HomeMy WebLinkAbout2001-105 (See Companion Resolution CDC/2001-19) RESOLUTION NO. 2001-105 2 3 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CONSENTING TO THE SALE OF CERTAIN REAL PROPERTY WITHIN THE CENTRAL CITY NORTH REDEVELOPMENT PROJECT FROM THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO TO THE SAN BERNARDINO UNIFIED SCHOOL DISTRICT 4 5 6 7 WHEREAS, the Redevelopment Agency of the City of San Bernardino (the "Agency") 8 owns certain lands referred to in this Resolution collectively as the "Properties" which are 9 situated within the redevelopment project area of the Central City North Redevelopment Project 10 described as: 11 (i) 736 North Berkeley Avenue 12 (ii) 630 North "F" Street (iii) 669 North "G" Street 13 14 (iv) 734 North Berkeley Avenue 15 WHEREAS, the San Bernardino Unified School District ("District") is proposing to 16 develop an elementary school on the Properties and wishes to purchase said Properties from 17 the Agency at the current appraised value and pursuant to the terms of a Purchase and Sale 18 Agreement. 19 WHEREAS, it is appropriate for the Mayor and Common Council to take the actions 20 with respect to the 33433 Report and the Agreement and to consent to sale by the Agency to 21 the District as set forth in this Resolution. 22 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION 23 ACTING ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN 24 BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: 25 -1- School District MCC 05/07/01 2001-105 Section 1. On May 7, 2001, the Mayor and Common Council conducted a full and 2 fair joint public hearing with the Community Development Commission of the City of San 3 Bernardino relating to the Sale by the Agency and redevelopment of the Properties by the 4 District. The minutes of the City Clerk for the May 7, 2001, meeting of the Mayor and Common 5 Council shall include a record of all communication and testimony submitted to the Mayor and 6 Common Council by interested persons relating to the joint public hearing, the 33433 Report and 7 the approval of the First Amendment. 8 Section 2. This Resolution is adopted in order to satisfy the provisions of Health and 9 Safety Code Section 33433 as related to the sale of the Properties by the Agency to the District 10 on the terms and conditions set forth in the Agreement. The Mayor and Common Council II hereby find and determine as follows: 12 (i) the disposition and redevelopment of the Properties by the District are consistent 13 with the Redevelopment Plan for the Central City Redevelopment Project. 14 (ii) the purchase price for the Properties payable by the District to the Agency, subjec 15 to the satisfaction of the terms and conditions of the Agreement, is an amount which the 16 Community Development Commission has determined to be fair, just and reasonable, and that 17 the disposition ofthe Properties on the terms set forth in the Agreement shall materially benefit 18 and sustain the implementation of the Redevelopment Plan. 19 Section 3. The Mayor and Common Council hereby find and determine that no 20 further environmental review ofthe disposition and redevelopment of the Properties by the 21 District is necessary at this time under the California Environmental Quality Act (CEQA), as 22 amended, in light of the fact that the District will conduct the appropriate CEQA review and 23 action prior to the development of the Properties. 24 Section 4. The Mayor and Common Council hereby approve, receive and file the 25 33433 Report and the Agreement in the form as submitted at this joint public hearing. -2- School District MCC 05/07/01 2001-105 Section 5.
