BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1: The Mayor and Director of Human Resources are hereby authorized and directed to execute on behalf of said City a Side Letter to Resolution No. 99-154, amending Article III, Compensation, Section 6, Retirement Plan and Article VII, General Provisions, Section 4, Term of Memorandum of Understanding, a copy of which amendments are attached hereto and incorporated herein marked Exhibit A. PENMAN, 14 City Attorney 15 f.~ 16 17 18 19 20 21 22 23 24 25 26 27 28 ~~ Mayor Pro Tern City of San Bernardino " '. 2000-351 SIDE LETTER TO RESOLUTION NO. 99-154 FOR FIRE SAFETY EMPLOYEES This exhibit sets forth the Side Letter to Resolution No. 99-154 for full-time regular, active Fire Safety employees. Article III. Compensation. Section 6 -- Retirement Plan A. The City shall continue to participate in an employees' retirement plan for Public Safety Officers, by contract with the California Public Employees' Retirement System (PERS) under the current "2% at age 50" formula. Effective July I, 2001, the City will implement the "3% at 55" formula. The Union agrees that it will defer any implementation of the 3% @ 50 benefit until July 1, 2005. Agreement of discussion of implementation does not imply that such benefit has been agreed to or awarded. Implementation is subject to future negotiations of such benefit and approval of snch benefit by the Mayor and Common Council. This agreement does not bar the Union from negotiating for this benefit in 2003. H. The City shall adopt a resolution with an implementation date of January 1, 2000, for paying and reporting the value of the Employer Paid Member Contribution (EPMC) under the guidelines of Government Code Section 20636(c)(4) pursuant to Section 20691. The City will report the 9% Employee Contribution as Special Compensation under the current PERS laws. For purposes of determining overtime compensation and other salary payments, including but not limited to, payoffs of sick leave, vacation accruals, holiday accruals and comp time balances, the aforementioned nine percent (9%) salary increase shall not be considered. Article VII. General Provisions. Section 2 -- Term With the exception of specific time frames and effective dates for individual Articles, this MOU shall be effective from January I, 1999 to December 31, 2003.
