HomeMy WebLinkAbout2000-135 1 2 RESOLUTION NO. 2000-135 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS 3 INTENTION TO ORDER THE VACATION OF A PORTION OF THE NORTH/SOUTH ALLEY NORTH OF 20TH STREET BETWEEN GUTHRIE STREET AND NEWCOMB 4 STREET. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 6 SAN BERNARDINO AS FOLLOWS: 7 8 9 10 11 12 13 14 15 16 17 18 19 20 SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of a portion of the North/South Alley, North of 20.h Street between Guthrie Street and Newcomb Street, described as follows: That portion of that certain North/South Alley, 20 feet wide, as delineated on the map of Tract No. 6898, in the City of San Bernardino, County of San Bernardino, State of California, as per plat thereof recorded in Book 88 of Maps, Pages 34 & 35, inclusive, Official Records of said County, more particularly described as follows: Beginning at a point at the Southeast corner of Lot 11, said point also being the North Line of 20th Street with a half width of 30 feet; thence East, along said North Line, a distance of 20.00 feet, to the Southwest corner of Lot 32; thence North, along the West lines of said Lot 32 and Lots 31 through Lot 23 of said Tract No. 6898, to the Northwest corner of said Lot 23; thence West, a distance of 20 feet, to the Northeast corner of Lot 20 of said Tract No. 6898; thence South, along the East lines of said Lot 20, and Lots 19 through Lot 11, to the Point of Beginning. SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in 21 vacating the above described portion of said street, elects to proceed under and in accordance 22 with the provisions of the "Public Streets, Highways, and Service Easements Vacation Law", 23 being Division 9, Part 3, of the Streets and Highways Code of the State of California. 24 25 26 SECTION 3. That the hour of 10:00 a.m., on July 24, 2000, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California, is fixed as the time and place when 27 and where all persons interested in or objecting to the proposed vacation may appear before the 28 said Mayor and Common Council and offer evidence in relation thereto. For further particulars 05/17/00 2000-135 1 2 3 4 RESOLUTION OF INTENTION --- VACATION OF A PORTION OF THE NORTWSOUTH ALLEY NORTH OF 20TH STREET BETWEEN GUTHRIE STREET AND NEWCOMB STREET (plan No. 10070) as to the proposed vacation, reference is made to that map marked "Plan No. 10070", approved on April 17, 2000, a copy of which is on file in the office of the City Clerk of said City. SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing 5 6 easements for public utility purposes belonging either to the City of San Bernardino or to any 7 public utility and there is hereby specifically reserved for the City of San Bernardino, its 8 9 10 entire area proposed to be vacated, including the right at any time, or from time to time, to successors, heirs and assigns, an easement for sanitary sewer and appurtenant facilities over the 11 construct, maintain, operate, replace and renew said sewer or appurtenances including the right 12 of ingress and egress thereto; and there is hereby specifically reserved for Southern California 13 Edison, its successors, heirs and assigns, an easement to construct, place, operate, inspect, 14 15 16 distribution structure consisting of wires, cables, conduits, poles, pole anchors and guy wires, maintain, repair, replace and remove any overhead or underground electrical transmission and/or 17 18 19 20 21 22 manholes markers and necessary fixtures and appurtenances, and said easement shall include rights of ingress and egress thereto; and there is hereby specifically reserved for Southern California Gas Company, its successors, heirs and assigns, an easement over the entire area proposed to be vacated, including the right at any time, or from time to time, to construct, maintain, operate, replace and renew one or more pipelines or appurtenances for the 23 transportation of natural gas, including the right of ingress and egress thereto; and there is 24 25 26 27 28 specifically reserved for Pacific Bell, its successors, heirs and assigns, an easement to construct, place, operate, inspect, maintain, repair and replace underground and overhead structures consisting of wires, cables and necessary fixtures and appurtenances and said easement shall includes rights of ingress and egress. 05/18/00 2 2000-135 1 RESOLUTION OF INTENTION --- VACATION OF A PORTION OF THE NORTH/SOUTH ALLEY N~blP20TH STREET BETWEEN GUTHRIE STREET AND NEWCOMB STREET (plan No. 10070) 2 3 4 cause Notices of Street Vacation to be posted as required by said "Public Streets, Highways and SECTION 5.
