J RESOLUTION NO. 2002-346 2 3 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO MODIFYING THE SCOPE OF THE PROPOSED PLAN AMENDMENTS TO REINSTATE EMINENT DOMAIN FOR ALL PROPERTIES LOCATED WITHIN THE UPTOWN AND CENTRAL CITY NORTH REDEVELOPMENT PROJECT AREAS 4 5 6 7 WHEREAS, the Mayor and Common Council have previously approved the 8 Redevelopment Plan for the Uptown Redevelopment Project Area (the "Uptown Project Area") on June 16, 1986, and the Central City North Redevelopment Project Area ("Central City North") on August 6, 1973 (the "Project Areas"); and 9 10 II WHEREAS, the Project Areas as adopted contained a provision for the exercise by the 12 Redevelopment Agency of the City of San Bernardino (the "Agency") of the powers of eminent 13 domain to eliminate blight within the Project Areas which powers have previously terminated 14 on June 16, 1998 for the Uptown Project Area and January I, 1999 for the Central City North 15 Project Area, by the express provisions contained in the applicable Redevelopment Plans; and WHEREAS, the Mayor and Common Council have previously taken actions or initiated 16 procedures for the purposes of amending the Project Areas to reinstate the powers of eminent 17 domain for the Agency in furtherance of continued redevelopment efforts within the Project 18 Areas which powers are deemed to be vital for the continued elimination of blight within the 19 Project Areas; and 20 WHEREAS, it is necessary that the Mayor and Common council proceed with the adoptio 21 of the proposed amendments to the Project Areas to reinstate the powers of eminent domain for al 22 properties located within the Project Areas without being limited to current uses, zoning or genera 23 plan designations, and for the Agency to continue the ongoing progress of eliminating blight withi 24 the Project Areas pursuant to the adopted Redevelopment Plan for the Project Areas. 25 /II -1- P:\ClericaJ Sen"ices Dept\:\hrgarel Parker\ResollltiollSU002\IO-21-02 UP & ccr.. Res B.doc . . . 2002-346 NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED 2 BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS 3 FOLLOWS: 4 Section 1. The Mayor and Common Council hereby find and determine that the Projec 5 Areas contain the following factors of blight including, but not limited to: 6 Buildings in which it is unsafe or unhealthy for persons to live or work, due t 7 serious Building Code violations, dilapidation and deterioration, defective design or physica 8 construction, faulty or inadequate infrastructure, or other similar factors; 9 Adjacent or nearby uses that are incompatible with each other and that prevent th 10 economic development of those parcels or other portions of the Project Areas; 11 Properties currently served by infrastructure that does not meet existing adopte 12 utility or community infrastructure standards; 13 Factors that prevent or substantially hinder the economically viable reuse 0 14 capacity of building or areas, caused by conditions including, but not limited to, all of th 15 following: a substandard design; buildings that are too large or too small given present standard 16 and market conditions; age, obsolescence, deterioration, dilapidation; inadequate parking. 17 buildings requiring demolition because of unsafe conditions; or other physical conditions tha 18 could prevent the highest and best uses of the property. 19 / / / 20 / / / 21 / / / 22 / / / 23 / / / 24 / / / 25 / / / -2- P:IClerical Servlce~ DepllMargaret ParkerlResolutions\2002\10-21-02 UP & CCJ'Ii Res B.duc 2002-346 , Section 2. Based on the cited conditions in Section I above, the Mayor and Commo 2 Council hereby find that it is in the vital interest of the residents of the Project Areas that th 3 Redevelopment Agency of the City of San Bernardino (the "Agency") continue it 4 redevelopment program of: redeveloping and rebuilding facilitates in the Project Areas t 5 provide safe and more efficient service for the people in the area and the general public as 6 whole; to provide for the removal of structurally substandard buildings to permit the return of th 7 Project Areas land to economic use and new construction; to eliminate environmenta 8 deficiencies such as small and irregular lot subdivisions, inadequate street layout, overcrowdin 9 of the land, and unsightly overhead utilities; the removal of impediments to land disposition an 10 development through acquisition and or assembly of land into reasonably sized and shape 11 parcels served by an improved street system and improved public utilities; to encourage an 12 foster economic revitalization of the Project Areas; and in order to effectively accomplish it 13 redevelopment program in accordance with the Redevelopment Plans for the respective Projec 14 Areas, the Mayor and Common Council, find it necessary to reinstate eminent domain for al 15 properties located within the Project Areas and thenceforth, desire to amend the Redevelopmen 16 Plans for the Project Areas accordingly. 17 III 18 I I I 19 I I I 20 I I I 21 III 22 I I I 23 I I I 24 I I I 25 I I I -3- P:\Clerical Sl'.....ice~ Depr\l\largaret Parker\Resolutions\2002\1{l.21.02 UP & CCN Res B.doe . 2002-346 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO MODIFYING THE SCOPE OF THE PROPOSED PLAN AMENDMENTS TO REINSTATE EMINENT DOMAIN FOR ALL PROPERTIES LOCATED WITHIN THE UPTOWN AND CENTRAL CITY NORTH REDEVELOPMENT PROJECT AREAS 3 4 Section 3.
