RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2000/2001 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1024, LANDSCAPING MAINTENANCE AND SEWER LIFT STATION DISTRICT, INLAND CENTER AND RIVERW ALK AREA. WHEREAS, by Resolution No. 98-331, the Mayor and Common Council found that the public interest, convenience, and necessity required the formation of a landscaping and sewer lift station maintenance district; and 11 landscaping and sewer lift station maintenance in the Inland Center and Riverwalk area, 12 pursuant to the provisions of Chapter 12.90 of the San Bernardino Municipal Code; and 13 WHEREAS, by Resolution No. 98-299, the Mayor and Common Council declared that 14 all the land included within the boundaries of said district receive a special benefit by the 15 maintenance of said landscaping and sewer lift station; and 16 17 18 WHEREAS, said Resolution No. 98-299 declared that an annual assessment shall be levied on all land within the district to provide funding for said landscaping and sewer lift 19 station maintenance and the administration thereof; and 20 WHEREAS, an Assessment Roll has been prepared totaling $745.14, which sets forth 21 the individual assessments to be levied on each ofthe parcels of land within Assessment District 22 No.1 024 for the fiscal year 2000/2001; and 23 24 XIII D of the California Constitution, which provides for the levying of annual assessments 25 26 27 WHEREAS, the Assessment District was created pursuant to the provisions of Article without the necessity of following the assessment ballot procedures as long as said assessments do not exceed any prior approved assessment or the methodology of applying assessments is not 28 changed or rates are not increased; OS/25/00 2000-168 1 2 3 4 5 6 7 8 9 RESOLUTION CONFIRMING 2000/2001 ASSESSMENT ROLL NO. 1024 (INLAND CENTER AND RIVERW ALK AREA) BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION I. That the Mayor and Common Council do hereby find and determine that the assessments as set forth on said Assessment Roll No. 1024 are equal to or less than any prior approved assessments and comply with the procedural requirements of Article XIII D of the California Constitution without the necessity of following the assessment ballot procedures as set forth therein; 10 11 SECTION 2. That the Mayor and Common Council do hereby find and determine that 12 the proportionate costs to be levied against the parcels of land within Assessment District No. 13 1024 are correctly set forth on Assessment Roll No. 1024, for the fiscal year 2000/2001, on file 14 in the office of the City Clerk of the City of San Bernardino; 15 16 SECTION 3.
