CDC/2000-18, CDC/2000-19> CDC/2000-20, 2000-186, 200 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2000-188 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT AND THE MITIGATION MONITORING PLAN FOR THE 40TH STREET REDEVELOPMENT PROJECT WHEREAS, the Redevelopment Agency of the City of San Bernardino, a public body corporate and politic (the "Agency") has prepared a 40th Street Redevelopment Project Redevelopment Plan (the "Project") in accordance with the provisions of the California Community Redevelopment Law (Health and Safety Code Section 33000 ~ et sew.) ; and WHEREAS, the California Environmental Quality Act (Public Resources Code Section 21000 et sea.) ("CEQA") and the Guidelines for Implementation of CEQA (the "CEQA Guidelines") provide, among other things, that where a project is to be carried out or approved by more than one public agency, one public agency shall be responsible for preparing the environmental documentation required by CEQA for the project and said public agency shall be called the Lead Agency; and WHEREAS, the City of San Bernardino, a charter city (the "City"), has, through the department of the City known as the Economic Development Agency, acted as Lead Agency for the Project; and WHEREAS, an Initial Study as provided for under CEQA was prepared for the Project indicating that implementation of the SBEO/0001/DOC/4078-1 6/13/00 940 jmw 1 2000-188 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21', 22~' 23 24 25 26 27 28 Project could result in potential significant environmental effects and recommending the preparation of an environmental impact report with respect to the Project; and WHEREAS, a notice of preparation of an environmental impact report (the "Notice of Preparation") and the Initial Study were transmitted to the appropriate public agencies for review; and WHEREAS, written comments submitted by interested persons and public agencies in response to the Notice of Preparation and the Initial Study have been addressed in the preparation of a final program environmental impact report with respect to the Project (the "EIR"); and WHEREAS, the EIR has previously been submitted for consideration and comment by the Project Area Committee for the 40th Street Redevelopment Project (the "PAC") and the PAC has recommended that the EIR be approved and certified as the final program environmental impact report for the Project; and WHEREAS, the Planning Commission of the City has adopted its Planning Commission Resolution No. 2000-01, dated May 2, 2000, in which the Planning Commission determined that the activities contemplated under the Project, and in particular the acquisition and installation of the various public improvements as described in Exhibit "C" of the Redevelopment Plan for the 40th Street Redevelopment Project, are consistent with the General Plan of the SBEO/0001/DOC/4078-1 6/13/00 940 jmw 2 2000-188 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 City, and the Planning Commission has recommended that the Common Council certify and approve the EIR and adopt the Project; and WHEREAS, the EIR for the Project has previously been submitted to the Common Council for review and consideration together with the other reports and documentation included in the Joint Public Hearing Document Binder, (See: Binder Tab 9); and WHEREAS, CEQA and the CEQA Guidelines provide that the governing body of the Lead Agency shall make certain certifications with respect to the final environmental report; and WHEREAS, CEQA and the CEQA Guidelines provide that no public agency shall approve or carry out a project for which an EIR has been certified which identifies one or more significant environmental effects of the project unless the public agency makes certain findings; and WHEREAS, CEQA and the CEQA Guidelines provide that when making ~Ithe required findings, the public agency shall also adopt a program i for reporting on or monitoring mitigation measures; and WHEREAS, the 40th Street Redevelopment Project Mitigation Monitoring and Reporting Program (the "Mitigation Monitoring and Reporting Program") has been prepared to implement mitigation measures set forth in the EIR (Binder Tab 9c); and SBEO/0001/DOC/4078-1 6/13/00 940 jmw 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 281 2ooo-ias WHEREAS, the Mitigation Monitoring and Reporting Program has' been presented to and reviewed by the Common Council; and WHEREAS, a joint public hearing was held by the Mayor and Common Council and by the Community Development Commission, the governing board of the Agency, on June 5, 2000 and continued to June 19, 2000 at which public testimony with respect to the Project and the EIR and the Mitigation Monitoring and Reporting Program was heard; and WHEREAS, said joint public hearing was concluded on June 19, 2000. NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS: Section 1. The recitals of this Resolution are true and correct. The Common Council hereby certifies as follows: (1) that the EIR has been completed in compliance with CEQA; (2) that the Common Council has reviewed and considered the information contained in the EIR regarding the Project and the potential effects of the Project on the environment; and (3) that the EIR reflects the independent judgment and analysis of the City with respect to the Project. Section 2 the Project. In accordance with CEQA and the CEQA 'Guidelines, the Common Council hereby makes the findings set forth in Exhibit "A" to this Resolution and incorporated herein by this reference, and adopts the mitigation measures set forth therein. Section 4. The Common Council hereby approves and adopts the Mitigation Monitoring and Reporting Program. Section 5. The documents and other materials that constitute the record of proceedings on which the Common Council's findings are based are included in the Joint Public Hearing Document Binder and in the resolutions and motions of the Mayor and Common Council and the Community Development Commission adopted concurrently with this Resolution. The custodian for these documents is the City Clerk, whose office is located at 300 North "D" Street, San Bernardino, California 92418. The EIR determines that the Redevelopment Plan will not have any significant land use impacts. Finding The Common Council finds that no mitigation measures are required, as there will be no significant land use impacts with adoption and implementation of the Redevelopment Plan. Earth Resources Facts The EIR discusses earth resources impacts at pages 4 and 5. The Redevelopment Plan was determined by the EIR to have no significant earth resources impacts. Finding The Common Council finds that no mitigation measures are required, as there will be no significant earth resources impacts with adoption and implementation of the Redevelopment Plan. Hydrology/Drainage Facts The EIR discusses hydrology/drainage impacts at pages 5 and 6. No significant hydrology impacts were identified with adoption and implementation of the Redevelopment Plan because the Redevelopment Plan does not propose any development; however, the EIR states that the Redevelopment Plan will encourage development that could increase runoff or change drainage patterns. Certain mitigation measures are incorporated into the Redevelopment Plan to reduce indirect hydrology impacts associated with new development to a level of insignificance. These mitigation measures are included in the Mitigation Monitoring and Reporting Program prepared in connection with the adoption and implementation of the Redevelopment Plan (the "Mitigation Monitoring and Reporting Program"). The Common Council finds that the mitigation measures to reduce indirect hydrology impacts associated with new development will mitigate the hydrology/drainage impacts to a less than significant level. Traffic and Circulation Facts The EIR discusses traffic and circulation impacts at page 6. The Redevelopment Plan was determined by the EIR to have no significant traffic and circulation impacts. Finding The Common Council finds that no mitigation measures are required, as there will be no significant traffic impacts with adoption and implementation of the Redevelopment Plan. Aesthetics Facts The EIR discusses aesthetic impacts at pages 6 and 7. Adoption and implementation of the Redevelopment Plan were determined by the EIR to have no direct aesthetic impacts. However, the EIR states that the Redevelopment Plan will encourage redevelopment within the project area and that the City has urban design criteria associated with new developments. A mitigation measure is recommended in the EIR that all projects conducted under the Redevelopment Plan shall incorporate all applicable streetscape improvements listed in the Urban Design Element of the General Plan of the City. Findings The recommended mitigation measure is adopted as set forth in the EIR and in the Mitigation Monitoring and Reporting Program. This Common Council finds there will not be any unavoidable aesthetic impacts with adoption and implementation of the Redevelopment Plan and incorporation of the mitigation measure. Noise Facts The EIR discusses noise impacts at page 7. The Redevelopment Plan was determined by the EIR to have no significant noise impacts. SBEO/0001/DOC/4078-1 6/13/00 940 jmw A-2 Finding This Common Council finds that no mitigation measures are required, as no significant noise impacts with adoption and implementation of the Redevelopment Plan have been identified in the EIR. Air Ouality 5 6 7 8~1 9, 10' 111 12, 13 14 15, 16~! 17 18 1911, 20 21 22 23 24 25 26 27 28 I Facts The EIR discusses air quality impacts at pages 7, 8 and 9. No significant air quality impacts were identified with adoption and implementation of the Redevelopment Plan because the Redevelopment Plan does not propose any development; however, the EIR states that the Redevelopment Plan is anticipated to encourage redevelopment of existing buildings, demolition of existing buildings and construction of new buildings in their place or the development of existing unused parcels of land which would general both short and long-term air emissions. The EIR further states that there would be air emissions associated with the operation of new buildings. Certain mitigation measures are incorporated into the Redevelopment Plan for incorporation into all future projects to reduce air emissions. These mitigation measures are also included in the Mitigation Monitoring and Reporting Program. Findings The recommended mitigation measures are adopted as set forth in the EIR and in the Mitigation Monitoring and Reporting Program. The mitigation measures will mitigate construction (short-term) air quality impacts and long-term impacts of future development projects. Public Services Water Service Facts The EIR discusses water service impacts at page 9. The Redevelopment Plan was determined by the EIR to have no significant water supply impacts. Finding This Common Council finds that no mitigation measures are required, as there will be no significant water supply impacts with adoption and implementation of the Redevelopment Plan. Police Service Facts SBEO/0001/DOC/4078-1 6/13/00 940 jmw A-3 The EIR discusses police service impacts at pages 9-10. No significant police service impacts were identified with adoption and implementation of the Redevelopment Plan because the Redevelopment Plan does not propose any development; however, the EIR states that the Redevelopment Plan will encourage redevelopment of existing buildings, demolition of existing buildings and construction of new buildings in their place or development of existing unused parcels of land. Certain mitigation measures are recommended in the EIR to reduce police service calls associated with new development in the project area. These mitigation measures are included in the Mitigation Monitoring and Reporting Program. Findings 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 The recommended mitigation measures to reduce police service calls associated with new development in the project area are adopted as set forth in the EIR and in the Mitigation Monitoring and Reporting Program. The mitigation measures will reduce the police service impacts of new development in the project area. Fire Protection Facts The EIR discusses fire protection impacts at page 10. Adoption and implementation of the Redevelopment Plan was determined by the EIR to have no direct fire protection impacts; however, the Redevelopment Plan would indirectly encourage redevelopment of existing blighted buildings, demolition of existing buildings and construction of new buildings in their place and the development of existing unused parcels of land. The EIR states that while new development would incrementally increase calls for fire protection, the demolition of blighted buildings or upgrading the blighted buildings to current fire and building codes would have positive benefits to the fire department. Finding This Common Council finds that no mitigation measures are required, as there will be no significant fire protection impacts with adoption and implementation of the Redevelopment Plan. School Facilities Facts The EIR discusses school facilities impacts at page 11. Adoption and implementation of the Redevelopment Plan was determined by the EIR to have no direct school facilities impacts; however, the Redevelopment Plan would indirectly encourage redevelopment of existing blighted buildings, demolition of existing buildings and SBEO/0001/DOC/4078-1 5/13/00 Sao jmw A-4 construction of new buildings in their place and the development of existing unused parcels of land, which could generate students to area schools. The EIR states that residential and commercial development would be required to pay developer fees to the school district to mitigate student impacts. 4 Finding This Common Council finds that no mitigation measures are required, as there will be no significant school facilities impacts with the adoption and implementation of the Redevelopment Plan. Wastewater Service Facts 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 The EIR discusses wastewater service impacts at page 11. Adoption and implementation of the Redevelopment Plan was determined by the EIR to have no direct wastewater service impacts; however, the Redevelopment Plan would indirectly encourage redevelopment of existing blighted buildings, demolition of existing buildings and construction of new buildings in their place and the development of existing unused parcels of land, which would generate wastewater. The EIR states that while the existing wastewater collection facilities serving the project areas have capacity for additional development, several upgrades to existing facilities are needed. The EIR states that several sewer system improvements are listed in the Redevelopment Plan and that financial assistance from the Redevelopment Agency of the City of San Bernardino to help the City with sewer improvements would have positive impacts on wastewater service. Finding This Common Council finds that no mitigation measures are required, since there will be no significant wastewater service impacts with adoption and implementation of the Redevelopment Plan. Solid Waste Facts The EIR discusses solid waste collection and landfill impacts at page 12. Adoption and implementation of the Redevelopment Plan was determined by the EIR to have no direct impacts on solid waste collection or the life expectancy of the landfill serving the project areas. The EIR states that the City has recycling programs that all future development within the project area will be encouraged to participate in to reduce the volume of solid waste taken to area landfills. The EIR contains a mitigation measure to mitigate the solid waste collection and landfill impacts that may result from future development. The mitigation measure is included in the Mitigation Monitoring and Reporting Program. The mitigation measure will mitigate the solid waste collection and landfill impacts that may result from future development. Hazards and Hazardous Materials Facts The EIR discusses hazard and hazardous materials impacts at pages 12-13. Adoption and implementation of the Redevelopment Plan was determined by the EIR to have no direct hazardous materials impacts; however, the Redevelopment Plan would indirectly encourage redevelopment of existing blighted buildings, demolition of existing buildings and construction of new buildings in their place and the development of unused parcels of land. The EIR states that although no hazardous sites are known to exist in the project area, previous uses may have included hazardous materials that may have either been spilled or dumped on the property or unused parcels designated for residential use may have abandoned septic tanks. The EIR states that development in the project area could expose people to hazardous materials and provides a mitigation measure to mitigate the potential exposure of people to hazardous materials. The mitigation measure is included in the Mitigation Monitoring and Reporting Program. Findings The recommended mitigation measure as set forth in the EIR and in the Mitigation Monitoring and Reporting Program is adopted. This measure will mitigate the potential exposure of people to hazardous materials in connection with future development. Population and Housing Facts The EIR discusses population and housing impacts at page 13. Adoption and implementation of the Redevelopment Plan was determined by the EIR to have no direct housing and population impacts; however, the Redevelopment Plan would indirectly encourage redevelopment of existing blighted buildings, demolition of existing buildings and construction of new buildings in their place and the development of existing unused parcels of land. The EIR states that new residential development would increase the City's housing inventory with a possible subsequent increase in population and that the use of tax increment to preserve or provide low- and moderate-income housing could also increase the City's housing and population. However, the EIR concludes that future residential development is not anticipated to have any significant housing or population impacts because development in the project area must be consistent with the City's general plan. Recreation Facts The EIR discusses recreation impacts at page 14. Adoption and implementation of the Redevelopment Plan was determined by the EIR to have no direct recreation impacts; however, the Redevelopment Plan would indirectly encourage redevelopment of existing blighted buildings, demolition of existing buildings and construction of new buildings in their place and the development of existing unused parcels of land. The EIR states that development could increase the demand on existing park and recreational facilities in the project areas and that the City requires the payment of Quimby Act fees for residential development to offset impacts on recreational facilities by new residents. Finding This Common Council finds that no mitigation measures are required, as there will not be any significant recreation impacts with adoption and implementation of the Redevelopment Plan.
