RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE MANAGEMENT AND TRAINING
CORPORATION, INLAND EMPIRE JOB CORPS CENTER AND ITS CORPS
MEMBERS RELATING TO TRAINING INTERNSHIP WORK EXPERIENCE FOR
STUDENTS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor of the City of San Bernardino is hereby authorized
and directed to execute on behalf of said City an Agreement with the Management and
Training Corp, Inland Empire Job Corps Center and its Corps members, relating to a training
internship work experience program for students, a copy of which is attached hereto, marked
Exhibit "A" and incorporated herein by reference as fully as though set forth at length.
SECTION 2. The authorization granted hereunder shall expire and be void and of no
further effect if the agreement is not executed by both parties and returned to the office of the
City Clerk within 60 days following effective date of the resolution.

COOPERATIVE AGREEMENT FOR JOB CORPS TRAINEES ON
OFF-CENTER SCHOOL-TO-CAREER INTERNSHIPS
between

Witnesseth:
WHEREAS the Management & Training Corporation (MTC) is interested in obtaining School-To-Career
training verification for trainees enrolled at the Inland Empire Job Corps Center; and
WHEREAS the Cooperator/Site is interested in obtaining the assistance of trainees in the Cooperator's/Site's
business and is interested in providing off-center School-To-Career training verification;
NOW, THEREFORE, it is mutually agreed as follows:
INLAND EMPIRE Job Corps Center agrees to:
1. Select and transport trainees to site for off-center School-To-Career Work-Based Learning.
2. Furnish meals for trainees.
3. Give full authority to site to treat trainees as if they were the site's employees.
COOPERATOR/SITE agrees to:

Provide off-center School-To-Career internship experience in the trainee's vocation with a full range
of worker involvement from the simple to the more difficult depending upon training phase of program;
thereby, providing the trainee with the opportunity for hands-on experience to learn and improve the
skills and tasks necessary to be employed in his/her trade.
Provide supervision and instruction to ensure progress toward competency.
Complete "Trainee Evaluation" forms, provided by STC Coordinator, on each trainee.
Advise trainees on the value of good work habits and attitudes.
Keep a record of trainee's attendance using time she!;t. provided by STC Coordinator. ' ,
Report problems in attendance, conduct, dress or other job performance deficiency to the STC
Coordinator immediately.

It is Mutually Agreed:
1. "Trainees are considered federal employees for purposes of federal employee compensalion."
Therefore, the trainees will be covered by Federal Employees Worker's Compensation. There will
be no need for the Site to provide Worker's Compensation Insurance.
2. No charge will be made by the Inland Empire Job Corps Center for services rendered by trainees.
3. No charge will be made by the Site for providing School-To-Career internship experience to trainees.
4. The Site and the center will work out a schedule for School-To-Career internships based on the
availability of work, shop facilities, and other factors involved to best suit the needs of the Site and
the center.
5. Trainees utilized in the School- To-Career internships will not replace Site's full-time (present or future)
employees. ..
6. In connection with the performance oi work under this agreement, the Site agrees not to discriminate
against any Job Corps trainee, employee, or applicant for employment because of race, religion,
color, national origin, gender, disability, age, veteran status, sexual orientation, political affiliation or
belief.
7. Any property damage to products or facilities, etc., where the trainee is working will be the
responsibility of the Site.
8. That ordinarily trainees should not be permitted to operate motor vehicles. However, ifthe Site
determines a trainee is sufficiently skilled and possesses a valid operator's license, the Site may
permit the trainee to operate vehicles. In this event, the Site assumes full liability and responsibility
for any property or vehicle damage.
9. Hours for School-To-Careertrainees will be determined by the Site and STC Coordinator taking into
account Site's needs, but will not exceed 40 hours per week. If Site wishes trainee to work over
the allotted hours, while in School-To-Career, Site agrees to pay trainee at the prevailing hourly wage.
Any violation to this rule will be in breach of Federal Law.
10. OCCUPATIONAL SAFETY AND HEALTH ACT - In the performance of this agreement, the Site
agrees to provide all Job Corps trainees, who legally are Federal employees for occupational safety
and health purposes, with safety and health protection which shall be at least as effective as that
which is required under the Occupational Safety and Health Act of 1970 (29 USC) and 29 Code of
Federal Regulations (CFR) Parts 1910, 1926, and 1960.
This agreement may be terminated by notification of either partyor modified in writing by consent of both
parties.
