HomeMy WebLinkAbout1999-196 " (See Also Res 1999-195) RESOLUTION NO. 1999-196 ~ 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO REQUESTING THAT THE CITY OF SAN BERNARDINO'S 3 SPECIAL ELECTION BE CONSOLIDATED WITH THE NOVEMBER 2, 1999, CONSOLIDATED ELECTION CONDUCTED BY THE COUNTY OF SAN BERNARDINO. ~ 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5 SAN BERNARDINO AS FOLLOWS: 6 SECTION I, Recitals. 7 A, A vacancy now exists on the Common Council of the City of San Bernardino for 8 the Fifth Ward of the City. 9 10 B. C. The Charter of the City requires that such vacancy be filled by election, San Bernardino Municipal Code Section 2,56.170 sets forth the procedure for 11 special elections to be held in the City. 12 D. It is desirable that a special election to fill the vacant seat be held at the earliest 13 opportunity so that the citizens of the Fifth Ward not be left without direct representation on the 14 Council for any extended length of time. 15 E, It is desirable that the City of San Bernardino's special election be consolidated with 16 the consolidated election to be conducted by the County of San Bernardino on Tuesday, November 17 2, 1999. 18 SECTION 2. Special Municipal Election Called. Pursuant to Resolution No.1999-1~~ 19 special municipal election is called and will be held in the City of San Bernardino on Tuesday, 20 November 2, 1999, for the purpose of electing a Council Member from the Fifth Ward for the 21 remainder of the current term, 22 SECTION 3, Request for Consolidation of Elections. Pursuant to Section 10400 of the 23 Elections Code, the Mayor and Common Council of the City of San Bernardino request that the 24 Board of Supervisors of the County of San Bernardino consolidate the City's special election with 25 the consolidated election to be held on Tuesday, November 2, 1999. 26 The polls for said election shall be open at 7:00 a.m. of the day of said election and shall 27 remain open continuously from said time until 8:00 p.m. of the same day when said polls shall be 28 closed, except as provided in Section 14401 of the California Elections Code. Canvass of Returns. The Registrar of Voters of the County of San Bernardino is hereby authorized to canvass the returns of the special municipal election so called and to conduct the special municipal election in all respects as if there were only one election with only one form of ballot. Results of the special municipal election shall be certified to the Mayor and Common Council of the City of San Bernardino. SECTION 5, Notice of Election, The City Clerk is hereby directed to publish a notice of the special municipal election which shall contain the following: A. The time of the election. B. The office to be filled, specifying remainder of current term, C. The hours the polls will be open. SECTION 6. Conduct of Election. The special municipal election so called shall be held in such precincts and at such polling places as shall be determined by the Registrar of Voters of the County of San Bernardino, The Board of Supervisors of the County of San Bernardino is hereby requested to issue instructions to the Registrar of Voters to take all steps necessary for the holding of the consolidated election, The Mayor is hereby authorized to execute a contract for the services necessary for conducting the special municipal election. The City of San Bernardino recognizes that additional costs will be incurred by the County by reasons of this consolidation and agrees to reimburse the County for any such costs. SECTION 7, Filing of Resolution.
