HomeMy WebLinkAbout2000-164 r 1 2 3 4 5 6 7 8 RESOLUTION NO. 2000-164 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2000/2001 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1016, LANDSCAPING MAINTENANCE DISTRICT, COULSTON STREET AREA. WHEREAS, by Resolution No. 95-375, the Mayor and Common Council found that the public interest, convenience, and necessity required the formation of a landscaping maintenance district; and WHEREAS, by said Resolution No. 95-375, the Mayor and Common Council formed 9 an assessment district known as Assessment District No. 1016 for the purpose of providing 10 landscaping maintenance in the Coulston Street area, pursuant to the provisions of Chapter 11 12 12.90 ofthe San Bernardino Municipal Code; and WHEREAS, by Resolution No. 95-356 the Mayor and Common Council declared that 13 14 all the land included within the boundaries of said district receive a special benefit by the 15 maintenance of said landscaping; and 16 WHEREAS, said Resolution No. 95-356 declared that an annual assessment shall be 17 levied on all land within the district to provide funding for said landscaping maintenance and the 18 19 administration thereof; and WHEREAS, an Assessment Roll has been prepared totaling $4.182.48, which sets forth 20 the individual assessments to be levied on each of the parcels of land within Assessment District 21 No. 1016 for the fiscal year 2000/2001; and 22 WHEREAS, Article XIII D of the California Constitution requires that any and all 23 24 Assessment Districts existing on the effective date of said Article XIII D shall comply with the 25 procedural and approval process as set forth in Section 4 of said Article XIII D, except as set 26 forth in Section 5 therein. 27 28 OS/25/00 . . 1 2 3 4 5 6 7 8 9 10 11 12 13 2000-164 RESOLUTION CONFIRMING 2000/2001 ASSESSMENT ROLL NO. 1016 (COULSTON STREET AREA LANDSCAPING MAINTENANCE) BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION I. That the Mayor and Common Council do hereby find and determine that the assessments as set forth on said Assessment Roll No. 1016 are hereby exempt from the procedural and approval requirements of Article XIII D of the California Constitution, as provided for under Section 5(b) of said Article XIII D, and that the assessment amounts as set forth on said Assessment Roll are equal to or less than any prior approved assessments. SECTION 2. That the Mayor and Common Council do hereby find and determine that the proportionate costs to be levied against the parcels of land within Assessment District No. 1016 are correctly set forth on Assessment Roll No. 1016, for the fiscal year 200012001, on file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said 14 15 assessments. SECTION 3.
