The Mayor of the City of San Bernardino or her designee is hereby authorized and directed to execute on behalf of said City, a grant agreement with the California Endowment in the amount of $148,860 relating to the provision of youth mentoring services 11 12 for the period of December 1, 2000 through November 30, 2002, a copy of which is attached 13 hereto, marked Exhibit" A" and incorporated herein by reference as fully as though set forth 14 at length. 15 16 SECTION 2. OBJF.CTIVES & EXPECTED OUTCOMES OF AWARD: Objectives · To ensure that all current and entering Mentors (150 per year) complete training in identification of risk factors for children and achieve a minimum of a 75% competency level. · To complete baseline assessment and develop a written plan of action for each child (75 ~ 100 per year) and their families. · To increase access to primary care, mental health services and substance abuse prevention and treatment for high-risk children and their families (75- J 00 per year) by 25% from baseline by the end of year one; 50% by the end of year two. . To contract with an evaluation consultant for the development of formal evaluation protocols. tools and implementation of the evaluation plan, Expected Outeomes · Increased access to existing public and private health resources for at-risk youth and their families, · Reducedjuvenile delinquency, involvement in gangs and gang-related activities, and use of firearms and drugs/alcohol among school-age children, IV. EV AUJATION: The City of San Bernardino will subcontract with an evaluation consultant to work with the project staff to develop the evaluation plan. The evaluation protocols will include both process and outcome evaluation measures such as pre and post surveys for MentorslMentees and parents/guardians, examination of supporting docwnentation (school records, case management file, and assessments) and change from baseline in access to private and public health resources. The evaluation plan will be developed within the first 3 months of the grant period and approved by TCE staff V. III ., c ::> C- Olle a.. -- ::> o 2000-328 THE CALIFORNIA ENDOWMBNT STANDARD GRANT COMMITMENT TERMS The California Endowment is a California nonprofit public benefit corporation, and is a private foundation for purposes of the Internal Revenue Code, This Standard Grant Commitment Terms ("Commitment") refers to and incorporates conditions for grants awarded by The California Endowment, to grantees of The California Endowment. The California Endowment's mission is to expand access to affordable, quality health care for underserved individuals and communities, and to promote fundamental improvements in the health status of all Californians. The California Endowment seeks to achieve its mission primarily through its grant making programs, I. PURPOSE OF AWARD. The California Endowment has made a grant to the Grantee for the purposes set forth in the Purpose of Grant Award (attached document). II. AMOUNT AND TERM OF AWARD. The amount of the award and the time for performance of activities are set forth in the Purpose of Grant Award. III. CONDITIONS OF AWARD, Grantees of The California Endowment agree to accept the award only under the following conditions: A. Identification of The California Endowment. Grantees shall ensure that The California Endowment is clearly identified as a support organization on all published material relating to the subject matter of the award. All external communications regarding The California Endowment shall be submitted first to The California Endowment for its review and approval. (See Attached Communications Guidelines). R Expenditure of Funds. Grantee shall expend the funds only for charitable purposes, as described in the Purpose of Grant Award. Any funds not expended in accordance with the terms of the grant must be returned to The California Endowment within thirty (30) days following the grant's termination date. Grantee may not use any of its grant dollars for purposes other than those stated in the Purpose of Grant Award and in Internal Revenue Code Section 4945(d)(I) through (5), inclusive, more particularly as follows: 1. To carry on propaganda or otherwise to attempt to influence legislation; 2. To influence the outcome of or participate in any public election or to carry on, directly or indirectly, any voter registration drive; 2000-328 3. To regrant an organization unless such organization is described in Internal Revenue Code Section 509(a)(1) through (3), inclusive, or is an exempt operating foundation as defined in Section 4940 (d)(2); 4. For purposes other than those which are religious, charitable, scientific, literary, or educational within the meaning of Section 170(c)(2)(B) ofthe Internal Revenue Code; or 5. For purposes other than those stated in the Purpose of Grant Award. C. Grantee's Status as an Eligible Grantee. I. This grant is specifically conditioned upon Grantee's status as an eligible grantee of The California Endowment. Grantee warrants and represents that it is a tax exempt organization under section 501(c)(3) of the Internal Revenue Code, and is not a private foundation as defined in section 509(a) of the Internal Revenue Code or is an exempt operating foundation described in Section 4940(d)(2) of the Internal Revenue Code. Grantee has provided The California Endowment with a copy of an IRS Determination Letter evidencing its status as an eligible grantee. Grantee will notify The California Endowment immediately of any change in tax status, including any substantial or material change in sources of support for any taxable year affected by this Commitment, within the meaning of Section 1,170A-9 of the IRS Treasury Regulations. Grantee warrants and represents that this Commitment shall not change Grantee's status under Section 509(a) of the Internal Revenue Code. 2. The forgoing subparagraph c.l. above shall not apply if Grantee is a political subdivision of the State of California, or is otherwise an organization described in Section 170( c )(1) or Section 511 (a)(2)(B) of the Internal Revenue Code. D. Return of Funds. Grantee shall return to The California Endowment any unexpended funds granted under the following conditions: I. If The California Endowment, in its sole discretion, determines the Grantee has not performed in accordance with this Commitment and/or the Grantee's grant program or budget as approved by The California Endowment; or 2. If grantee loses its status as an eligible grantee as described in Section C.I, or C.2. above. 3. Any portion of the funding not used for grant purposes. E. Funds. Records. Audit. Site Visits. Funds provided by The California Endowment shall be accounted for separately in the Grantee's books and records. A systematic accounting record shall be kept by the Grantee of the 2000-328 receipt and disbursement of funds. The Grantee shall retain original substantiating documents related to grant expenditures and make these records available for The California Endowment's review upon request. Grantee shall be responsible for maintaining adequate financial records of this grant program. The California Endowment, or a designated representative, reserves the right, upon written notice, to audit Grantee's books and records relating to the expenditure of any funds provided by The California Endowment. F. Budgets. Expenditures of grant funds must be only for line items specified in the approved grant budget. Advance written approval by The California Endowment must be received by the Grantee for disbursements deviating from the line items of the approved budget. Any interest earned on grant funds must be applied to the project purposes and must be reported to The California Endowment. G. No Further Obligations by The California Endowment. This grant is made with the understanding that The California Endowment has no obligation to provide other or additional support or grants to the Grantee. H. Public Reporting. Grantee agrees to disseminate to interested publics, by using established channels of communication pertinent information relating to the results, findings, or methods developed through this grant. (See Attached Communications Guidelines). 1. Intellectual Property. All copyrights and all other intellectual property produced as a result of this award shall be produced for the "public domain." As such, The California Endowment, grantee, or any other party shall have a nonexclusive irrevocable, perpetual, and royalty-free license to reproduce, publish, copy, alter or otherwise use the intellectual property so produced. 1. Travel. Conference and Food Expenses. Grantee agrees to abide by its budget for travel, conferences and food expenses as set forth in the budget submitted with Grantee's Proposal. K. Licensing and Credentials. Grantee hereby agrees to maintain, in full force and effect, all required governmental or professional licenses and credentials for itself, its facilities, and for its employees and all other persons engaged in work in conjunction with this award. L Management and Organizational Changes. Grantee agrees to provide immediate written notice to The California Endowment if significant changes or events occur during the term of this award which could potentially impact the progress or outcome ofthe grant, including, without limitation, changes in Grantee's management personnel or losses of funding. M. The California Endowment Letterhead and Logo. Use of The California Endowment letterhead or logo is prohibited without prior written consent from the Communications Department of The California Endowment. 2000-328 N. Payment of Funds to Related Parties of The California Endowment. No part of these grant funds shall be paid to any director, officer, or employee (or their family members) of The California Endowment for any purpose.
