2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO CALLING A SPECIAL MUNICIPAL ELECTION
3 ON A PROPOSED CHARTER AMENDMENT RELATING TO THE
SALARY OF THE MAYOR AND REQUESTING THAT SAID CITY OF SAN
4 BERNARDINO'S SPECIAL MUNICIPAL ELECTION BE CONSOLIDATED
WITH THE NOVEMBER 5, 2002 STATEWIDE GENERAL ELECTION
5 CONDUCTED BY THE COUNTY OF SAN BERNARDINO.
6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION I. Recitals.

A. In accordance with the Constitution of the State of California, the City of San
Bernardino, a municipal corporation, has adopted a Charter.
B. The Mayor and Common Council of the City of San Bernardino desire to submit to
the qualitied electors of the City of San Bernardino for their consideration a Charter Amendment

concerning the annual salary of the Mayor of the City of San Bernardino.

SECTION 2. Special Municipal Election Called. A special municipal election is hereby
called and will be held in the City of San Bernardino on Tuesday, November 5, 2002, for the purpose
of submitting to the qualified electors of the City, for their approval or disapproval, the proposed

Charter Amendment as set forth in Exhibit "A" attached hereto.

SECTION 3. Reqnest for Consolidation of Elections. Pursuant to Section 10400 of the
California Elections Code, the Mayor and Common Council of the City of San Bernardino request
that the Board of Supervisors of the County of San Bernardino consolidate the City's special
municipal election with the statewide general election to be hcld on Tuesday, November 5, 2002.
The polls for said election shall be open at 7 :00 a.m. of the day of said election and shall

rcmain open continuously from said time until 8:00 p.m. of the same day when said polls shall be
closed, except as provided in Section 1440 I of the California Elections Code.

SECTION 4. Measure. The measure to be voted on at the consolidated special municipal
election as it is to appcar on the ballot shall be as follows:

MEASURE . Approve a Charter
Amendmcnt to set the annual salary of the
Mayor on January 1,2003 at 50% of the salary For the Amendment
for a Superior Court Judgc, County of San
Bernardino, State of California, which was in
effect on July I, 2002, thereafter adjusted and
implemented January I of each subsequent year Against the Amendment
to 50% of the salary for said Superior Court
Judge then in effect on that January I date.

14 The measure shall be designated on the ballot by a letter printed on the left margin of the
15 square containing the description of the measure as provided in the California Elections Code.
16 SECTION 5. Canvass of Returns. The Registrar of Voters of the County of San
17 Bernardino is hereby authorized to canvass the returns of the special municipal election so called and
18 to conduct the special municipal election in all respects as if there were only one election with only
19 one form of ballot. Results of the special municipal election shall be certified to the Mayor and
20 Common Council of the City of San Bernardino.
21 SECTION 6. Notice of Election. The City Clerk is hereby directed to publish a notice of
22 the spccial municipal election which shall contain the following:

in the City Clerk's Office at the above location.
The City Clerk is directed to make arrangements to accept arguments and to arrange for
sample ballots, which shall include the text of the proposed Charter Amendment, in accordance with

the California Elections Code. This notice may be combined with a notice of any othcr municipal
election to be held on the same date.

SECTION 7. Conduct of Election. The special municipal election so called shall be held
in such precincts and at such polling places as shall be determined by the Rcgistrar of Voters of the
County of San Bernardino. The Board of Supervisors of the County of San Bernardino is hereby

requested to issue instructions to the Registrar of Voters to take all steps necessary for the holding
of the consolidated election. Thc Mayor is hereby authorized to execute a contract for the services
necessary tor conducting the special municipal election. The City of San Bernardino recognizes that

additional costs will be incurred by the County by reasons of this consolidation and agrces to
reimburse the County for any such costs.

SECTION 8. Filin~ of Resolution. The City Clerk of the City of San Bernardino is
directed to file a certified copy ofthis Resolution with the Board of Supervisors of the County of San
Bernardino and to tile a copy of this Resolution with the Registrar of Voters.

SECTION I. Recitals.

(a)
In accordance with the Constitution of the State of California, the City of San
8 Bernardino. a municipal corporation, has adopted a Charter.

The Mayor and Common Council of the City of San Bernardino desireto submit to
the electors the Charter Amendment set forth below in bold type in this resolution.

SECT10N 2. Submittal to Electors. The following proposed amendment set forth in bold

type to the Charter of the City of San Bernardino is submitted to the qualitied electors of the City
13
of San l3ernardino for their approval or rejection at the consolidated special municipal election to
14
be held on Tuesday. November 5. 2002.

PROPOSED CHARTER AMENDMENT NO.

It is proposed that Section 24 of the Charter of the City of San Bernardino be amended by
17
18
substituting a new second sentence in bold type so that the entire Section would now read as follows:
Section 24. Salary of Mayor. The Office of Mayor shall be a full
19
time position and the incumbent shall not engage in any business,
20
professional or occupational activities which interfere with the
21
discharge of the duties of such office. Effective January 1,2003,
the annual salary of the Mayor shall be set at fifty percent (50%)
of the salary for a Superior Court Judge, County of San
22

Bernardino, State of California, as of July 1, 2002, and shall

thereafter be adjusted and implemented January 1 of each

subsequent year at the same fifty percent (50%) figure of the

salary for said Superior Court Judge then in effect on said

January 1 date.
