RESOLUTION NO. 2001-302
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE MAYOR OR HER DESIGNEE TO
EXECUTE PROGRAM SUPPLEMENT AGREEMENT NO. OOS-M WITH THE STATE
OF CALIFORNIA FOR RAILROAD AT GRADE CROSSING AND SIGNAL
IMPROVEMENT AT PALM AVENUE AND BURLINGTON NORTHERN SANTA FE
TRACK (BNSF).
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
WHEREAS, before Federal-aid will be made available for a specific project, the City
is required to enter into agreements with the State relative to prosecution, administration,
special provisions and maintenance of Project facilities.
WHEREAS, before Federal-aid will be made available, other agreements related to
Federal-aid requirements may be required.
WHEREAS, the City Council approves each project and allocated funding with the
Capital Improvement Program budget each year.
NOW, THEREFORE, BE IT RESOLVED that the Mayor or her designee be
authorized to execute Program Supplement Agreement No. 005-M (attached as Exhibit A) for
railroad at grade crossing and signal improvement at Palm A venue and Burlington Northern
Santa Fe track.

SPECIAL COVENANTS OR REMARKS
1. All required pavement marking and advance warning signs shall
comform to the requirements of MUTCD, 1988 and shall be placed in
their proper location by the Local Agency at the time of
completion of the Railroad's work.
2. Federal funding levels are shown for information only.
Federal and Local funds shall be paid to the railroad or
contractor by the State according to the terms described in the
Service Contract between the railroad or contractor and the
state.
The Local Agency share of funding shall be due and payable upon
receipt by the State of an approved invoice from the Railroad.
Railroad.
3. The cost of maintenance of the crossing shall be as allocated by
Public Utilities Commission.
