, Superior Court of the State of California; APN 9 0142-211-05, more fully described in a Deed recorded in Book 9489, Page 1564, Official 10 Records of said County; APNs 0142-211-06 and 0142-211-15, more fully described in a 11 document recorded as Document No. 19990014627, Official Records of said County; APN 0142- 12 211-08, more fully described in a Deed recorded as Document No. 19960194972, Official 13 14 Records of said County; APNs 0142-211-09 and 0142-211-10, more fully described in a Deed 15 recorded in Book 9427, Page 128, Official Records of said County; APN 0142-211-11, more 16 fully described in a Deed recorded as Document No. 89-349047, Official Records of said 17 County; APN 0142-211-14, more fully described in a Deed recorded in Book 7877, Page 900, 18 Official Records of said County; APN 0142-211-19, more fully described in a Deed recorded in 19 20 Book 7724, Page 57, Official Records of said County; APN 0142-211-23, more fully described 21 in a Deed recorded in Book 5395, Page 355, Official Records of said County; APN 0142-211- 22 23 24, more fully described in a Deed recorded in Book 5835, Page 597, Official Records of said County, and APN 0142-211-27, more fully described in a Deed recorded in Book 8292, Page 24 1336, Official Records of said County 25 26 SECTION 4.
