RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING
FAIR MARKET VALUE OF A STREET AND HIGHWAY EASEMENT AND SLOPE
AND DRAINAGE EASEMENT ACROSS CERTAIN REAL PROPERTY LOCATED
GENERALL Y NORTHERLY OF KENDALL DRIVE, EASTERLY OF DEVIL'S
CREEK FLOOD CONTROL CHANNEL, COMMONLY KNOWN AS ASSESSOR'S
PARCEL NUMBER 0261-231-06, RELATIVE TO THE EXTENSION OF PEPPER
LINDEN DRIVE.
WHEREAS, the City of San Bernardino desires to acquire a Street and Highway
easement and Slope and Drainage easement across certain real property located northerly of
Kendall Drive and easterly of the Devil's Creek Flood Control Channel, commonly known as
Assessor's Parcel Number 0261-231-06, and more fully described in Exhibit "A" attached hereto
and made a part hereof, relative to the extension of Pepper Linden Drive; and
WHEREAS, Everett E. McGrew and Aldona R. McGrew are the owners of the lot and
parcel of real property from which said easements are to be acquired; and
WHEREAS, an appraisal has been prepared by Len Purdue and Associates, a California
general certified appraiser; and
WHEREAS, City has reviewed the appraiser's determination of the fair market value
of the land and his report thereon; and
WHEREAS, staff has amended said determination of fair market value as a result of an
21 increase of area to be acquired.
22 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. That said Street and Highway easement and Slope and Drainage easement

25 across said lot and parcel of real property owned by Everett E. McGrew and Aldona R.

McGrew, more fully described in said Exhibit "A", is hereby determined to have a fair market
value of $96,080.00 as determined by said appraiser and as amended by staff.

LEGAL DESCRIPTION FOR A PORTION OF PEPPER LINDEN DRIVE,
NORTHERLY OF KENDALL DRIVE.

That portion of Lot 14, Tract No. 2404, as per plat thereof recorded in Book 34 of Maps, pages
52 and 53, records of the County Recorder of San Bernardino County, State of California,
described as follows:
PARCEL ONE:
An easement for street and highway purposes, and appurtenant facilities, being a portion of a
strip of land, 100 feet wide, lying within said Lot 14, the centerline of which is described as
follows:
Beginning on the centerline of Kendall Drive, distant thereon 1010.28 feet from its intersection
with the centerline of Deer field Street, as said street is delineated on the Map of Tract No. 10647,
as per plat thereofrecorded in Book 159 of Maps, pages 39 and 40, records of said County;
thence North 320 06' 26" East, a distance of225.00 feet, to a tangent curve, concave
southeasterly, having a radius of 1850.00 feet; thence northeasterly, along said curve, through a
central angle of2l 039' 07', an arc distance of699.ll feet to the point of termination.
The sidelines of said easement shall be lengthened or shortened as to commence on the
southwesterly line of said Lot 14 and terminate on the northeasterly line of said lot 14.
Contains 12,517 square feet, more or less.
PARCEL TWO:
An easement for street and highway purposes, and appurtenant facilities, described as follows:
Beginning at the most westerly corner of said Lot 14, said point also being on the northeasterly
line of Kendall Drive, having a half-width of 40 feet; thence North 320 15' 50" East, along the
northwesterly line of said Lot 14, a distance of34.79 feet; thence South 12048' 52" East, a
distance of35.ll feet; thence South 320 15' 50" West, a distance of 10.00 feet, to the
southwesterly line of said Lot 14 and said northeasterly line of Kendall Drive; thence North 570
44' 10" West, along said southwesterly line, a distance of24.86 feet, more or less, to the Point of
Beginning
Contains 557 square feet, more or less.

East, along the northwesterly line of said Lot 14, a distance of34.79 feet to the True Point of
