BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CIT OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directe to execute on behalf of said City an Agreement with the County of San Bernardino regarding th allocation of funds from the County to the City for the purpose of implementing a census 200 outreach program, a copy of which is attached hereto, marked Exhibit "A" and incorporated b reference as though fully set forth at length. SECTION 2. The approval to execute the above reference agreement is rescinded if th parties to the agreement fail to execute it within 60 days of the passage of this resolution. BACKGROUND INFORMATION: California's Budget Bill for 1999-2000 - SB 160 (Peace) included an appropriation of $24,715.000 to administer the activities of the California Complete Count Committee. Of this amount $5,000,000 was appropriated for the County Complete Count Committees and the San Bernardino County Complete Count Committee's allocation is $239.603. RECEIVE COMPLETE COUNT COMMITTEE STATUS REPORT AND AUTHORIZE ALLOCATIONS AND APPROVE STANDARD AGREEMENT FOR DISTRIBUTION OF COMPLETE COUNT COMMITTEE'S ALLOCATED FUNDS PAGE TWO FEBRUARY 15, 2000 On January 11, 2000, the Board of Supervisors adopted a resolution, which established the San Bernardino County Complete Count Committee and appointed eight initial members. The resolution authorized the Chairman of the Board to appoint additional members to the Committee in order to have organizational participation on the Committee. Additional Committee members were recruited from the County of San Bernardino and from the incorporated cities of the County. On January 25, 2000, the Board of Supervisors approved Agreement 2000-42 and Resolution No. 2000-19 with the State of California Business, Transportation and Housing Agency in the amount not to exceed $239,603 to promote the 2000 Census. The Complete Count Committee established a sub-committee consisting of members from the cities to help the County determine a spending plan for the allocated dollars. The Sub-Committee met on February 8. 2000 and established the aforementioned distribution recommendations. The Complete Count Committee approved these recommendations on February 10, 2000. Approval of this action will ensure an accurate and complete count of San Bernardino County residents in Census 2000. FINANCIAL IMPACT: Funding for this expenditure of $239,603 is provided through San Bernardino County Agreement No. 2000-42 and Resolution No. 2000-19. Approval of this action will result in no local cost to the County. Appropriations (Fund-SFG, Dept.-CAO, Org.-CAO, Obj.-2445) and Revenues (Fund-SFG. Whereas in January 2000. the San Bernardino County Board of Supervisors established the San Bernardino County Complete Count Committee in order to maximize the number of San Bernardino County residents counted in the 2000 census and to implement a census outreach program and California's 1999-2000 fiscal year Budget Bill appropriated funds to counties to administer the activities of complete count committees throughout the State. Whereas the City of San Bernardino desires to participate in the Complete Count Committee efforts in San Bernardino County. Now Therefore. it is agreed as follows: 1. Funds allocated through this agreement shall be used to further the goals and activities of the County Complete Count Committee and shall be used by Contractor as set forth in Contractor's proposal which is incorporated herein by reference and attached as exhibit "A". The funds provided under this agreement must be used by Contractor consistent with the Guidelines established by the California Complete Count Committee which have previously provided to the Contractor. 3. Contractor shall receive $&7 ~nn dollars for Complete Count Committee activities pursuant to this agreement. County's obligation to provide these funds is contingent on receipt of funds by the County from the State for the activities of the County Complete Count Committee. 4. All subcontracts must comply with the same terms and conditions as the County Agreement with the State. 5. Utilizing the Forms attached as exhibit "B" the Contractor shall submit a monthly progress report to the County Complete County Committee no later than the 29th day of each month. 6. Contractor shall be an independent contractor in performing services under this agreement. 7. Contractor shall defend, indemnify. and hold harmless the County and its officers, employees and volunteers with respect to all action and activities of contractor and its officers and employees use of the funds provided under this agreement. 8. Contractor understands and agrees that all funds provided under this agreement were obtained pursuant to an agreement between the County and the State for Complete Count Committee activities and that all activities. services, and use of funds under this agreement shall follow and be consistent with the State/County Agreement. 9. Contractor acknowledges that the County has established a goal of ensuring that all individuals who benefit financially from County through contract are in compliance with their court-ordered child. family and spousal support obligations in order to mitigate the economic burden otherwise imposed upon County and its taxpayers. As required by County's Child Support Compliance Program (County Code Section 110.0101 et seq.) and without limiting Contractor's duty under this contract to comply with all applicable provisions of law, Contractor warrants that it is now in compliance and shall during the term of this contract maintain compliance with employment and wage reporting requirements as required by the Federal Social Security (42 USC Section 653a) and California Unemployment Insurance Code Section 1088.5. and shall implement all lawfully served Wage and Earnings Withholding Orders or District Attorney Notices of Wage and Warnings assignment for Child or Spousal Support. pursuant to Code of Civil Procedure Section 706.031 and Family Code Section 5246(b). Contractor hereby certifies that it has submitted to the County a completed principal Owner Information (POI Form) and Child Support Compliance Program Certification (CSCP Certification). Without limiting the rights and remedies available to County under law or under any other provision of this contract, failure to cure such default within 90 days of notice by the San Bernardino County District Attorney shall be grounds upon which the County Board of Supervisors may terminate this contract. "D" St. San Bernardino, CA 92418 Dear Ms. Daniels: On February 15, 2000 the San Bernardino County Board of Supervisors approved the allocation of State funds to perform Census 2000 outreach activities. The City of San Bernardino was allocated $42,500. Attached is a standard agreement that needs to be signed by your city. Please make sure you type the name of the signer and their title on page three of the agreement. As soon as the County receives the signed agreement. 50% of your allocated money will be sent to you. The remaining 50% will be sent to you when the County receives the remaining money from the State. Since we are advancing you this money. you need to make sure you send supporting documentation to me as soon as possible for all money spent. Please submit the three progress reports included in the agreement in Exhibit B by March 1, 2000. March 16, 2000 and March 31, 2000. respectively.
