RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO APPROVING THE APPLICATION FOR GRANT
FUNDS FOR THE CALIFORNIA HERITAGE FUND GRANTS PROGRAM
UNDER THE SAFE NEIGHBORHOOD PARKS, CLEAN WATER, CLEAN
AIR AND COASTAL PROTECTION BOND ACT OF 2000 FOR THE
REHABILITATION AND RESTORATION OF THE CALIFORNIA THEATER

WHEREAS, the Legislature and Governor of the State of California have approved grant
7
8
Funds for the California Heritage Fund; and
WHEREAS, the Office of Historic Preservation has been delegated the responsibility for the
9
administration of the grants program, setting up necessary procedures; and
10
WHEREAS, said procedures established by the Office of Historic Preservation require the
11
Applicant to certify by resolution the approval of applications(s) before submission of said
12
application(s) to the Office of Historic Preservation; and
13
WHEREAS, the applicant will enter into a contract with the Office of Historic Preservation
14
for the subject Project;

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
16
THE CITY OF SAN BERNARDINO AS FOLLOWS:

Section 1. Approves the filing of an Application for assistance for the above project(s) to be
19
funded from the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act
20
of ZOOO/California Heritage Fund; and
21
Section 2. Certifies that Applicant understands the assurances and certification in the
22
Application form; and
23
Section 3. Certifies that all archeological investigations, studies, and reports used as the basis
24
for work on this grant-funded Property, as well as interpretation and mitigation, will be professionally
25
prepared and approved by a qualified archeologist for conformance with The Secretary of the
26
27
Interior's Standards for Archeology and Historic Preservation. Where appropriate, demonstrate
28
consultation with the local Native Americans, or other appropriate groups.

Section 4. Certifies that the Development and Interpretation Projects, Applicant has adequate
control (ownership, leasehold, easement, joint powers or cooperating agreement, or other long-term
interest in the Property at the commencement, during, and after the completion of the Project, in
accordance with Covenant requirements; and
Section 5. Certifies that all architectural plans and specifications used as the basis for
construction work on this grant-funded Property will be prepared and approved by a professionally
qualified restoration architect and/or engineer for conformance with the Secretary of the Interior's
Standards for the Treatment of Historic Properties and the California Historic Building Code; and
Section 6. Certifies that Applicant has or will have sufficient funds to operate and maintain
the Project; and
Section 7. Certifies that Applicant shall start the CEQA and, or, NEPA compliance process, if
applicable, within 60 days after full execution of the Contract and shall complete and comply with
CEQA and, or, NEP A, if applicable, prior to the release of grant funds from the Office of Historic
Preservation; and
Section 8. Certifies that Applicant has reviewed and understands the General Provisions
contained in the Project Contract shown in the Procedural Guide; and
Section 9. Appoints the Project Manager of the Redevelopment Agency as agent to conduct
all negotiations, execute and submit all documents including, but not limited to Applications,
agreements, payment requests and so on, which may be necessary for the completion of the
aforementioned Project.
