RESOLUTION NO. 1999-18 1 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING GENERAL 3 PLAN AMENDMENT NO. 98-05 TO THE GENERAL PLAN OF THE CITY OF SAN BERNARDINO, TO AMEND THE GENERAL PLAN LAND USE DESIGNATION 4 FROM OIP, OFFICE INDUSTRIAL PARK, TO CG-l, COMMERCIAL GENERAL, FOR 0.8 ACRES AT THE NORTHWEST CORNER OF THE INTERSECTION OF 5 WATERMAN AVENUE AND ORANGE SHOW ROAD. 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 7 OF SAN BERNARDINO AS FOLLOWS: 8 9 10 11 12 SECTION 1. Recitals (a) WHEREAS, the General Plan for the City of San Bernardino was adopted by the Mayor and Common Council by Resolution No. 89-159 on June 2, 1989. (b) WHEREAS, General Plan Amendment No. 98-05 to the General Plan of the City of 13 San Bernardino was considered by the Planning Commission on December 22, 1998, after a 14 noticed public hearing, and the Planning Commission's recommendation of approval has been 15 considered by the Mayor and Common Council. 16 17 18 the Environmental Review Committee and the Planning Commission who both determined that 19 (c) WHEREAS, an Initial Study was prepared on October 22, 1998 and reviewed by General Plan Amendment No. 98-05 would not have a significant effect on the environment 20 and therefore, recommend that a Negative Declaration be adopted. 21 22 (d) WHEREAS, the proposed Negative Declaration received a 21-day public review period from November 5, 1998 through November 24, 1998 and all comments relative thereto 23 24 25 have been reviewed by the Planning Commission and the Mayor and Common Council in compliance with the California Environmental Quality Act (CEQA) and local regulations. 26 (e) WHEREAS, the Planning Commission conducted a noticed public hearing on 27 December 22, 1998 in order to receive public testimony and written and oral comments on 28 1 1999-18 General Plan Amendment No. 98-05 (a proposal to change the General Plan Land Use Designation from OIP, Office Industrial Park, to CG-l, Commercial General, for 0.8 acres located at the northwest corner of Waterman Avenue and Orange Show Road, identified as 1194 S. Waterman Avenue) and fully reviewed and considered the Planning Division staff report and the recommendation of the Environmental Review Committee. (f) WHEREAS, the Mayor and Common Council held a noticed public hearing and fully reviewed and considered proposed General Plan Amendment No. 98-05 and the Planning Commission and Environmental Review Committee recommendations and Planning Division Staff Report on January 25, 1999. (g) WHEREAS, the adoption of General Plan Amendment No. 98-05 is deemed in the SECTION 2. Negative Declaration NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the 26 27 28 2 1 A. 2 3 4 5 6 7 B. 8 9 10 11 12 13 C. 14 15 16 17 18 D. 19 20 21 22 23 24 25 26 27 28 1999-18 The proposed amendment is internally consistent with the General Plan in that it meets Objective 1.19 which provides for the continued use, enhancement, and new development of retail, personal service, entertainment, office and related commercial uses along major transportation corridors and intersections to serve the needs of the residents. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City in that any development proposed for the site in the future will be required to meet the extensive development standards that are in place to buffer nearby sensitive uses and that enable commercial projects to blend with adjacent neighborhoods. The proposed amendment would not impact the balance of land uses within the City in that the addition of commercially designated land will provide additional opportunities for economic development that have been lost during the recession of the last several years. In the case of an amendment to the General Plan Land Use Map, the subject parcel(s) is physically suitable (including, but not limited to access, provision of utilities, compatibility with adjoining land uses, and absence of physical constraints) for the requested land use designation(s) and the anticipated land use development(s) in that the amendment area is bounded on three sides by developed, dedicated streets, and existing infrastructure suitable for urban development. SECTION 4. Amendment BE IT FURTHER RESOLVED by the Mayor and Common Council that: 3 11 12 13 This resolution and the amendment affected by it shall be noted on such appropriate 14 General Plan maps which have been previously adopted and approved by the Mayor and 15 Common Council and which are on file in the office of the City Clerk. 16 17 18 The Planning Division is hereby directed to file a Notice of Determination with the 19 County Clerk of the County of San Bernardino certifying the City's compliance with California 20 Environmental Quality Act in preparing the Negative Declaration. 21 I I I I 1 A. 2 3 4 5 6 7 8 9 B. 10 1999-18 The Land Use Plan of the General Plan of the City of San Bernardino is amended by changing the land use designation from OIP, Office Industrial Park, to CG-l, Commercial General, for 0.8 acres located at the northwest corner of Waterman Avenue and Orange Show Road, identified as 1194 S. Waterman Avenue. This amendment is designated as General Plan Amendment No. 98-05 and its location is outlined on the map entitled Attachment A, and further described in Attachment B, copies of which are attached and incorporated herein for reference. General Plan Amendment No. 98-05 shall become effective immediately upon adoption of this resolution. SECTION 5. Map Notation SECTION 6.
