RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING
3 FAIR MARKET VALUE OF A SLOPE AND DRAINAGE EASEMENT ACROSS
CERTAIN REAL PROPERTY LOCATED GENERALLY NORTHERLY OF KENDALL
4 DRIVE, EASTERLY OF DEVIL'S CREEK FLOOD CONTROL CHANNEL,
COMMONLY KNOWN AS ASSESSOR'S PARCEL NUMBER 0261-231-27, RELATIVE
5 TO THE EXTENSION OF PEPPER LINDEN DRIVE.

WHEREAS, the City of San Bernardino desires to acquire a Slope and Drainage

easement across certain real property located northerly of Kendall Drive and easterly of the
Devil's Creek Flood Control Channel, commonly known as Assessor's Parcel Number 0261-231-

27, and more fully described in Exhibit "A" attached hereto and made a part hereof, relative to
the extension of Pepper Linden Drive; and
12 WHEREAS, George A Sehremelis and Athena A. Sehremelis are the owners of the lot
13 and parcel of real property from which said easement is to be acquired; and

WHEREAS, an appraisal has been prepared by Len Purdue and Associates, a California
general certified appraiser; and

WHEREAS, City has reviewed the appraiser's determination of the fair market value
18 of the land and his report thereon; and
19 WHEREAS, staff has amended said determination of fair market value to include a
20 temporary construction easement adjacent to said Slope and Drainage easement
21
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
22 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

24 across said lot and parcel of real property owned George A. Sehremelis and Athena A.

SECTION 1. That said Street and Highway easement and Slope and Drainage easement
Sehremelis, fully described in said Exhibit "A", is hereby determined to have a fair market value
of $1.750.00 as determined by said appraiser and as amended by staff

LEGAL DESCRIPTION FOR A SLOPE AND DRAINAGE EASEMENT EASTERLY OF
PEPPER LINDEN DRIVE, NORTHERLY OF KENDALL DRIVE.

A slope easement and appurtenant facilities, lying within Lot 12, Tract No. 2404, as per plat
thereof recorded in Book 34 of Maps, pages 52 and 53, records of the County Recorder of San
Bernardino County, State of California, described as follows:
Beginning at the northwesterly comer of said Lot 12; thence South 32015' 50" West, a distance
of 14.22 feet; thence South 870 18' 35" East, a distance of 20.46 feet; thence South 580 15' 35"
East, a distance of 20.49 feet; thence South 780 55' 17" East, a distance of 20.57 feet, more or
less, to the northeasterly line of said Lot 12; thence North 640 50' 39" West, along said
northeasterly line of Lot 12, a distance of 54.85 feet, more or less, to the point of beginning.
Contains 422 square feet, more or less.
