RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT
WITH THE STURGES FAMILY PLAYHOUSE FOR THE PROMOTION OF ARTS
AND CULTURE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor of the City of San Bernardino is hereby
authorized and directed to execute on behalf of said City an Agreement with Sturges
Family Playhouse, a copy of which is attached hereto marked Exhibit "A" and
incorporated herein by references as fully as though set forth at length.
SECTION 2.
The authorization to execute the above referenced agreement
is rescinded if the parties to the agreement fail to execute it within sixty (60) days of the
passage ofthis resolution.

AGREEMENT
Fine Arts Funding
THIS AGREEMENT is entered into between the CITY OF
SAN BERNARDINO, a municipal corporation, referred to as
"City" and the Sturges Family Playhouse, a non-profit
organization, referred to an "Organization"
The parties agree as follow:
1. Reci tal s .
A. Organization has requested financial
Assistance from City for fiscal year 2000-01, in order to
assist in defraying the expense of certain concerts,
shows, festivals, or events of activities sponsored by
Organizations as set forth Organization's grant proposal
(hereinafter "the proposal") approved by the Fine Arts
Commission of the City. A copy of said proposal is on
file in the Mayor's Office of Cultural Affairs. The terms
of the proposal are incorporated herein by reference and
shall govern the uses of the funds provided herein. The
financial assistance provided for this agreement is made
on a one-time only basis, and receipt of said funds shall
not imply a continuing obligation of the City beyond the
terms of this Agreement.
B. The expenditure is for valid municipal public
purpose, to wit: for the promotion of art appreciation in
San Bernardino, as more fully set forth in the proposal
submitted by Organization.
Payment. Upon presentation of a claim to the
Office, City shall pay to Organization from the

budget for the 2000-01 fiscal year, the total sum of
$5,000.00 dollars, to cover the costs per Fine Arts grant
application agreement.
3. Use of Funds. The funds paid to Organization
shall be used solely for the purposes set forth in
Paragraph 1 and in strict compliance with the provisions
set forth in the agreement. No deviation from the
agreement shall be made without the expressed approval of
the City of San Bernardino. Said funds shall be expended
by June 30, 200l, and any unexpended funds shall be
returned to City by Organization.
4. Accounting. Within 20 days after the
completion of the event, the Organization shall submit to
the Mayor's Office, with copy to the Director of Finance,
an accounting of the actual expenditures connected with
said event as it relates to the fund which were provided
by the City. Financial records shall be maintained in
accordance with generally accepted accounting principles
by Organization in such manner as to permit City to
easily trace the expenditures of the funds. All books and
records of Organization are to be kept open for
inspection at any time during the business day by the
City or its officers or agents. Failure to submit the
financial records in accordance with this section will
result in the Organization reimbursing the City.
5. Hold Harmless. Organization covenants and
agrees to defend, indemnify, and hold harmless the City
and its employees and agents from all liabilities and
charges,

expenses (including counsel fees), suits or losses
however occurring, or damages arising or growing out of
the use or receipt of the funds paid hereunder and all
operations under this agreement. Payments hereunder are
7 made with the understanding that the City is not involved
in the performance of services or other activities of
Organization. Organization and its employees and agents
are independent contractors and are not employees or
agents of the City in performing said services. The
costs, salary and expenses of the City Attorney and
members of his office in enforcing this agreement on
behalf of the City shall be considered as "counsel fees"
for the purposes of this paragraph.

6. Termination. City shall have the right to
terminate this Agreement and any funding remaining unpaid
hereunder for any reason by mailing a ten-day written
notice to Organization and this agreement shall terminate
ten days after the mailing of such notice. In event this
Agreement is terminated for reasons of improper use of
funds or use of funds for any purpose other than those
authorized, any unexpended portion of funds provided by
City shall be returned to City. In addition, Organization
shall reimburse to City any funds expended which were
used for any purpose other than those authorized under
this Agreement.
7. Assignment. Organization shall not assign
its interest in this Agreement without the prior written
approval of City.
8. Insurance. Organization shall take out and
maintain during the life of this Agreement such public
liability and property damage insurance, naming the City
as additional insured, so as to insure City, its elective
and appointive boards, commissions, officers,

Agents and employees, Organization and its agents
performing act covered by this Agreement from the claims
for property damage for personal injury, including death,
as well as from claims for property damage which may
arise from Organization's or its agents' operation
hereunder, whether such operations be by Organization or
its agent or by anyone directly or indirectly employed by
either Organization or its agents, and the amounts of
such insurance shall be as follows:
(a) Public Liability Insurance. In an amount not
less that $1,000,000 for injuries, including, but not
limited to, death, to any person, and subject to the same
limit for each person, in an amount not less than
$100,000 on account of anyone occurrence.

provide worker compensation insurance in the amount
required by state law if the funds provided hereunder are

adherence to the obligations imposed by this agreement a
binding obligation of the organization.

1l. Entire Agreement. This Agreement and any
other documents of instruments attached hereto or
referred to herein integrate all terms and conditions
mentioned herein or incidental hereto, and supersede all
negotiations and prior writing in respect to the subject
matter hereof. In the event of conflict between the terms
conditions or provisions of this Agreement, and any such
document or instrument, the terms and conditions of this
Agreement shall prevail.
12. Non-Discrimination. Organization agrees that
for the term of this Agreement it shall not discriminate
in employment recruitment, hiring, admission practices,
advertising or in an other manner on the basis of race,
color, creed, religion, national origin, sex, physical
handicap, or marital status.

The Sturges Family Playhouse was founded in 1988 by the Hlebasko Family to provide quality
Children's Community Theater at affordable prices, with the emphasis on versatile family
entertainment in the downtown area.
The Sturges Family Playhouse was adopted as the "Resident Children's Playhouse" at Sturges
Center for the Fine Arts and provides a diversified culturally mixed performance attendance
venue especially from the downtown based community families.

V. Program Description:
THE STURGES FAMILY PLAYHOUSE, having completed three years of
quality Community Musical Theatre and Family Entertainment to San Bernardino, is
moving forward with more versatile productions, expanded target audiences, and
multicultural emphasis. With a focus on including both educational and ethnic
offerings, the Sturges Family Playhouse is preparing a season that includes America's
favorite Broadway show, "Bye Bye Birdie", the beloved children's classic , ''The
Velveteen Rabbit", and resident theatre playwright and composers' Lindsay Hlebasko's
popular, "When You Fracture A Fairy Tale". All productions offer a school matinee, and
comprehensive educational packet for teachers and parents.
Three NEW offerings for the 2000 - 2001 Season include "DESIREE", which
will be offered in Spanish and English, and features young outstanding local talent.
Also, "LEARNING EXPRESS" is a production packed with four mini-shows featuring
the topics of 1) RECYCLING & ENVIRONMENT; 2) WEATHER; 3) SELF-ESTEEM &
CREATIVE PROBLEM SOLVING, & 4) PRACTICAL MATH AND SCIENCE. And
finally, we are adding a Summer Show, "SATURDAY'S W ARRIOR"....a truly versatile
and exciting season!

Vll. Need Statement:
The infusion and availabili!J of performing arts in any community fills the great
need for culture and joy in one's hfe. An essential balance IS achieved with programs
such as THE STURGES F AMIL Y PLAYHOUSE offers training, and an opportunity to
perform for the young and youn~ at heart. Patrons of the arts and families all comprise
an appreciative audience who enJoy having quality live theatre just minutes from home.
The "magic" of quality musical theatre is nothing less than awesome. Our target
groups are now expanding from children and families to bi-Iingual and ethnic
productions. Also, outstanding educational programs that coordinate with State
mandates of peer performances and curriculum elements will accommodate educators
and delight student audiences. The overwhelming need for our youth to feel good about
themselves, make wise choices, and have a "connection" (which we provide at our
theatre) is definitely part of the "NEED" for our program. Children who have been
LABELED elsewhere (ADD, Learning Handicapped, and socially mal-adjusted) THRIVE
in the performing arts!!!)
The Playhouse is enjoying casts of gifted and enthusiastic performers members
from the local community to enhance the arts in the downtown area. Our exciting,
expanded programs projected for this season are UNIQUE AND NEEDED. Offering
productions rangin~ from Broadway to Bi-lingual musicals; from Fairy Tales to
Educational Productions all fill the ongoing need for uplifting entertainment, learning
experiences, and touching "message" shows. Science and Math will be explored through
music and humor, as will other timely topics and learning-based shows.
The need for the "under-served" to be involved with the arts is crucial. Those who
have little or no opportunity. to enjoy the aura of musical theatre are the very ones we
invite to be our guests.....ChIldHelp Village (abused children), Option House (domestic
violence shelter), Pediatric Wards, and disabled seniors and others all love to see a
wonderful production, and then meet the cast, get a tour of the backstage, and receive
complimentary refreshments.

Our vision is to offer outstanding, unique, and solid programs. The Sturges
Family Playhouse plans on being a "cornerstone" in local theatre for years to come.

Vlll. Intended Results
The experience of either performing and I or watching live theatre can be life-
changing. Careers, educational goals, and fragile dreams can be realized through
involvement in community theatre. Supplementing declining arts programs in the
schools, and injecting the downtown area with community theatre in addition to sports
venues, businesses and eateries fills a great need in San Bernardino to become a mecca
of entertainment and offer a constant variety of events and activities to enjoy.
Bringing outstanding productions to San Bernardino in a community theatre level
allows the participation of all ages, ethnic groups, different ranges of ability,
and a variety of personalities to all come together for a particular good....the production
at hand! Youth tend to flock to their drama and choir departments after performing at
the Sturges. They have discovered they can be "stars" and love the hidden talents that

emerge during rehearsals and shows.
Children, in particular, become "performing veterans" quickly, and we find that
they often return over and over to stay involved with the theatre. This is also true of
teens and adults who enjoy honing their skills, advancing in roles and ability, and
applying their confidence and stage presence to other aspects of their lives.
A main "intended result" lies within our audiences. At intermissions and after
shows, it is so exciting and gratifying to see all the smiles, wonderful comments, and the
desire to become involved with the "next show"! This is a true measure of success, and
we LOVE it! Edifying messages through dialogue and song positively affect lives, and
we hope, for the moments we cross paths with our casts and audience, that their lives are
happier and they have been uplifted enough to return again.
By targeting the Hispanic audiences for specific shows, and adding educational
and entertaining school matinees with activities packets, we are predicting a "full service
theatre" for our community as an intended result! Multicultural productions are on hand
for futures show selections, and we plan to serve the diverse and unique cultural
population of our community.
Several of our casts have featured performers in wheelchairs or with special
needs. These fine people performed so well, and the shows were blocked so naturally,
that these "dis-abilities" seemed to disappear.
By expanding our show selection to include specific educational topics, we feel
it is essential to network with "real world" topics as well as often fictitious offerings.
We are excited about the following ORIGINAL mini-shows, each featuring catchy music,
audience participation, and versatile learning opportunities:

"WEATHER OR NOT"......"THE POWER IN ME"........
We feel the intended results will increase audience counts, impact of our theatre,
interest in the Sturges Center and the Arts, and a rap ore with our citizens.

XII Future Objectives:
With plans of doubling our program this coming season, future objectives will
include continued expansion of the successful production ideas, and inclusion of more
innovative and creative projects.
The purpose and immediate goal of our networking with the community in
events that provide donations and financial contributions to the Playhouse is for self-
sustaining reasons. The California Speedway and Route 66 Rondevoux are two ongoing
and consistent sources of money for us, as we participate and assist with their annual
events.
We plan to expand the profile and fund-raising ability of our guild, and secure
corporate sponsors to underwrite productions, thus ensuring solid profits, which we
split with the Sturges Center for the Fine Arts.
Donations from arts patrons, and local organizations will assist in staying in "the
black" as we have always done.

Xlll. Provide a brief historylbackground of the organization:
Sturges Family Playhouse Founder and Director Lindsay Hlebasko wrote a
proposal for a resident community musical theatre to be at The Sturges Center for the
Fine Arts in May 1997. With the dissolution of the San Bernardino Civic Light Opera,
and the California Theatre dark most of the time, Hlebasko thought a Family Playhouse
at the Sturges Center in the downtown area would be perfect.
The Sturges Foundation, under the direction of Thelma Press, Sturges General
Manager, Charles Bradley, and Sturges Theatre Manager, Harald Luther all praised the
idea and Hlebasko began recruiting staff, as she set about writing the script and
composing the score for the first production, an original musical adaptation of "Heidi"
"Heidi" opened in October 1997, followed by "The Wizard of Menlo Park",
"Beauty and the Beast", "When You Fracture A Fairy Tale", ''The Best Of Friends", ''The
Princess and The Pea", and "Pirates Of Penzance"!
The Playhouse has always offered school matinees with educational packets for
teachers and parents. These packets feature "follow-up" activities that align with
language arts, math, science, and reading on various grade and ability levels.
Enjoying involvement in the community, the Playhouse not onl; offers quality
community theatre and family entertainment, but also is a sponsor 0 The Miss San
Bernardino Pageant, and member of the Chamber of Commerce. The Playhouse often
provides complimentary entertainment for civic and special events. Participation i
parades, and other events allow the Playhouse to feel like a family member to San
Bernardino.
N ow beginning its fourth season, the Playhouse remains a member of The Inland
Theatre League, and Southern California Musical Theatre Alliance; both of which
recognize excellence in performance, technical, and directorial efforts.
Often regarded as a Children's Theatre, the Sturges Family Playhouse actually is

exactly what it says it is....a FAMILY playhouse! Entire family units often perform or
assist with productions. The Hlebasko Family (founders) all are active with various areas
of the theatre. Children and youth are often featured in specific shows, but overall, it's
"equal opportunity" in the casting department!
Hlebasko's original productions offer casts a unique opportunity to record a CD
of the original music. This is a fun and unexpected "perk" for so many performers who
would never have had this fun experience in a musical theatre production.
The Sturges Family Playhouse has purchased several things for the Sturges
Center; sound effects processor, lighting gobos and special effects, and CD writer.
The drops, sets, costumes, and props are quickly building an impressive inventory for
future productions.

*Note....we received many, many compliments about this show, the visual and the vocal.
One gentlemen told us It was the best Gilbert and Sullivan he had evenr seen, and
compared is with a northern California Opera Company! The choreography, acting, sets,
