BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY

SECTION 1:
The Mayor and Director of Human Resources are hereby
uthorized and directed to execute on behalf of said City a Side Letter to Resolution No.
000-13, for full-time, regular active Fire and Police Management employees, Section I,

SIDE LETTER TO RESOLUTION NO. 2000-13
FOR SAFETY MANAGEMENT EMPLOYEES
This exhibit sets forth the Side Letter to Resolution No. 2000-13 for full-time regular, active Safety
Management employees.
I. PERS
Safety Employees:
1. The City shall continue to participate in an employee retirement plan for Public Safety
Officers, by contract with the California Public Employees' Retirement System (PERS) under the current
2% at age 50 formula. Effective July 1, 2001, the City will implement the 3% at 55 formula. The Unit
agrees that it will defer any implementation of the 3% @ 50 benefit until July 1, 2005. Agreement of
discussion of implementation does not imply that such benefit has been agreed to or awarded.
Implementation is subject to future negotiations of such benefit and approval of such benefit by the Mayor
and Common Council. This agreement does not bar the Unit from negotiating for this benefit in 2003.
3. The City shall adopt a resolution with an implementation date of January 1, 2000, for
paying and reporting the value of the Employer Paid Member Contribution (EPMC) under the guidelines
of Government Code Section 20636(c)(4) pursuant to Section 20691. The City will report the nine
percent (9%) Employee Contribution as Special Compensation under the current PERS laws.
