J. . , . . , Resolution No 2000-352 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING A SIDE LETTER TO RESOLUTION NO. 99-155, RESOLUTION IMPLEMENTING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SAN BERNARDINO AND EMPLOYEES IN THE POLICE SAFETY EMPLOYEE BARGAINING UNIT REPRESENTED BY THE SAN BERNARDINO POLICE OFFICERS' ASSOCIATION. PENMAN, 14 City Attorney 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ~c ' I 2000-352 SIDE LETTER TO RESOLUTION NO. 99-155 FOR POLICE SAFETY EMPLOYEES ,'. , The following sets forth the Side Letter to Resolution No. 99-155 for full-time, regular, active Police Safety Employees. Article III. Compensation. Section 2 PERS -- Retirement Plan A. The City shall continue to participate in an employees' retirement plan for Public Safety Officers, by contract with the California Public Employees' Retirement System (PERS) under the current 2% at age 50 formula. Effective July 1, 2001, the City will implement the 3% at 55 formula. The Union agrees that it will defer any discussion of the 3% at 50 benefit for two (2) years beyond the proposed contract extension date or until December 31, 2004. E. The City shall adopt a resolution with an implementation date of January 1, 2000, for paying and reporting the value of the Employer Paid Member Contribution (EPMC) under the guidelines of Government Code Section 20636(c)(4) pursuant to Section 20691. The City will report the 9% Employee Contribution as Special Compensation under the current PERS laws. For purposes of determining overtime compensation and other salary payments, including but not limited to, payoffs of sick leave, vacation accruals, holiday accruals and comp time balances, the aforementioned nine percent (9%) shall not be considered. Article VII General Provisions. Section 4 -- Term This MOD will be in effect for the four-year period commencing January 1, 1999, and ending December 31, 2002.
