HomeMy WebLinkAbout2001-174 '. . 1 2 3 4 5 6 7 8 RESOLUTION NO. 2001-174 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2001/2002 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1002, LANDSCAPING MAINTENANCE DISTRICT, "H" STREET AREA. WHEREAS, by Resolution No. 91-122, the Mayor and Common Council found that the public interest, convenience, and necessity required the formation of a landscaping maintenance district; and WHEREAS, by said Resolution No. 91-122, the Mayor and Common Council formed 9 an assessment district known as Assessment District No. 1002 for the purpose of providing 10 landscaping maintenance in the "H" Street area, pursuant to the provisions of Chapter 12.90 of 11 the San Bernardino Municipal Code; and 12 13 WHEREAS, by Resolution No. 91-90, the Mayor and Common Council declared that 14 all the land included within the boundaries of said district receive a special benefit by the 15 maintenance of said landscaping; and 16 WHEREAS, said Resolution No. 91-90 declared that an annual assessment shall be 17 levied on all land within the district to provide funding for said landscaping maintenance and the 18 19 20 administration thereof; and WHEREAS, an Assessment Roll has been prepared totaling $3.966.82, which sets forth the individual assessments to be levied on each of the parcels of land within Assessment District 21 22 No. 1002 for the fiscal year 2001/2002; and 23 WHEREAS, Article XIII D of the California Constitution requires that any and all 24 Assessment Districts existing on the effective date of said Article XIII D shall comply with the 25 procedural and approval process as set forth in Section 4 of said Article XIII D, except as set 26 forth in Section 5 therein. 27 28 05/14/01 2001-174 1 2 3 4 5 RESOLUTION CONFIRMING 2001/2002 ASSESSMENT ROLL NO. 1002 ("U" STREET AREA LANDSCAPING MAINTENANCE) BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that the assessments as set forth on said Assessment Roll No. 1002 are hereby exempt from the 6 7 8 procedural and approval requirements of Article XIII D of the California Constitution, as provided for under Section 5(b) of said Article XIII D, and that the assessment amounts as set 9 forth on said Assessment Roll are equal to or less than any prior approved assessments. 10 SECTION 2. That the Mayor and Common Council do hereby find and determine 11 that the proportionate costs to be levied against the parcels of land within Assessment District 12 13 No. 1002 are correctly set forth on Assessment Roll No. 1002, for the fiscal year 2001/2002, on 14 file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said 15 assessments. 16 SECTION 3.
