HomeMy WebLinkAbout2000-040 1 RESOLUTION NO. 2000-40 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING GENERAL PLAN AMENDMENT NO. 99-04 TO THE GENERAL PLAN OF THE CITY OF SAN 3 BERNARDINO, TO AMEND THE GENERAL PLAN LAND USE DESIGNATION 4 FROM PFC, PUBLIC FLOOD CONTROL, TO CG-I, COMMERCIAL GENERAL, FOR APPROXIMATELY 7.6 ACRES ADJACENT TO 1100 S. 'E' STREET. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 6 SAN BERNARDINO AS FOLLOWS: 7 8 9 10 11 SECTION 1. Recitals (a) WHEREAS, the General Plan for the City of San Bernardino was adopted by the Mayor and Common Council by Resolution No. 89-159 on June 2, 1989. (b) WHEREAS, General Plan Amendment No. 99-14 to the General Plan of the City of 12 San Bernardino was considered by the Planning Commission on January 11, 2000, after a 13 14 15 noticed public hearing, and the Planning Commission's recommendation of approval has been considered by the Mayor and Common Council. (c) WHEREAS, an Initial Study was prepared on October 14,1999, and reviewed by the 16 Environmental Review Committee and the Planning Commission who both determined that 17 General Plan Amendment No. 99-14 would not have a significant effect on the environment and 18 19 20 therefore, recommend that a Mitigated Negative Declaration be adopted. (d) WHEREAS, the proposed Mitigated Negative Declaration received a 21-day public 21 review period from October 21, 1999 through November 10, 1999 and all comments relative 22 thereto have been reviewed by the Planning Commission and the Mayor and Common Council in 23 24 25 26 27 28 compliance with the California Environmental Quality Act (CEQA) and local regulations. (e) WHEREAS, the Planning Commission conducted a noticed public hearing on January 11,2000 in order to receive public testimony and written and oral comments on General Plan Amendment No. 99-04 (a proposal to change the General Plan Land Use Designation from PFC, Public Flood Control to CG-l, Commercial General, on 7.6j: acres located north of Orange 1 2000-40 (f) WHEREAS, the Mayor and Common Council held a noticed public hearing and fully reviewed and considered proposed General Plan Amendment No. 99-04 and the Planning 2 " 1 2 3 4 5 6 7 8 C. 9 10 11 12 13 14 15 16 17 A. 18 19 20 21 22 23 24 25 B. 26 27 IIII 28 2000-40 convenience, or welfare of the City in that the development proposed for the site will be required to meet the extensive development standards that are in place pertaining to the design of the auto-related buildings and freeway landscaping. The proposed amendment would not impact the balance of land uses within the City in that the addition of commercially designated land will provide for the expansion of an existing business and provide additional opportunities for economic development in the City. In the case of an amendment to the General Plan Land Use Map, the subject parcel is physically suitable (including, but not limited to access, provision of utilities, compatibility with adjoining land uses, and absence of physical constraints) for the requested land use designation and the anticipated land use developments in that the amendment area is adjacent to an existing auto dealership and all services and utilities are in place. SECTION 4. Amendment BE IT FURTHER RESOLVED by the Mayor and Common Council that: The Land Use Plan of the General Plan of the City of San Bernardino is amended by changing the land use designation from PFC, Public Flood Control, to CG-l, Commercial General, for approximately 7.6 acres located north of Orange Show Road, east ofI-215, and adjacent to 1100 S. 'E' Street. This amendment is designated as General Plan Amendment No. 99-04 and its location is outlined on the map entitled Attachment A, and further described in Attachment B, copies of which are attached and incorporated herein for reference. General Plan Amendment No. 99-04 shall become effective immediately upon adoption of this resolution. 3 2000-40 4 Common Council of the City of San Bernardino at a joint regular meeting thereof, 2000-40 1 RESOLUTION. . .
