HomeMy WebLinkAbout2000-284 ~. 1 RESOLUTION NO. 2000-284 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AN AMENDMENT TO THE AGREEMENT WITH SAN BERNARDINO COUNTY AND THE 3 BOYS AND GIRLS CLUB OF SAN BERNARDINO FOR CLASSROOM AND SWIM POOL IMPROVEMENTS AND REHABILITATION OF THE GYMNASIUM AT THE BOYS AND 4 GIRLS CLUB. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 6 OF SAN BERNARDINO AS FOLLOWS: 7 SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed 8 to execute on behalf of said City an amendment to the agreement with San Bernardino County and 9 the Boys and Girls Club of San Bernardino relating to classroom and swim pool improvements and 10 rehabilitation of the gymnasium at the Boys and Girls Club, a copy of which is attached hereto, 11 marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. 12 SECTION 2. LAURIN, DIRECTOR DEPARTMENT OF ECONOMIC AND COMMUNITY DEVELOPMENT SUBJECT: AMENDMENT NO, 1 TO CONTRACT NO. 99-369 WITH THE CITY OF SAN BERNARDINO, AND THE BOYS AND GIRLS CLUB OF SAN BERNARDINO FOR FACIL TV IMPROVEMENTS - FIFTH DISTRICT RECOMMENDATION: Approve Amendment NO.1 to Contract No. 99-369 with the City of San Bernardino and the Boys and Girls Club of San Bernardino, increasing the contract amount from $10,000 to $46,000 for facility improvements and continued maintenance and operation of the Boys and Girls Club facility. BACKGROUND INFORMATION: On May 1S, 1999, the Board of Supervisors approved Contract No. 99-369, which provided $10,000 in Community Development Block Grant (CDBG) funds for the purchase and installation of a pool pump and the construction of a computer room at the San Bernardino Boys and Girls Club facility. On April 13, 1999, the Board of Supervisors approved the 1999-2000 Consolidated Plan, which included the County's CDBG application. As part of that application, $36,000 was allocated for the rehabilitation of the gymnasium floor at the facility, bringing the total available CDBG funding for the project to $46,000. The Boys and Girls Club provides programs and services to youths from low-and moderate-income households in San Bernardino and the surrounding area communities of the Fifth Supervisorial District. This Contract Amendment No. 1 will give the City of San Bernardino the authority to use the new funds to rehabilitate the facility. The Boys and Girls Club of San Bernardino will continue to maintain and operate the facility for ten (10) years from the date of completion of the additional improvements. This amendment specifies the terms and assurances necessary for compliance with County requirements and CDBG program regulations. REVIEW BY OTHERS: The contract was reviewed and approved by Deputy County Counsel Michelle D. Blakemore on August 18, 2000; the Department of Economic and Community Development's Contract Compliance designee (David Larsen) on August 23, 2000; and the County Administrative Office (Dave Gibson, Administrative Analyst). FINANCIAL IMPACT: The additional CDBG funds in the amount of $36,000 have been allocated to this project and were budgeted in the Department's 1999-2000 fiscal year budget (SBA-ECD-ECD). This amendment will increase the total funding for additional site improvements from $10,000 to $46,000. This action has no effect on the County General Fund. Agency Administrator/CAD Date Date q-;?3-c?D Date 2000-284 FIRST AMENDMENT TO THE CONTRACT BETWEEN THE COUNTY OF SAN BERNARDINO THE CITY OF SAN BERNARDINO AND THE BOYS AND GIRLS CLUB OF SAN BERNARDINO CONTRACT # 99-369 This First Amendment to Contract No. 99-369 is made and entered into this day of 19_, by and between San Bernardino County, hereinafter referred to as "COUNTY", the City of San Bernardino, hereinafter referred to as "CITY", and The Boys and Girls Club of San Bernardino, hereinafter referred to as "CLUB". WHEREAS, COUNTY, CITY and CLUB have previously entered into a Contract, Contract No. 99-369 hereinafter referred to as "CONTRACT", for Community Development Block Grant (CDBG) funded improvements at the CLUB facility, hereinafter referred to as "FACILITY", located in the City of San Bernardino; and, WHEREAS, COUNTY, as part of the 1999-2000 CDBG application, approved funding in the amount of thirty- six thousand dollars ($36,000) for rehabilitation improvements to FACILITY; and, WHEREAS, the City of San Bernardino has allocated thirty eight thousand six hundred thirty eight dollars ($38,638) for utility payments and continued facility maintenance for CLUB under separate lease agreement; and, WHEREAS, COUNTY, CITY, and CLUB desire to amend CONTRACT to include additional funding for improvements. NOW, THEREFORE, in consideration of the mutual covenants herein set forth and the mutual benefits to be derived therefrom, the parties agree as follows: 1. Replace CONTRACT Section 2, with new SCOPE OF PROJECT SCOPE OF PROJECT COUNTY has constructed improvements, hereinafter referred to as IMPROVEMENTS, to the CLUB facility which included the replacement of a swimming pool pump, and the construction of a computer room in the facility. This amendment provides for the rehabilitation of the gymnasium flooring. In consideration of IMPROVEMENTS, CLUB will continue to provide programs and services to youths from low-and moderate- income households of the Fifth Supervisorial District and the City of San Bernardino. Unless as specified otherwise, ECD shall have the authority to represent COUNTY regarding the terms and conditions of AMENDMENT and the administration thereof, and CITY Department of Parks, Recreation, and Community Services shall have the authority to represent CITY regarding the terms and conditions of this Contract and the administration thereof. CITY shall provide COUNTY with all documents necessary to comply with CDBG Program regulations. 2. Replace CONTRACT Section 4, with new FUNDING FUNDING COUNTY has provided CDBG funds in the amount of ten thousand ($10,000) for the purchase and installation of a new swimming pool pump, and for the construction of a computer room in the FACILITY. COUNTY shall provide additional CDBG funds in the amount of thirty-six thousand dollars ($36,000) for the construction of IMPROVEMENTS as described in Section I, SCOPE OF WORK in this first amendment to CONTRACT. CITY will provide funds from various sources in the amount of thirty eight thousand six hundred and thirty eight dollars ($38,638) for utility payments and continued maintenance of FACILITY. 2000-284 3. Replace CONTRACT Section 3, with new TIME OF PERFORMANCE TIME OF PERFORMANCE The term of this contract shall be extended and continue in force for not less than ten (10) years following the date of completion of IMPROVEMENTS. CITY shall notify COUNTY of said date of completion of IMPROVEMENTS. 4. Replace CONTRACT Section 7, with new MAINTENANCE AND OPERATION MAINTENANCE AND OPERATION CLUB shall have sole responsibility for the maintenance of IMPROVEMENTS at the sole expense of CLUB for a period of not less than ten (10) years beginning upon the date of completion of IMPROVEMENTS. FACILITY and IMPROVEMENTS shall be maintained at all times in accordance with federal, state and local laws, regulations and safety standards. 5. Replace Section 10, CONTRACT COMPLIANCE with new CONTRACT COMPLIANCE CONTRACT COMPLIANCE CLUB will take all necessary affirmative steps to assure that minority firms, women's business enterprises, and Labor Surplus Area Firms (a firm located in an area of high unemployment) are used when possible in compliance with provisions of Title 24 Code of Federal Regulations Part 85.36(e). CLUB shall comply with Executive Orders 11246, 11375, 11625, 12138, 12432, 12250, Title VII of the Civil Rights Act of 1964, the California Fair Employment and Housing Act, County Policy 15-01, and other applicable Federal and State and County laws, regulations and policies relating to equal employment and contracting opportunities, including laws and regulations hereafter enacted. CLUB shall make every effort to ensure that all projects funded wholly or in part by CDBG Program funds shall provide equal employment and career advancement opportunities for minorities and women. In addition, CLUB shall make every effort to employ residents of the area and shall keep a record of the positions that have been created directly as a result of this Contract. All other provisions and terms of the Contract, Contract No. 99-369, shall remain the same and are hereby incorporated by reference. 2 2000-284 IN WITNESS WHEREOF, the parties have caused this Contract to be executed as of the day and year first written above.
