and 10 II WHEREAS, The Mayor and Common Council of the City of San 12 Bernardino and the Community Development Commission of the City of San 13 Bernardino, as the governing board of the Agency, have each adopted 14 resolutions calling for the conduct of a joint public hearing on June 15 5, 2000, for consideration of the adoption of the Redevelopment Plan 16 and the certification of a final environmental impact report for the 17 40th Street Redevelopment Project as authorized under Health and 18 Safety Code Section 33355; and 19 20 WHEREAS, notice of the joint public hearing has been duly 21 published in the manner required by law and notice of the joint public 22 hearing has also been transmitted by mail to property owners, business 23 and residential tenants and other interested persons in the manner 24 required by law; and 25 26 27 28 SBEO/OOOl!OOCj4091 6/13/00 100 jrnw 1 2000-186 I 2 3 4 5 6 7 8 WHEREAS, the Agency staff has prepared a response to written objections to the adoption of the Redevelopment Plan as submitted by l interested persons, either prior to the commencement of the joint public hearing on June 5, 2000 or during the course of the conduct of the joint public hearing, in accordance with Health and Safety Code Section 33363; and WHEREAS, it is appropriate to take the action set forth 9 below in this Resolution. 10 II NOW THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF 12 SAN BERNARDINO, CALIFORNIA DO HEREBY RESOLVE AS FOLLOWS, 13 14 Section 1, The Common Council hereby acknowledges that 15 a full and fair joint public hearing was conducted by the Common 16 Council in joint session with the Community Development Commission 17 commencing on June 5, 2000, as continued to June 19, 2000, for the 18 purpose of considering the adoption of the Redevelopment Plan for the 19 40th Street Redevelopment Project and the certification of the final 20 environmental impact report for the project, All interested persons 21 have been accorded a full and fair opportunity to present written and 22 oral testimony both in favor and in opposition of the adoption of the 23 Redevelopment Plan and the certification of the final environmental 24 impact report for the project during the course of the joint public 25 hearing, The Common Council acknowledges that the joint public 26 hearing was closed by motion of the Common Council on June 19, 2000, 27 28 SBEO/0001!DOC/4091 6/13/00 100 jmw 2 2000-186 I Section 2, The oral testimony submitted by interested 2 persons to the Mayor and Common Council and the Community Development 3 Commission during the course of the joint public hearing is hereby 4 included as part of the record of proceedings in this matter, and the 5 City Clerk is hereby authorized and directed to prepare a written 6 transcription of such testimony at the earliest feasible time. 7 8 Section 3, The oral presentation submitted by the Agency 9 staff and Agency consultants to the Mayor and Common Council and the 10 Community Development Commission during the course of the joint public II hearing is hereby included as part of the record of proceedings in 12 this matter, and the City Clerk is hereby authorized and directed to 13 prepare a written transcription of such Agency staff and Agency 14 consultant presentations at the earliest feasible time, 15 16 Section 4, The Common Council hereby acknowledges 17 receipt of the video-graphic presentation materials relating to the 18 40th Street Redevelopment Project as submitted by the Agency 19 consultants at the joint public hearing on June 5, 2000, and such 20 video-graphic presentation materials (consisting of the 29 pages of 21 text attached hereto as Exhibit "A" and incorporated herein by this 22 reference) are hereby included as part of the record of proceedings 23 in this matter. 24 25 Section 5, The Common Council hereby acknowledges 26 receipt of the Response to Written Objections in the form as attached 27 28 SBEO/0001/nocj4091 6/13/00 100 jmw 3 2000-186 I hereto as Exhibit "Bn and incorporated herein by this reference, The 2 Common Council notes that the Response to Written Objections also 3 includes written responses to oral testimony submitted at the June 5, 4 2000 joint public hearing--both oral testimony in favor and oral 5 testimony in opposition to the adoption of the Redevelopment Plan, 6 The Common Council hereby finds that the Response to Written 7 Objections adequately describes the disposition of the issues raised 8 in each written objection received before or at the noticed joint 9 public hearing in accordance with the provisions of Health and Safety 10 Code Section 33363.
