HomeMy WebLinkAbout2002-232 1 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE 3 SUMMARY VACATION OF AN EASEMENT FOR THE FUTURE EXTENSION OF INDIAN CANYON COURT LOCATED ACROSS LOT 8, TRACT 13470, IN THE CITY 4 OF SAN BERNARDINO. 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 RESOLUTION NO. 2002-232 WHEREAS, the Mayor and Common Council of the City of San Bernardino desire to surnrnarily vacate an easement for the future extension of Indian Canyon Court, located across Lot 8 of Tract 13470, in the City of San Bernardino, without notice and hearing; and WHEREAS, the easement proposed to be vacated is more fully described as follows: That 50 foot easement for the future extension of Indian Canyon Court, as said easement is delineated on the amended map of Tract No. 13470, as per map recorded in Book 233 of Maps, Pages 18, 19 and 20, records of the County Recorder of San Bernardino County, State of California. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino elect to proceed with the summary vacation of that 50 foot easement as described above, under and in accordance with the provisions of the "Public Streets, Highways, and Service Easements Vacation Law", being Division 9, Part 3 of the Streets and Highways Code of the State of 20 California. 21 22 23 Mayor and Common Council do hereby find that said easement may be summarily vacated, 24 25 26 SECTION 2. It is hereby determined that the vacation of the easement is categorically exempt from the requirements of the California Environmental Quality Act (CEQA), pursuant to Class I, Section 15301(c). SECTION 4. The Mayor and Common Council of said City do hereby summarily vacate the easement for the extension ofIndian Canyon Court, located across Lot 8 of Tract 13470, as more fully described herein. SECTION 5. Nothing in this Resolution shall in any way affect or disturb any existing easements for public utility purposes belonging either to the City of San Bernardino or to any public utility that existed prior to these vacation proceedings. SECTION 6.
