RESOLUTION NO. 2000-145
RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE
2000/2001 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 962, SEWER
LIFT STATION MAINTENANCE DISTRICT, PINE A VENUE AREA.
WHEREAS, by Resolution No. 84-523, the Mayor and Common Council found that the
public interest, convenience, and necessity required the formation of a sewer lift station
maintenance district; and
WHEREAS, by said Resolution No. 84-523, the Mayor and Common Council formed
9 an assessment district known as Assessment District No. 962 for the purpose of providing
10 maintenance of a sewer lift station in the Pine A venue area, pursuant to the provisions of
11

Chapter 12.90 of the San Bernardino Municipal Code; and
WHEREAS, by Resolution No. 84-487, the Mayor and Common Council declared that
all the land included within the boundaries of said district receive a special benefit by the
14
15 maintenance of a sewer lift station; and
16 WHEREAS, said Resolution No. 84-487 declared that an annual assessment shall be
17 levied on all land within the district to provide funding for said maintenance of a sewer lift
18 station; and

WHEREAS, by Resolution No. 87-7, the Mayor and Common Council declared
that the public interest and necessity required the amendment of the boundaries of the District
22 by expanding the boundaries thereof to include additional territory in the District; and
23 WHEREAS, an Assessment Roll has been prepared totaling $13.936.00, which sets
24 forth the individual assessments to be levied on each of the parcels of land within Assessment
25

District No. 962 for the fiscal year 2000/2001; and
WHEREAS, Article XIII D of the California Constitution requires that any and all
27
Assessment Districts existing on the effective date of said Article XIII D shall comply with the
28
procedural and approval process as set forth in Section 4 of said Article XIII D, except as set

forth in Section 5 therein.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council do hereby find and determine that
the assessments as set forth on said Assessment Roll No. 962, are hereby exempt from the
procedural and approval requirements of Article XIII D of the California Constitution, as
provided for under Section 5(a) of said Article XIII D, and that the assessment amounts as set
forth on said Assessment Roll are equal to or less than any prior approved assessments.
SECTION 2. That the Mayor and Common Council do hereby find and determine
13 that the proportionate costs to be levied against the parcels of land within Assessment District
14 No. 962 are correctly set forth on Assessment Roll No. 962, for the fiscal year 2000/2001, on
15 file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said
16
assessments.

SECTION 3. That the City Clerk is directed to cause a copy of this Resolution to be
18
transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the
19
20 request that the individual assessments be placed on the subject 2000/2001 property tax bills
21 for collection together with all other property taxes.
