HomeMy WebLinkAbout2001-180 , . , 1 2 3 RESOLUTION NO. 2001-180 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2001/2002 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1017, LANDSCAPING MAINTENANCE DISTRICT, KENDALL A VENUE AND PINE A VENUE AREA, 4 5 6 public interest, convenience, and necessity required the formation of a landscaping maintenance 7 8 WHEREAS, by Resolution No. 96-248, the Mayor and Common Council found that the district; and WHEREAS, by said Resolution No. 96-248, the Mayor and Common Council formed 9 an assessment district known as Assessment District No. 1017 for the purpose of providing 10 11 landscaping maintenance in the Kendall Avenue and Pine Avenue area, pursuant to the 12 provisions of Chapter 12.90 ofthe San Bernardino Municipal Code; and 13 WHEREAS, by Resolution No. 96-145, the Mayor and Common Council declared that 14 all the land included within the boundaries of said district receive a special benefit by the 15 16 17 18 19 20 maintenance of said landscaping; and WHEREAS, said Resolution No. 96-145 declared that an annual assessment shall be levied on all land within the district to provide funding for said landscaping maintenance and the administration thereof; and WHEREAS, an Assessment Roll has been prepared totaling $20.462.85, which sets 21 forth the individual assessments to be levied on each of the parcels of land within Assessment 22 District No.1 0 17 for the fiscal year 2001/2002; and 23 24 WHEREAS, Article XIII D of the California Constitution requires that any and all Assessment Districts existing on the effective date of said Article XIII D shall comply with the 25 26 procedural and approval process as set forth in Section 4 of said Article XIII D, except as set 27 forth in Section 5 therein. 28 05/14/01 2001-180 1 2 3 4 RESOLUTION CONFIRMING 2001/2002 ASSESSMENT ROLL NO. 1017 (KENDALL AVENUE AND PINE AVENUE AREA LANDSCAPING MAINTENANCE) BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that 5 6 7 8 provided for under Section 5(b) of said Article XIII D, and that the assessment amounts as set the assessments as set forth on said Assessment Roll No. 1017 are hereby exempt from the procedural and approval requirements of Article XIII D of the California Constitution, as 9 forth on said Assessment Roll are equal to or less than any prior approved assessments. 10 11 that the proportionate costs to be levied against the parcels of land within Assessment District SECTION 2. That the Mayor and Common Council do hereby find and determine 12 No. 1017 are correctly set forth on Assessment Roll No. 1017, for the fiscal year 2001/2002. on 13 14 file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said 15 assessments. SECTION 3.
