HomeMy WebLinkAbout2001-183 1 2 3 4 5 RESOLUTION NO, 2001-183 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING 200112002 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. LANDSCAPING MAINTENANCE DISTRICT, ELM AND COULSTON AREA. THE 1023, WHEREAS, by Resolution No. 97-301, the Mayor and Common Council found that the public interest, convenience, and necessity required the formation of a landscaping maintenance 6 7 district; and 8 9 10 WHEREAS, by said Resolution No. 97-301, the Mayor and Common Council formed an assessment district known as Assessment District No. 1023 for the purpose of providing landscaping maintenance in the Elm and Coulston area, pursuant to the provisions of Chapter 11 12 13 14 15 16 17 18 19 20 12.90 of the San Bernardino Municipal Code; and WHEREAS, by Resolution No. 97-252, the Mayor and Common Council declared that all the land included within the boundaries of said district receive a special benefit by the maintenance of said landscaping; and WHEREAS, said Resolution No. 97-252 declared that an annual assessment shall be levied on all land within the district to provide funding for said landscaping maintenance and the administration thereof; and WHEREAS, an Assessment Roll has been prepared totaling $6.839.28, which sets forth the individual assessments to be levied on each of the parcels ofland within Assessment District 21 22 No. 1023 for the fiscal year 200112002; and 23 WHEREAS, the Assessment District was created pursuant to the provisions of Article 24 XIII D of the California Constitution, which provides for the levying of annual assessments 25 26 27 without the necessity of following the assessment ballot procedures as long as said assessments do not exceed any prior approved assessment or the methodology of applying assessments is not 28 changed or rates are not increased; 05/14/01 2001-183 1 2 3 4 5 RESOLUTION CONFIRMING 2001/2002 ASSESSMENT ROLL NO. 1023 (ELM AND COULSTON AREA) BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION I. That the Mayor and Common Council do hereby find and determine that 6 the assessments as set forth on said Assessment Roll No, 1023 are equal to or less than any prior 7 approved assessments and comply with the procedural requirements of Article XIII D of the 8 California Constitution without the necessity of following the assessment ballot procedures as 9 set forth therein; 10 11 12 SECTION 2.
