RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING AND
3 SETTING FAIR MARKET VALUE AND SALES PRICE OF $1,000.00 AND
DECLARING THE INTENTION OF THE CITY TO SELL PROPERTY GENERALLY
4 LOCATED AT THE NORTHWEST CORNER OF WASHINGTON STREET AND
5 WATERMAN AVENUE IN THE CITY OF SAN BERNARDINO, AND SETTING A
PUBLIC HEARING TO CONSIDER SAID SALE.

WHEREAS, the City of San Bernardino, a municipal corporation, is the owner of the
hereinafter described parcel of real property, generally located at the northwest comer of
Washington Street and Waterman Avenue, south of Wier Road in the City of San Bernardino,
11 State of California, consisting of a 10,479 square foot, triangle-shaped strip of non-buildable
12 land, and more fully described below in Exhibit "A" attached hereto and made a part hereof; and
13 WHEREAS, the Mayor and Common Council of said City find and determine that there
14
is no necessity for the City's ownership of said Real property; and

WHEREAS, the Mayor and Common Council of said City believe it is in the best
interest of the City that said parcel of real property be disposed of at fair market value; and
WHEREAS, City staff have estimated a fair market value of One Thousand Dollars
($1,000.00) for said real property; and

WHEREAS,
Steven Walker Homes, has expressed a desire to purchase said real
WHEREAS, pursuant to Section 2.65.030 of the San Bernardino Municipal Code, City
owned property valued at less than $25,000 may be sold without the need for competitive bid, so
25 long as the sales price is not less than the fair market value of said real property.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY

SECTION 1. The public interest and convenience require the sale of City owned real
3
4 property, generally located at the northwest corner of Washington Street and Waterman Avenue
5

in the City of San Bernardino and same is hereby declared as surplus real property.
SECTION 2. It is therefore the intention of the Mayor and Common Council of the City
of San Bernardino to sell said real property to Steven Walker Homes.
SECTION 3. The Mayor and Cornmon Council do hereby find and determine that the
Fair Market Value of the property and sales price is One Thousand Dollars ($1,000.00).
SECTION 4. The Mayor and Common Council of the City of San Bernardino do hereby
set a public hearing to be held on December 3, 2001, at 10:00 a.m. or as soon thereafter as the
matter can be heard, in the Council Chambers of City Hall, 300 North "D" Street, San

Bernardino, California, relative to the proposed sale.
SECTION 5. Notice of the public hearing shall be published in The San Bernardino
County Sun, a newspaper of general circulation, at least once prior to the public hearing and shall
be posted in at least 3 conspicuous places on the property at least (10) days prior to the hearing.
SECTION 6. Written and oral protest to such sale may be submitted and shall be
received at or prior to the public hearing. Written protests may also be submitted to the City
Clerk's Office, City Hall, 300 N. "D" Street, San Bernardino, California, prior to the public
hearing.
SECTION 7. It is the intent of the Mayor and Cornmon Council to consider and
approve said sale at the public hearing, said property more particularly described in said Exhibit
"A" attached hereto.

Legal Description for Proposed Sale of City Property on the West Side of W aterman Avenue,
being a portion of Waterman Avenue as vacated on the Map of Tract No. 15826.
That portion of Waterman Avenue, as vacated on the map of Tract No. 15826, as per plat
recorded in Book 280 of Maps, pages 38-41, records of the County Recorder of San
Bernardino County, State of California, described as follows:
Commencing at the intersection of the West line of W aterman Avenue and the South Line of
Wier Road, said point also being the Northeast comer of Lot 13 of said Tract No. 15826;
Thence South 000 17' 39" East, along said West line of Waterman Avenue, a distance of
157.81 feet to the True Point of Beginning;
Thence, along the existing West line of Waterman Avenue, South 00030' 40" East, a
distance of 115.22 feet;
Thence South 00058' 05" West, as distance of 340.71 feet;
Thence South 02001' 50" West, a distance of 29.87 feet;
Thence South 080 35' 47" West, a distance of 3.26 feet;
Thence South 890 42' 41" West, a distance of 40.52 feet;
Thence North 050 27' 52" East, along a straight line, a distance of 491.39 feet, more or less,
to the True Point of Beginning.
