HomeMy WebLinkAbout1999-081 1 RESOLUTION NO. ] 99q-1l1 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING GENERAL PLAN AMENDMENT NO. 98-02 TO THE GENERAL PLAN OF THE CITY OF SAN BERNARDINO, TO AMEND THE GENERAL PLAN LAND USE DESIGNATION FROM CG-2, COMMERCIAL GENERAL, TO CH, COMMERCIAL HEAVY, FOR THREE PARCELS TOTALING ,76 ACRES AT THE NORTHEAST CORNER OF THE 5 INTERSECTION OF BASELINE STREET AND GARNER AVENUE, 3 4 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 7 OF SAN BERNARDINO AS FOLLOWS: 8 SECTION 1, Recitals 9 10 11 12 (a) WHEREAS, the General Plan for the City of San Bernardino was adopted by the Mayor and Common Council by Resolution No, 89-159 on June 2, 1989. (b) WHEREAS, General Plan Amendment No. 98-02 to the General Plan ofthe City of 13 San Bernardino was considered by the Planning Commission on February 16, 1999, after a 14 noticed public hearing, and the Planning Commission's recommendation of approval has been 15 16 17 18 commercial heavy, and the truck fleet parking lot will not result in any significant 19 20 considered by the Mayor and Common Council. (c) WHEREAS, the proposed general plan amendment from commercial general to environmental impacts to the site or surrounding area. Section l506l(b)(3) of the CEQA Guidelines states such activities are covered by the general rule that CEQA applies only to 21 projects that have the potential for causing a significant effect on the environment. Where it 22 23 can be seen with certainty that there is no possibility that the activity in question may have a 24 25 26 27 28 significant effect on the environment, the activities are not subject to CEQA, (d) WHEREAS, the Planning Commission conducted a noticed public hearing on February 16, 1999 in order to receive public testimony and written and oral comments on General Plan Amendment No. 98-02 (a proposal to change the General Plan Land Use 1 1999-81 Designation from CG-2, Commercial General, to CH, Commercial Heavy, for three parcels totaling ,76 acres located at the northeast corner of Baseline Street and Garner A venue, identified as 1180 W. Baseline Street and fully reviewed and considered the Planning Division staff report and the recommendation of the Planning Commission, (e) WHEREAS, the Mayor and Common Council held a noticed public hearing and fully reviewed and considered proposed General Plan Amendment No. 98-02 and the Planning Commission and Development Review Committee recommendations and Planning Division Staff Report on April 5, 1999, (1) WHEREAS, the adoption of General Plan Amendment No. 98-02 is deemed in the 2 1 2 3 4 5 6 C, 7 8 9 10 D, 11 12 13 14 15 16 17 18 19 20 A, 21 22 23 24 25 26 27 28 1999-81 convenience, or welfare of the City in that any development proposed for the site in the future will be required to meet the extensive development standards that are in place to buffer nearby sensitive uses and that enable commercial projects to blend with adjacent neighborhoods, The proposed amendment would not impact the balance of land uses within the City in that the addition of commercially designated land will provide additional opportunities for economic development that has been lost during the recession of the last several years. In the case of an amendment to the General Plan Land Use Map, the subject parcels are physically suitable (including, but not limited to access, provision of utilities, compatibility with adjoining land uses, and absence of physical constraints) for the requested land use designation(s) and the anticipated land use development(s) in that the amendment area is bounded on two sides by developed, dedicated streets, and existing infrastructure suitable for urban development. SECTION 4. Amendment BE IT FURTHER RESOLVED by the Mayor and Common Council that: The Land Use Plan of the General Plan of the City of San Bernardino is amended by changing the land use designation from CG-2, Commercial General, to CH, Commercial Heavy, for three parcels totaling .76 acres located at the northeast corner of Baseline Street and Garner Avenue, identified as 1180 W, Baseline Street. This amendment is designated as General Plan Amendment No, 98-02 and its location is outlined on the map entitled Attachment A, and further described in Attachment B, copies of which are attached and incorporated herein for reference, 3 1999-81 1 B, 2 3 4 5 This resolution and the amendment affected by it shall be noted on such appropriate 6 General Plan maps as having been previously adopted and approved by the Mayor and 7 Common Council and which are on file in the office of the City Clerk, 8 9 10 11 Clerk of the County of San Bernardino certifying the City's compliance with California 12 Environmental Quality Act. General Plan Amendment No, 98-02 shall become effective immediately upon adoption of this resolution, SECTION 5. Map Notation SECTION 6.
