RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AUTHORIZING THE SUBMISSION OF A
GRANT APPLICATION AMENDMENT TO THE UNITED STATES
DEPARTMENT OF COMMERCE, ECONOMIC DEVELOPMENT
ADMINISTRATION

WHEREAS, the City of San Bernardino, California ("City") is a charter city; and
8
WHEREAS, the Inland Valley Development Agency ("IVDA") was established by the
9
legislative bodies of the City, the County of San Bernardino, the City of Loma Linda, a charter
10
city, and the City of Colton, a general law city ("Members"); and
II
WHEREAS, on January 24, 1990, a certain Joint Exercise of Powers Agreement became
12
effective in which is set forth the purposes and powers of the IVDA in connection with the
13
adoption of a redevelopment plan and acquisition of certain Norton Air Force Base ("NAFB")
14
properties if and when available for acquisition; and
15
WHEREAS, on February 12, 1990 and February 13, 1990, the Members approved and
16
authorized the execution of a certain Amendment Joint Exercise of Powers Agreement
17
("Amended Agreement") which amended and superseded the Joint Exercise of Powers
18
Agreement; and
19
WHEREAS, the IVDA together with the City have received a grant from the United
20
States Department of Commerce, Economic Development Administration ("EDA"), in the
21
amount of $1 ,800,000 for the design, construction and implementation of infrastructure
22
improvements including: (i) the construction of street improvements including traffic signals,
23
landscaping and underground utilities relative to Mill Street from Lena to Tippecanoe; and (ii)
24
the construction of street improvements including landscaping and underground utilities relative
to Otto Gericke from 3rd to Art Townsend, and relative to Art Townsend from Otto Gericke to
25
Del Rosa ("Improvements"); and

WHEREAS, the IVDA together with the City now desire to commence a formal grant
2 application amendment with the United States Department of Commerce, Economic
3 Development Administration ("EDA"), for the issuance of an amendment to the grant for
4 approximately $1,100,000 in additional funding to fund a portion of the design, construction and
5 implementation of infrastructure improvements including: (i) the construction of street
6 improvements including traffic signal modifications, landscaping and underground utilities
7 relative to Frank Bland Drive from Art Townsend Drive to Enterprise Drive, and relative to
8 Rialto Avenue from Frank Bland Drive to Del Rosa Avenue, and relative to Enterprise Drive
9 from Frank Bland Drive to Del Rosa Avenue, and relative to "A" Street from Otto Gericke Drive
10 to Frank Bland Drive, and relative to Otto Gericke Drive from "A" Street to Harry Sheppard
11 Boulevard, ("Improvements"), which along with those improvements already under construction
12 are estimated to cost approximately $2.9 million, and
13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
14 SAN BERNARDINO, CALIFORNIA, DO HEREBY RESOLVE, DETERMINE AND ORDER
15 AS FOLLOWS:
16 Section 1. The Mayor of the City is hereby authorized and directed to execute any
17 and all necessary documents and to make all necessary representations and assurances in
18 connection with the submittal of the $1,100,000 grant application amendment to the EDA so as
19 to enable the City in cooperation with the IVDA to obtain the funding for and to undertake the
20 improvements.

EDA CONSTRUCTION GRANTS
As the duly authorized representative of the applicant, I further certify that the applicant:
1. Will operate and maintain the facility in accordance with at least the minimum standards as may be required
or prescribed by the applicable Federal, State and local agencies for the maintenance and operation of such
facilities.
Will require the facility to be designed to comply with the Americans With Disabilities Act of 1990 (ADA)
(p.L 101-336) Accessibility Guidelines for Buildings and Facilities, as amended, (36 CFR Pan 1191). Will
be responsible for conducting inspections to insure compliance with these specifications.
In consideration of EDA m~king a grant and/or loan for a project that is requested by an applicant which is
a business enterprise, it agrees that for a period ofrwo years after disbursement by EDA of said grant and/or
loan or any pan therecf, applicant will not employ or tender any office or employment to, or retain for
professional services, any person who, on the date such assistance is needed or within one year prior to said
date, shall have served as an officer, attorney, agent or employee of EDA occupying a position or engaged
in activities which EDA has determined involves discretion with respect to the granting of assistance under
the Public Works and Economic Development Act of 1965, as amended, including the comprehensive
amendments of the Economic Development Arlmini,rration Reform Act of 1998.
Will have no facilities under ov.rnership, lease or supervision that are to be utilized for this project either listed
or under consideration for listing on EPA' s List of Violating Facilities.
Will comply with the EDA nOllrelocation regulations which generally prohibit use of ED A financial assistance
to assist employers who transfer jobs from one co=uting area to another. This includes an affirmative duty
on the pan of the applicant to inform EDA of any employer who will benefit from such assistance who will
transfer jobs in connection with the EDA grant.
Will comply with Executive Order 12699, Seismic Safety of Federal and Federally Assisted or Regulated New
Building Construction, which imposes requirements that federally assisted facilities be designed and
constructed in a=rdance with the 1991 lCBO Uniform Building Code; or 1992 Supplement to the BOCA
National Building Code; and/or 1991 Amendments to the SBCC Standard Building Code.
Will observe and comply with Federal pro=ement rules, as defined in 15 CFR Part 24 and/or Office of
Management and Budget Circulars as applicable, for award of any contracts for architectural engineering
and/or grant arlmini<:tration services and/or construction financed with grant funds.
Understands that attorneys' or consultants' fees, whether direct or indirect, expended for securing or
obtaining EDA assistance for this application are not eligible costs.

Administration (EDA) to continue the Economic Adjustment public works defense
implementation grant 07-49-02680. This Financial Assistance Award is authorized under Title
II, Section 209, of the Public Works and Economic Development Act, as amended. This grant
will assist the funding of your project proposal to provide engineering and design ofa master
plan, land use study, and design and construction of infrastructure improvements on the Fonner
Norton Air Force Base, located in the City of Sac'~~llll.to, "~<::.~",pntg County, California.

Inland Valley Development Agency is authorized to request a $1,000,000 EDA grant, which is
90 percent of the total estimated project cost of$I,112,000. The local matching share is
$112,000, which will be provided by Inland Valley Development Agency.

Marshall. His address is The EDA Field Assistance Office, 8929 South Sepulveda Boulevard,
Suite 414, Los Angeles, California 90045. Mr. Marshall's telephone number is (310) 670-6406,
and he may be contacted for answers to application questions.
Your Economic Development Representative and your SRO Project Officer will both conduct
initial reviews of your application and notify you of any deficiencies identified. Project
processing can continue providing you do not have any major deficiencies. List any known
missing exhibits in your application transmina1letter.
The Seattle Regional Office has limited annual authority to invite public works grant
applications. Since we are near the end of the fiscal year, it is imperative that the application is
submitted to the Regional Office by September 3. If clearing deficiencies takes more than 3 to 7
days, EDA will suspend processing of your project proposal. Subsequently the application may
be officially denied and relumed to you.
This invitation to apply for a grant is not an indication EDA will approve your application. Each
year EDA invites applications which collectively exceed available funds. Therefore, your project
proposal will be in competition for approval with many other worthwhile projects.
