2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE SUBMITTAL OF
AN APPliCATION TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD
3 (CIWMB) REQUESTING TO JOIN THE RECYCLING MARKET DEVELOPMENT ZONE
(RMDZ) PROGRAM THROUGH THE REDESIGNATION OF THE AGUA MANSA RMDZ

WHEREAS, the California Public Resources Code Section 42010 provides for the establishment of
a Recycling Market Development Zone (RMDZ) Program throughout the State which provides incentives to
stimulate development of seconcLuy materials markets for recyclables; and,
WHEREAS, the cities and COlll1ties must meet 50 percent reductions in landfill waste disposal as
mandated in the California Integrated Waste Management Act; and,
WHEREAS, the State established the Agua Mansa RMDZ in August 1993 that includes designated
areas in the cities of Colton, Rialto, and Riverside, and the counties of Riverside and San Bernardino; and,
WHEREAS, the redesignation of the Agua Mansa RMDZ to include the City of San Bernardino is
13 essential to developing local seconcLuy materials markets and to assist in meeting the landfill reduction goals;
14 and,
15 WHEREAS, the City of San Bernardino Economic Development Agency has adopted a Strategic
16 Economic Plan which includes goals consistent with those of the RMDZ program; and,
17 WHEREAS, the City of San Bernardino has adopted, and the California Integrated Waste
18 Management Board has approved, a Source Reduction and Recycling Element (SRRE) administered by the
19 Public Services Department that identifies an RMDZ as a viable program consistent with the City's goals to
20 encourage local businesses to use recycled materials in manufacturing and to reduce the volume and toxicity
21 of waste generated; and,
22 WHEREAS, the City of San Bernardino generates an adequate feedstock of marketable recyclable
23 materials for processing and manufacturing, maintains a municipal waste collection fleet, and has a developed
24 transportation network that will contribute to the success of the RMDZ program in the proposed expansion

area; and,
WHEREAS, the Agua Mansa RMDZ Board has agreed to submit an application for redesignation
of this Recycled Market Development Zone to the California Integrated Waste Management Board to include
the City of San Bernardino;

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Approve the submittal of a Recycling Market Development Zone redesignation
application for the Agua Mansa RMDZ to include the City of San Bernardino.
SECTION 2. Designate the Economic Development Agency of Riverside COlll1ty as the lead
agency to coordinate, process, and execute all contracts, agreements, amendments, and ancilluy documents
within the scope of the proposed zone application.

SECTION 3. Designate the City of San Bernardino Development Services Department Planning
Division, to be the lead agency for completing and authorizing all necessaty documentation and public
notices in order to comply with the Califomia Environmental Quality Act (CEQA) as required by the

CIWMB to include the proposed areas within the City of San Bernardino.

SECTION 4. That the redesignation is necessaty to assist in attracting private sector recycling
business investments to the area.

SECTION 5. That the current and proposed waste management practices and conditions are
favorable to the development of post-constUller waste materials markets.
SECTION 6. That the Mayor and Common Colll1cil adopt Initial Study 97-90 and the Negative
Declaration in accordance with the California Environmental Quality Act; that said Initial Study was
presented before the City's Development/Environmental Review Committee on Jlll1e 19, 1997; that afterthe
required public comment period had ended, the Development/Environmental Review Committee approved
22 said Initial Study 97-90 on July 31, 1997, with a recommendation for a Negative Declaration and forwarded
23 said recommendation to the Mayor and Common COlll1ciL
24 SECTION 7. Rescind Resolution 97-90 that designates the San Bernardino Economic
25 Development Agency as the lead agency for the administration of the Recycling Market Development Zone
26 application.
27 SECTION 8. That the authorization to execute the above referenced is rescinded if it is not issued
28 within sixty (60) days of the passage of this resolution.
