2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO REPEALING
ORDINANCE NO. MC-I091 WHICH ATTEMPTED TO PREVENT THE NEED TO
3 OBTAIN CITY ATTORNEY APPROVAL PRIOR TO THE RETENTION OF
OUTSIDE SPECIAL COUNSEL SERVICES.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Upon the filing with the City Clerk's office of a referendum petition
protesting the adoption of Ordinance No. MC-l09l, said petition containing electors' signatures
totaling more than thirty percent (30%) of the entire vote cast for all candidates for Mayor at the last

preceding City election at which time a Mayor was elected, Ordinance No. MC-l091 had its

effective date suspended in accordance with Charter Section 121 and California Elections Code
Section 9237 and, as such, has therefore never taken effect. Accordingly, the City Clerk now having
certified that said referendum petition contains a sufficient number of valid electors' signatures,
notwithstanding Section 1.04.090 of the San Bernardino Municipal Code, Ordinance No. MC-l 091

is hereby repealed in its entircty.
