A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO MAKING CERTAIN FINDINGS WITH RESPECT TO
THE USE OF LOW- AND MODERATE-INCOME HOUSING FUNDS IN
CONNECTION WITH THE REDEVELOPMENT PLAN FOR THE 40TH
STREET REDEVELOPMENT PROJECT

WHEREAS, the Community Development Commission of the City
7 of San Bernardino ("Commission") as the governing board of the
8 Redevelopment Agency of the City of San Bernardino (the "Agency")
9 has initiated proceedings for the consideration of the adoption of
lO the Redevelopment Plan for the 40th Street Redevelopment Project
II ("Redevelopment Plan"); and

WHEREAS, a draft of the Redevelopment Plan has been
14 prepared in accordance with the provisions of the California
15 Community Redevelopment Law, Health and Safety Code Section 33000,
l6 et. seq., ("CRL"); and

the Redevelopment Plan provides for the
WHEREAS,
19 allocation of taxes to the Agency from the redevelopment project
20 area of the 40th Street Redevelopment Project ("Project Area"); and
21
22 WHEREAS, unless certain exceptions apply, Section 33334.2
23 of the CRL requires that not less than twenty percent (20%) of all
24 taxes allocated to the Agency pursuant to Section 33670 of the CRL,
25 shall be used by the Agency for the purpose of increasing,
26 improving, and preserving the community I s supply of low- and
27 moderate-income housing available at affordable housing cost to

1 persons and families of low- or moderate-income and very low-income
2 households; and

4 WHEREAS, Section 33334.2(g) of the CRL provides that not
5 less than twenty percent (20%) of all taxes allocated to the Agency
6 pursuant to Section 33670 of the CRL may be used outside of the
7 Project Area, provided that findings have been made by resolutions
8 of the Commission and the Mayor and Common Council of the City of
9 San Bernardino, that the use of such funds outside of the Project
lO will be of benefit to the Project Area and the 40th Street
11 Redevelopment Project.

NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY
l4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS
15 FOLLOWS:

Section l.
The Common Council hereby finds and
18 determines that the use of taxes allocated to the Agency from the
19 Project Area for the purpose of increasing, improving, and
20 preserving the community's supply of low- and moderate-income
2l housing available at affordable housing cost to persons and
22 families of low- or moderate-income and very low-income households
23 outside of the Project Area will be of benefit to the Project Area
24 and the 40th Street Redevelopment Project for the following
25 reasons:

(a)
the use of low- and moderate-income housing funds
28
outside the proj ect Area will provide additional

housing opportunities to persons who are employed
by businesses located in the Project Area;
(b) the preservation, development andlor acquisition of
residential units outside of the Project Area
reserved for use and occupancy by low- and
moderate-income persons and families shall assist
with the prevention of the spread of blight outside
of the Project Area; and
(c) The use of low- and moderate-income housing funds
outside of the Project Area will enable the City of
San Bernardino to meet State of California State
housing requirements and fulfill affordable housing
goals and policies as stated in the Housing Element
of the General Plan of the City of San Bernardino.

Section 2.
