Home My WebLink About1999-232 1 2 RESOLUTION NO. 1999-232 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS 3 INTENTION TO ORDER THE VACATION OF A PORTION OF BELLEVIEW STREET, BETWEEN RANCHO AVENUE AND PENNSYLVANIA AVENUE AND 4 RESERVING PUBLIC UTILITY EASEMENTS AND AN EASEMENT FOR EGRESS 5 AND INGRESS. 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 7 SAN BERNARDINO AS FOLLOWS: 8 SECTION 1. That the Mayor and Common Council of the City of San Bernardino 9 hereby declares its intention to order the vacation of portions of Belleview Street, between 10 Rancho Avenue and Pennsylvania Avenue, described as follows: 11 12 13 14 15 16 17 18 19 20 21 22 23 24 That portion of Belleview Street lying within the Rancho San Bernardino, as per plat recorded in book 7 of Maps, page 2, records of the County Recorder of San Bernardino County, State of California, described as follows: Beginning at the intersection of the north line of Belleview Street, 62.5 feet wide and the east line of rancho avenue, 66 feet wide; thence east, along said north line of Belleview Street, a distance of 935 feet; thence, southerly, at right angles, a distance of 62,5 feet to the south line of said Belleview Street; thence west, along said south line, to the east line of said Rancho Avenue; thence northerly, along the northerly prolongation of said east line, to the point of beginning, EXCEPTING THEREFROM, the westerly 11 feet, parallel with said east line of Rancho A venue. SECTION 2, That the Mayor and Common Council of the City of San Bernardino, in vacating the above described portion of said street, elects to proceed under and in accordance with the provisions of the "Public Streets, Highways, and Service Easements Vacation Law", being Division 9, Part 3, of the Street and Highways Code of the State of California. SECTION 3. That the hour of 10:00 a.m., on October 18, 1999, in the Council 25 26 Chambers of City Hall, 300 North "D" Street, San Bernardino, California, is fixed as the time 27 and place when and where all persons interested in or objecting to the proposed vacation may 28 appear before the said Mayor and Common Council and offer evidence in relation thereto, for 08/31/99 1999-232 1 2 RESOLUTION OF INTENTION --- VACATION OF PORTIONS OF BELLEVIEW STREET BETWEEN RANCHO AVENUE AND PENNSYLVANIA A VENUE, 3 further particulars as to the proposed vacation, see that map marked "Plan No, 9989A", approved 4 on September 20, 1999, attached as Exhibit' A'. 5 6 7 easements for public utility purposes belonging either to the City of San Bernardino or to any SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing 8 public utility and there is hereby specifically reserved for the City of San Bernardino, an 9 easement for water utility purposes over the entire area proposed to be vacated, including the 10 right at any time, or from time to time, to construct, maintain, operate, replace and renew one or 11 12 13 and maintenance of water wells and related incidental purposes, including the right of ingress more pipelines or appurtenances thereto for the transportation of water and for the construction 14 and egress thereto; and there is hereby specifically reserved to Southern California Edison an 15 easement to construct, place, operate, inspect, maintain, repair, replace and remove any overhead 16 or underground electrical transmission andlor distribution structure consisting of wires, cables, 17 conduits, poles, pole anchors and guy wires, manholes markers and necessary fixtures and 18 19 appurtenances and said easement shall include rights of ingress and egress; and there is 20 specifically reserved for GST Telecom an easement to construct, place, operate, inspect, 21 maintain, repair and replace underground and overhead structures consisting of wires, cables and 22 necessary fixtures and appurtenances and said easement shall includes rights of ingress and 23 24 egress; and there is specifically reserved for GTE an easement to construct, place, operate, inspect, maintain, repair and replace underground and overhead structures consisting of wires, 25 26 27 28 cables and necessary fixtures and appurtenances and said easement shall includes rights of ingress and egress; and there is hereby specifically reserved for Southern California Gas Company, an easement over the entire area proposed to be vacated, including the right at any 08131199 2 1999-232 1 RESOLUTION OF INTENTION --- VACATION OF PORTIONS OF BELLEVIEW STREET BETWEEN RANCHO AVENUE AND PENNSYLVANIA AVENUE, 2 3 time, or from time to time, to construct, maintain, operate, replace and renew one or more 4 pipelines or appurtenances thereto for the transportation of natural gas, including the right of 5 ingress and egress thereto; and there is hereby specifically reserved an easement over the entire 6 7 portion to be vacated, for the rights of ingress and egress for all parcels of land adjacent to the 8 area proposed to be vacated, said parcels ofland known as Assessor's Parcel Nos. 0142-213-04, 9 0142-211-05, 0142-211-06, 0142-211-08, 0142-211-09, 0142-211-10, 0142-211-11, 0142-211- 10 14,0142-211-15,0142-211-19,0142-211-23,0142-211-24 and 0142-211-27. 11 SECTION 5. That the City Engineer of the City of San Bernardino hereby is directed to 12 cause Notices of Street Vacation to be posted as required by said "Public Street, Highways and 13 14 Service Easements Vacation Law." 15 SECTION 6.
