HomeMy WebLinkAbout2001-160 1 2 3 RESOLUTION NO. 2001-160 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2001/2002 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 962, SEWER LIFT STATION MAINTENANCE DISTRICT, PINE A VENUE AREA. 4 5 public interest, convenience, and necessity required the formation of a sewer lift station 6 WHEREAS, by Resolution No. 84-523, the Mayor and Common Council found that the 7 maintenance district; and 8 WHEREAS, by said Resolution No. 84-523, the Mayor and Common Council formed 9 an assessment district known as Assessment District No. 962 for the purpose of providing 10 maintenance of a sewer lift station in the Pine Avenue area, pursuant to the provisions of 11 12 13 Chapter 12.90 of the San Bernardino Municipal Code; and WHEREAS, by Resolution No. 84-487, the Mayor and Common Council declared that all the land included within the boundaries of said district receive a special benefit by the 14 15 maintenance ofa sewer lift station; and 16 17 18 WHEREAS, said Resolution No. 84-487 declared that an annual assessment shall be levied on all land within the district to provide funding for said maintenance of a sewer lift station; and 19 20 WHEREAS, by Resolution No. 87-7, the Mayor and Common Council declared that the public interest and necessity required the amendment of the boundaries of the District by 21 22 expanding the boundaries thereof to include additional territory in the District; and 23 WHEREAS, an Assessment Roll has been prepared totaling $13,936.00, which sets 24 forth the individual assessments to be levied on each of the parcels of land within Assessment 25 26 District No. 962 for the fiscal year 2001/2002; and WHEREAS, Article XIII D of the California Constitution requires that any and all 27 28 Assessment Districts existing on the effective date of said Article XIII D shall comply with the 05/15/01 2001-160 1 2 3 4 5 6 RESOLUTION CONFIRMING 2001/2002 ASSESSMENT ROLL NO. 962 (PINE AVENUE AREA SEWER LIFT STATION) procedural and approval process as set forth in Section 4 of said Article XIII D, except as set forth in Section 5 therein. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that 7 8 the assessments as set forth on said Assessment Roll No. 962, are hereby exempt from the 9 procedural and approval requirements of Article XIII D of the California Constitution, as 10 provided for under Section S(a) of said Article XIII D, and that the assessment amounts as set 11 12 13 14 forth on said Assessment Roll are equal to or less than any prior approved assessments. SECTION 2. That the Mayor and Common Council do hereby find and determine that the proportionate costs to be levied against the parcels of land within Assessment District 15 No. 962 are correctly set forth on Assessment Roll No. 962, for the fiscal year 2001/2002, on 16 file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said 17 18 19 assessments. SECTION 3.
