RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO, CALIFORNIA, CONSENTING TO
THE PAYMENT BY THE REDEVELOPMENT AGENCY OF THE
CITY OF SAN BERNARDINO FOR THE DESIGN,
CONSTRUCTION AND FINANCING OF CERTAIN PUBLIC
IMPROVEMENTS FOR THE 40TH STREET REDEVELOPMENT
PROJECT PURSUANT TO HEALTH AND SAFETY CODE
SECTION 33445 AND MAKING CERTAIN DETERMINATIONS
CONCERNING SUCH PUBLIC IMPROVEMENTS
WHEREAS, the Redevelopment Agency of the City of San
Bernardino (the "Agency") has caused the Redevelopment plan for the
40th Street Redevelopment Project (the "Redevelopment Plan") to be
prepared for approval by Ordinance of the Mayor and Common Council of
the City of San Bernardino, California (the "Common Council"); and
WHEREAS, the Common Council and the Community Development
commission of the City of San Bernardino as the governing board of the
Agency have held a full and fair joint public hearing on the adoption
of the Redevelopment plan on June 5, 2000, as continued to June 19,
2000, pursuant to proper notice having duly been given; and
WHEREAS, the Common Council and the Community Development
Commission have given due consideration to all written and oral
statements introduced into evidence at such joint public hearing; and
the
Redevelopment
Plan
contemplates
the
WHEREAS,
installation or construction of public improvements, structures,
facilities and buildings either inside or outside and of benefit to
the project area of the 40th Street Redevelopment Project (the

I "proj ect Area"), The public improvements to be constructed pursuant'
2 to the Redevelopment Plan include those items described in the
3 Redevelopment Plan and identified in Section 1 of this Resolution; and

WHEREAS, the Planning Commission has determined during a
6 hearing conducted on May 2, 2000,
that the location, purpose and
7 extent of the public improvements identified in Section 1 of this
8 Resolution are consistent with the City of San Bernardino General
9 Plan; and
10

WHEREAS, the Common Council has considered the following
12 alternative means of financing the necessary public improvements
13 either inside or of benefit to the Project Area as set forth in
14 Exhibit "C" to the Redevelopment Plan and the Redevelopment
15 Implementation Plan (See Joint Public Hearing Binder Tab 4: Section
16 C):

Federal and State Assistance Programs;

General revenue financing;

Joint Powers Agreements with the Agency, the City
and/or nonprofit corporations;

and sale and lease back financings;

the
improvements
available

WHEREAS, Health and Safety Code Section 33445 authorizes
20 Agency to pay all or part of the value of the land for and
21 installation and construction of certain public improvements,
22 structures, facilities and buildings for the 40th Street Redevelopment
23 proj ect; provided the Common Council makes certain determinations; and
24
25 WHEREAS, Health and Safety Code Section 33334,2 requires
26 that a certain percentage of all tax increment revenues available to
27

I the Agency and attributable to the property tax rate levied within the
2 Project Area shall be utilized to further the efforts of the City to
3 provide affordable low- and moderate-income housing; and
4
5 WHEREAS, Health and Safety Section 33334,2 further provides
6 that such housing may be provided outside of the Project Area upon
7 certain findings being made; and
8
9 WHEREAS, the Community Development Commission and the Common
10 Council have each previously made the required findings pursuant to
II Section 33334.2 with respect to the provision of low- and moderate-
12 income housing either inside or outside the Project Area.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
15 COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, AS FOLLOWS:

19 or other improvements as specified in the Redevelopment Plan are of

year intervals, or more frequent if required.
Streetscape Improvements:
1, Install landscaping in Electric Avenue right-of-way of from
34th Street to 50th Street,

Sewer Svstem Improvements:
1. Upgrade sewers in Sierra Way, 34th Street, "I" Street and
"H" Street to remove known deficiencies and other which may
become known in the future,
Section 2.
The Common Council further finds and
determines that no other reasonable means of financing the public
improvements identified in Section 1 of this Resolution are available
to the City other than to permit the Agency to construct said public
improvements in whole or in part with the proceeds of tax increment
revenues and/or tax allocation bonds which may be issued from time to
13 time by the Agency or with the pledge or other use of tax increment
14 revenues that are available to the Agency for such purposes,

The Common Council
further finds and
Section 3,
17 determines that the payment of funds for the acquisition of land or
18 the cost of buildings, facilities, structures or other improvements
19 will assist in the elimination of one or more blighting conditions
20 inside the Project Area or, subject to the provisions of Section 532
21 of the Redevelopment Plan, provide housing for low and moderate income
22 persons, and is consistent with the Implementation Plan for the 40th
23 Street Redevelopment Project adopted pursuant to Health & Safety Code
24 Section 33490. The Implementation Plan is incorporated as part of the
25 Report to Council prepared and submitted to the Common Council in

connection with its consideration of the Redevelopment Plan unde-r
Joint Public Hearing Binder Tab No, 4: Section C,
Section 4, The determinations as set forth herein are
based upon the evidence and documents prepared in connection with the
adoption of the Redevelopment Plan including, but not limited to, the
Report to the Common Council,
Section 5, Pursuant to Health and Safety Code Section
33445(a) the Common Council hereby authorizes and consents to the
Agency paying for all or any part of the costs of the value of land
and the cost of the installation and construction for the public
improvements specified in Section 1 of this Resolution which are
publicly owned and located either inside or outside the Project Area
for the foregoing reasons.
