RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING A SIDE
3 LETTER TO RESOLUTION NO. 89-129, RESOLUTION ESTABLISHING
MANAGEMENT AND CONFIDENTIAL COMPENSATION AND BENEFITS PLAN,
4 AMENDING SUBSECTIONS B, COMPENSATION, AND H, PERS, FOR FIRE SAFETY
MANAGEMENT EMPLOYEES, EFFECTIVE AS OF JANUARY 1, 2000

WHEREAS, Resolution No. 89-129 establishes a compensation and benefits
7 plan for Management and Confidential employees; and,
8 WHEREAS, on December 1,1997, the Mayor and Common Council authorized
9 and directed the execution of a side letter to Resolution No. 89-129 providing for an
10 increase to the City's continuation of the Fire Safety Management employees' share of
11
PERS from seven percent (7%) to eight percent (8)) immediately, and from eight
12
percent (8%) to nine percent (9%) as of December 31, 1998; and,
13

WHEREAS, the City has paid for the Fire Safety Management employees' nine
15 percent (9%) contribution to PERS since December 31, 1998,
16 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1: The Mayor and Director of Human Resources are hereby
19 authorized and directed to execute on behalf of said City a Side Letter to Resolution No.
20 89-129, for full-time, regular active Fire Safety Management employees, amending
21 Subsections B, Compensation, and H, PERS, a copy of which amendments are
22 attached hereto and incorporated herein marked Exhibit A.

SIDE LETTER TO RESOLUTION NO. 89-129
FOR FIRE SAFETY MANAGEMENT EMPLOYEES
This exhibit sets forth the Side Letter to Resolution No. 89-129, for full-time, regular
active Fire Safety Management employees.
B. Compensation
As of January 1, 2000, a State Fire Officer Certification shall receive an
additional $150 per month above base salary; or,
As of January 1, 2000, a State Chief Officer Certification or completion
of the National Fire Academy Executive Fire Officer program shall receive
an additional $250 per month above base salary.
H. PERS
As of January 1, 2000, the City will increase the base salary of all
employees covered by this agreement by converting the nine percent
(9%) Employer Paid Member Contribution (EPMC) to base salary. This
base salary is "compensation earnable" as defined in Section 20636 (c)
of the California Government Code and shall be reported to the Public
Employees' Retirement System (hereinafter "PERS"). Employees will
then assume responsibility for payment of the nine percent (9%)
employee retirement contribution to PERS and all associated costs for
the conversion of the EPMC to base salary. The City shall designate
such payment as an Employer Pick-Up as defined under the provisions
of Section 414 (h) (2) of the Internal Revenue Code (26 USC ~ 414(h)
(2)). The employee contribution to PERS shall be made through
automatic payroll deductions from the base salary in accordance with
PERS regulations.
For purposes of determining overtime compensation and other salary
payments, including but not limited to, payoffs of sick leave, vacation
accruals, holiday accruals and comp time balances, the aforementioned
nine percent (9%) base salary increase shall not be considered.
As of January 1, 2000, the City shall amend the contract with PERS to
adopt Section 21574, Fourth Level of 1959 Survivor Benefits. All
associated costs of this benefit will be borne by the Fire Management
group.
