HomeMy WebLinkAbout2001-157 1 2 3 RESOLUTION NO. 2001-157 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2001/2002 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 953, LANDSCAPING MAINTENANCE DISTRICT, 16TH STREET AND MEDICAL CENTER DRIVE AREA. 4 5 6 public interest, convenience, and necessity required the formation of a landscaping maintenance WHEREAS, by Resolution No. 82-159, the Mayor and Common Council found that the 7 8 district; and WHEREAS, by said Resolution No. 82-159, the Mayor and Common Council formed 9 an assessment district known as Assessment District No. 953 for the purpose of providing 10 11 landscaping maintenance in the 16th Street and Medical Center Drive area, pursuant to the 12 provisions of Chapter 12.90 of the San Bernardino Municipal Code; and 13 14 WHEREAS, by Resolution No. 82-120, the Mayor and Common Council declared that all the land included within the boundaries of said district receive a special benefit by the 15 maintenance of said landscaping; and 16 17 18 levied on all land within the district to provide funding for said landscaping maintenance and the WHEREAS, said Resolution No. 82-120 declared that an annual assessment shall be 19 administration thereof; and 20 WHEREAS, an Assessment Roll has been prepared totaling $7.157.70, which sets forth 21 the individual assessments to be levied on each of the parcels of land within Assessment District 22 No. 953 for the fiscal year 2001/2002; and 23 24 WHEREAS, Article XIII D of the California Constitution requires that any and all Assessment Districts existing on the effective date of said Article XIII D shall comply with the 25 26 procedural and approval process as set forth in Section 4 of said Article XIII D, except as set 27 forth in Section 5 therein. 28 05/14/01 2001-157 1 2 3 4 RESOLUTION CONFIRMING 2001/2002 ASSESSMENT ROLL NO. 953, (16TH STREET AND MEDICAL CENTER DRIVE AREA LANDSCAPING MAINTENANCE) BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that 5 6 7 8 provided for under Section 5(a) of said Article XIII D, and that the assessment amounts as set the assessments as set forth on said Assessment Roll No. 953, are hereby exempt from the procedural and approval requirements of Article XIII D of the California Constitution, as 9 forth on said Assessment Roll are equal to or less than any prior approved assessments. 10 11 SECTION 2. That the Mayor and Common Council do hereby find and determine that the proportionate costs to be levied against the parcels of land within Assessment District 12 No. 953 are correctly set forth on Assessment Roll No. 953, for the fiscal year 2001/2002, on 13 file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said 14 15 assessments. 16 SECTION 3.
