RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING
3 FAIR MARKET VALUE OF A SLOPE AND DRAINAGE EASEMENT ACROSS
CERTAIN REAL PROPERTY LOCATED GENERALLY NORTHERLY OF KENDALL
4 DRIVE, EASTERLY OF DEVIL'S CREEK FLOOD CONTROL CHANNEL,
COMMONLY KNOWN AS ASSESSOR'S PARCEL NUMBER 0261-231-07, RELATIVE
5 TO THE EXTENSION OF PEPPER LINDEN DRIVE.

WHEREAS, the City of San Bernardino desires to acquire a Slope and Drainage
easement across certain real property located northerly of Kendall Drive and easterly of the
Devil's Creek Flood Control Channel, commonly known as Assessor's Parcel Number 0261-231-

07, and more fully described in Exhibit "A" attached hereto and made a part hereof, relative to
11 the extension of Pepper Linden Drive; and

WHEREAS, Jean M. Haensly as trustee of the Jean M. Haensly Revocable Trust dated
January 24, 2001, is the owner of the lot and parcel of real property from which said easement
14
is to be acquired; and
15
WHEREAS, an appraisal has been prepared by Len Purdue and Associates, a California
16
17 general certified appraiser; and
18 WHEREAS, City has reviewed the appraiser's determination of the fair market value
19 of the land and his report thereon; and
20 WHEREAS, staff has amended said determination of fair market value to include a
21 temporary construction easement adjacent to said Slope and Drainage easement
22

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That said Street and Highway easement and Slope and Drainage easement

LEGAL DESCRIPTION FOR A SLOPE AND DRAINAGE EASEMENT EASTERLY OF
PEPPER LINDEN DRIVE, NORTHERLY OF KENDALL DRIVE.

A slope easement and appurtenant facilities, lying within Lot 13, Tract No. 2404, as per plat
thereof recorded in Book 34 of Maps, pages 52 and 53, records of the County Recorder of San
Bernardino County, State of California, described as follows:
Beginning at the most northerly corner of said Lot 13; thence South 320 15' 50" West, along the
northwesterly line of said Lot 13, a distance of 44.28 feet; thence South 760 56' 51" East, a
distance of37.59 feet; thence South 560 50' 35" East, a distance of I 1.02 feet; thence South 870
18' 35" East, a distance of 6 1.49 feet, more or less, to the southeasterly line of said Lot 13; thence
North 320 15' 50" East, along said southeasterly line, a distance of 14.22 feet, more or less, to the
northeasterly comer of said Lot 13; thence North 64050' 59" West, along the northeasterly line
of said Lot 13, a distance of 101.77 feet, more or less, to the point of beginning.
