RESOLUTION NO. 2001-173
RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE
200112002 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1001,
LANDSCAPING MAINTENANCE DISTRICT, PENNSYLVANIA AVENUE AND
BIRCH STREET AREA.

6 public interest, convenience, and necessity required the formation of a landscaping maintenance
7
WHEREAS, by Resolution No. 91-40, the Mayor and Common Council found that the
district; and
8
WHEREAS, by said Resolution No. 91-40, the Mayor and Common Council formed an
9
assessment district known as Assessment District No. 1001 for the purpose of providing
10
11 landscaping maintenance in the Pennsylvania Avenue and Birch Street area, pursuant to the
12 provisions of Chapter 12.90 of the San Bernardino Municipal Code; and
13 WHEREAS, by Resolution No. 90-481, the Mayor and Common Council declared that
14 all the land included within the boundaries of said district receive a special benefit by the
15
maintenance of said landscaping; and

WHEREAS, said Resolution No. 90-481 declared that an armual assessment shall be
18 levied on all land within the district to provide funding for said landscaping maintenance and the
19 administration thereof; and
20 WHEREAS, an Assessment Roll has been prepared totaling $8.516.44, which sets forth
21 the individual assessments to be levied on each of the parcels of land within Assessment District
22 No. 1001 for the fiscal year 2001/2002; and

WHEREAS, Article XIII D of the California Constitution requires that any and all
Assessment Districts existing on the effective date of said Article XlII D shall comply with the
25
26
procedural and approval process as set forth in Section 4 of said Article XIII D, except as set
27 forth in Section 5 therein.

RESOLUTION CONFIRMING 2001/2002 ASSESSMENT ROLL NO. 1001 (PENNSYLVANIA A VENUE AND
BIRCH STREET AREA LANDSCAPING MAINTENANCE)
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council do hereby find and determine that
6 the assessments as set forth on said Assessment Roll No. 1001 hereby comply with the

procedural and approval requirements of Article XIII D of the California Constitution, as
provided for under Section 5(b) of said Article XIII D, and that the assessment amounts as set
forth on said Assessment Roll are equal to or less than any prior approved assessments.
SECTION 2. That the Mayor and Common Council do hereby find and determine
that the proportionate costs to be levied against the parcels of land within Assessment District

No. 1001 are correctly set forth on Assessment Roll No. 1001, for the fiscal year 2001/2002, on

14 file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said
15 assessments.
16 SECTION 3. That the City Clerk is directed to cause a copy of this Resolution to be
17 transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the
18

request that the individual assessments be placed on the subject 2001/2002 property tax bills
20
for collection together with all other property taxes.
