HomeMy WebLinkAbout2000-058 1 2 Resolution No. 2000-58 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING 3 SUBMISSION OF WASTE TIRE ENFORCEMENT GRANT APPLICATION FROM THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD, 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF mE CITY OF SAN BERNARDINO AS FOLLOWS: WHEREAS, funds allocated are available from the California Integrated Waste Management Board for grants to solid waste Local Enforcement Agencies (LEA) and cities and counties with regulatory authority within the city and county government to perform waste tire enforcement surveys and compliance activities at waste tire facilities; and WHEREAS, the City proposes to implement a Waste Tire Enforcement Program that involves inspection and compliance activities at tire dealers, auto dismantlers, and waste tire facilities that will reduce illegal stockpiling and disposal of waste tires. The City has demonstrated it has sufficient staff resources, technical expertise, and experience with similar projects to carry out the proposed program; NOW, THEREFORE, be it resolved that the Mayor and Common Council of the City of San Bernardino authorizes the submittal of an application to the California Integrated Waste Management Board for a Waste Tire Enforcement Grant (attached hereto as Exhibit "A"), The Mayor of the City of San Bernardino, or her designee, is hereby authorized to execute in the name of the City of San Bernardino all necessaty contracts, agreements, and amendments for the purposes of securing grant funds and to implement and carry out the purposes specified in the application. The City adopted its charter in 1905 and has a strong Mayor form of government, with a seven-member Council elected by ward, The City of San Bernardino experiences an on-going social and economic problem resulting from illegal dumping and stockpiling of tires. This problem includes the following attnoutes: · Annually, the City estimates that 258,000 waste tires may be senerated within the City, of which at leuHO%ri18y be illegallyttanSparted aridlOi disposed of within the City. · On public right-of-ways, approximately 10'10 of the City's right-of-way crew's time is directed towards the problem of illegal tire dumping. This represents a significant cost to the City. The illegal stockpiling and disposal of waste tires within the City of San Bernardino contributes significantly to the overall problem of blight within the City, resulting in reduced property values and depressed conditions. When tires are illegally dumped on private property, it becomes the responsibility for the property owner to remove them. If the property owner fails to take action, the City, through an abatement process, will remove the tires and place a lien on the property for the costs of abatement. In some locations, these property owners are repeatedly victimized by illegal tire dumping, to the point that the abatement liens exceed the value of their property. megal tire dumping further contributes to secondary problems such as iltegal trash dumping and graffiti. lue piles also provide a breeding ground for rodents and mosquitoes. These VectOR are known to carty diseases that threaten public bea1th. The City received funding for a second grant tam in 1999 from the CIWMB for the implementation of a Waste life Enforcement Grant. Site visits to ficilities, development and distribution of educational materials, and coordinated CIOOperation from related departments were the key elements of this grant. Through the grant, the City was able to continue using our easy-to-understand brochure that contained information on tire disposal regulations, necessary fire department permits, and options for tire disposal services. Instead of handing the brochure during the site visit, staff found that it was more effective to mail the brochure along with a letter" to notify the facility of our upcoming visit. This gave facility managers ample time to gather the required materials for inspection and also gave them an opportunity to ask questions and discuss the material with a City staff member prior to an inspection. This approach gave facility managers plenty of time to prepare for the inspection and the opportunity to address any issues with non-compliance. Overal~ facility managers were appreciative of this method be<-.JIIISC the inspections didn't interfere with their business day. However, regular unscheduled site visits still prove to be the most effective method of ensuring compliance. 1 , 2000-58 identified within the City limits. The City's Special Waste Coordinator will perform inspection/compliance and survey activities on identified sites within the grant '(erm. Surveys will be completed on a monthly basis and reports shall be filed with the CIWMB monthly. Objective 4 - CompliaDu Activity The City will review the twenty-two identified waste tire facilities within the City during the Initial Field Survey to determine current status at each site. In addition, the City will identify any new or previously undisclosed sites. Once a site has been determined to accept or store 500 or more tires, the City shall prepare and issue a Letter of Violation (LOV) to the owner/oper8tor ofthesite.lf a facility is non-compliant, copies of the LOV shall be forwarded to the City's Code Compliance and Fire Departments to ensure a complete, thorough review of each site and a coordinated response to any potential violations, if necessary. Once a facility is determined to be in compliance with the regulations, staff will send a letter notifying them that there were no violations found during the inspection. On a weekly basis, the City shall monitor the issuance of the LOVs to ensure the receipt of Corrective Action Plans (CAP) by the deadlines outlined in the LOV. Upon receipt of the CAP, the City will forward a copy of the CAP to the CIWMB's Tire and Enforcement Agency, Permitting and Enforcement Section for review. Upon review and approval of the CAP, the City will continue to monitor each site to ensure the CAP time schedule is being met, A Warning Letter will be issued by the City in the event that the owner/operator of the site filils to submit a CAP, or fails to comply with the schedule outlined in the CAP. The Warning Letter will identify the action(s) the owner/operator must undertake to come into compliance and the deadline for completion. When unable to obtain a CAP or when the owner/operator continually fails to meet the deadlines set forth in the Warning Letter, the City will refer the file to the CIWMB's Tire and Enforcement Agency, Permitting and Enforcement Section for additional enforcement. When necessary the City will coordinate . response against the owner/operator through the City Attorney's Office for possible civil or criminal prosecution. This objective will be oll8oing throughout the grant term. METHODOLOGY The City will utilize. staff from the Public Services Department to conduct the inspection/compliance and survey activities outlined in this grant. The City currently employs an Environmental Projects Assistant u a Special Waste Coordinator. The Special Waste Coordinator is primarily responsible for the implementation of the Household Hazardous Waste Program, the Used Oil Program, and the Waste IJl'e Program. The Special Waste Coordinator will be continue to be responsible for the implementation and management of this program when grant funding is no longer available. 3 2000-58 QualificaJiolU The City's Department of Public Services has a full-time permanent staff of 187, The Department's Refuse Division is comprised of the Automated Residential Collection Unit, the Subscription Refuse Service Unit, the Street Sweeping Unit, and the Recycling and Environmental Projects Unit, and Refuse Administration, The Refuse Division is responsible for the collection of refuse, recyclables, green waste and waste tires trom residential and commercial accounts within the City's corporate boundaries. In 1995, the City of San Bernardino enacted a local ordinance and designed a program to deal with the issue of illegal tire disposal within the City. The City adopted the Used Tire Management Ordinance on June 20,1995, attempting to close several leaks in the State's waste tire reporting and manifest pragramr. "l'Iicn,tdina:ncc Included an increased local penalty for illegal tire dumping, Under this program, staff visited all identified sellers of new and used tires within the City and provided them with information regarding both the State's waste management programs and the City's ordinance. Field audits of dealers to ensure compliance with local and state requirements were also planned. The passage of AD 2108, which changed the point of collection fee to the point of retail purchase on January I, 1997, combined with a change in City stafl: resulted in the City temporarily suspending the active development ofit's Used Tire Management Program. The City has worked closely with the Tire Enforcement Unit of the ClWMB in order to seek abatement of illegal tire stockpiles within the City. As a result of this joint effort several tire piles were abated, either through direct threat of legal action trom both the State and City levels, or through an increased awareness and closer monitoring at the City level. In addition, the City's residential refuse collection service permits residents to discard one tire per collection day, with a maximum of four tires in any three-month period. These tires arc collected separate trom the refuse and diverted to a local tire processor. In 1999, the City collected approximately 102 tons or 8160 tires. Ovec the past five years the City has coordinated enforcement activities with the ClWMB's Tire and Enforcement Agency, Permitting and Enforcement Section, demonstrating the City's ability and capacity to carry out these actions in a timely manner. Additionally, the City Rceived funding from the CIWMB for the implementation of a 1999/00 Wutc Tue Enforcement Grant. The City is close to completion of this grant program. MtI1UIgenwtt PersolUld Sylvia Juarez, Environmental Projects Assistant, has coordinated the City's Waste Tlfe Survei\1ence and Enforcement Program for the past two years. In addition to the Waste rue Program, Ms. Juarez works with other staffmembers in coordinllting the City's Used Oil Program and the City's Household Hazardous Waste Program. Ms. Juarez has a Bachelor of Science Degree in Environmental Studies from the California State University, San Bernardino. Linda Ceballos, Environmental Projects Coordinator, has over five years of experience in the development and implementation of grant funded community resource programs for the City, Ms. Ceballos supervises a staff that includes four full-time Environmental 5 2000-58 BUDGET SUMMARY There are currently 62 tire dealers and 8 dismantlers within the City of San Bernardino; twenty-two of these facilities have been identified to store more than 500 tires. The estimated costs include all inspection/compliance and survey activities required to complete the activities within the grant term. The City believes that the funding is adequate to accomplish the tasks outlined. In addition to the work statement, a description is provided summarizing required expenses. BE IT RESOL VEn BY TIlE MAYOR AND COMMON COUNCIL OF lliE CITY OF SAN BERNARDINO AS FOLLOWS: WHEREAS, funds allocated are available from the California Integrated Waste Management Board for grants to solid waste Loca1 Enforcement Agencies (LEA) and cities and counties with regulatol)' authority within the city and county government to perform waste tire enforcement surveys and compliance activities at waste tire facilitiesj and WHEREAS, the City proposes to implement a Waste Tile Enforcement Program that involves inspection and compliance activities at tire dealers, auto dismanders, and waste tire facilities that will reduce illegal stockpiling and disposal of waste tires. The City has demonstrated it has sufficient staff resources, technical expertise, and experience with similar projects to carry out the proposed program; NOW, TIlEREFORE, be it resolved that the Mayor and Conunon Council of the City of San Bernardino authorizes the submittal of an application to the California Integrated Waste Management Board for a Waste Tile Enforcement Grant. The Director of Public Services of the City of San Bernardino, or his designee, is hereby authorized to execute in the name of the City of San Bernardino all necessary applications, contracts, agreements, and amendments for the purposes of securing grant funds and to implement and carry out the purposes specified in the application. 1be authorization to execute the above referenced is rescinded if it is not issued within sixty (60) days of the passage of this resolution. The City provides curbside, commingled recycling service to 45,000 single-family residencies within the City, Residents participating in the program have an opportunity to recycle glass, plastic, aluminum cans, steel cans, newspaper, mixed paper, cardboard. The City also provides the opportunity for residents to recycle greenwaste, used tires and used motor oil and filters, These items are collected curbside for the residents. In addition to residential recycling, the City has also implemented a commingled recycling program for businesses. The City's Municipal Code 8.24 sets forth the definition of recyclable materials and services provided by the City. Resolution 98-228 established rates for City refuse and recycling services,
