RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AUTHORIZING THE CITY OF SAN BERNARDINO TO ENTER
INTO A MEMORANDUM OF UNDERSTANDING (MOD) WITH THE CITY OF SAN
BERNARDINO MUNICIPAL WATER DEPARTMENT AND EAST VALLEY WATER
DISTRICT TO PROVIDE EMERGENCY CONFINED SPACE RESCUE SERVICES
TO THEIR FACILITIES AND PROPERTIES.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the East Valley Water District, San Bernardino Municipal Water
Department, and the City of San Bernardino wish to enter into a Memorandum Of
Understanding (MOU); and
SECTION 2. The Mayor or her designee is hereby authorized and directed to execute
said MOU, a copy of which is attached and incorporated herein as Attachment A; and
SECTION 3. Said MOU shall be for emergency confined space rescue services for the
term July 1, 2001, through June 30, 2006.
SECTION 4. Compensation for the first five year term shall include the MOU
participants purchasing all specialized confined space rescue equipment delineated in
Attachment B 10 said MOD.
SECTION 5. The authorization to execute the above referenced memorandum of
understanding is rescinded if it is not executed within sixty (60) days of the passage of this
resolution.

MEMORANDUM OF UNDERSTANDING
CONFINED SPACE RESCUE
PURPOSE
This Memorandum of Understanding (MOU) identifies the roles and responsibilities of
the signatory agencies for Confined Space Rescue.
DEFINITIONS
CONFINED SPACE - A space which is: large enough for a person to enter, has
restricted means of entry or exit, and is not designated for continuous occupancy. Ref:
California Code of Regulations, Title 8, Section 5157, (b)
EMPLOYER - An agency which requires its' employees to enter Confined Spaces and
is therefore obligated to have on-site rescue capability. Ref: California Code of
Regulations, Title 8, Section 5157, (k)
ENTRY RESCUE - Rescuers entering a confined space to retrieve or to provide
emergency assistance to the entrants. Ref: Confined Space Guide, Cal/OSHA
Consultation Service, page 8
NON-ENTRY RESCUE - Using equipment or other rescue aids to remove entrant from
the Confined Space without the rescuers entering the space. Ref: Confined Space
Guide, Cal/OSHA Consultation Service, page 8
OFF-SITE RESCUE - Prearranged rescue services provided by persons other than the
employer. Ref: California Code of Regulations, Title 8, Section 5157, (k)(2)
ON-SITE RESCUE - Employees assigned to rescue co-workers and who are trained in
rescue, first aid and CPR. Ref: California Code of Regulations, Title 8, Section 5157, (k)
RESCUE - Procedures for providing emergency services to entrants which include
retrieval from the Confined Spaces and first aid or CPR for injured entrants. Ref:
California Code of Regulations, Title 8, Section 5157, (d)(9)
SELF RESCUE - The entrants exit the Confined Space without assistance from outside
personnel. Ref: Confined Space Guide, Cal/OSHA Consultation Service, page 8
RESPONSIBILITIES
Through this MOU the City of San Bernardino Public Services, City of San Bernardino
Municipal Water Department, and East Valley Water District have agreed to provide
$6,000 each for a total of $18,000 for the specialized confined space rescue equipment.
The San Bernardino City Fire Department will provide the specialized confined space
rescue personnel and apparatus to utilize the equipment, once it has been delivered,
and personnel have been adequately trained on its use. All MOU parties and the City of
San Bernardino will benefit in an improved level of service by adding confined space
rescue services to those emergency services already provided by the City Fire
Department.

MEMORANDUM OF UNDERSTANDING
CONFINED SPACE RESCUE
Each signatory agency is responsible for meeting the employer responsibility to provide
rescue capability for employees who enter Confined Spaces. Each agency is still
responsible to train and equip their people for standard on-site rescues, such as "self
rescue" and "non-entry" rescue. The City of San Bernardino Fire Department is
designated as the primary off-site "entry" rescue service for the signatory agencies.
OBLIGATIONS
A MOU term of five (5) years from July 1, 2001 through June 30, 2006. The City of San
Bernardino Public Services, City of San Bernardino Municipal Water Department, and
East Valley Water District will recompense the City by the purchase of certain
specialized confined space rescue equipment as delineated in attachment B. This is a
one time cost, not to exceed $6,000 each, for a total of $18,000. Title and ownership of
the equipment will be given to the City Fire Department.
