HomeMy WebLinkAbout2002-205 1 2 RESOLUTION NO. 2002-205 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 3 2002/2003 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1012, LANDSCAPING MAINTENANCE DISTRICT, MILL STREET AND BURNEY 4 STREET AREA. 5 6 7 8 WHEREAS, by Resolution No, 94-03, the Mayor and Common Council found that the public interest, convenience, and necessity required the formation of a landscaping maintenance district; and 9 WHEREAS, by said Resolution No, 94-03, the Mayor and Common Council formed an 10 assessment district known as Assessment District No, 1012 for the purpose of providing 11 12 13 14 15 16 17 18 19 20 21 landscaping maintenance in the Mill Street and Burney Street area, pursuant to the provisions of Chapter 12,90 of the San Bernardino Municipal Code; and WHEREAS, by Resolution No. 93-432 the Mayor and Common Council declared that all the land included within the boundaries of said district receive a special benefit by the maintenance of said landscaping; and WHEREAS, said Resolution No, 93-432 declared that an annual assessment shall be levied on all land within the district to provide funding for said landscaping maintenance and the administration thereof; and WHEREAS, an Assessment Roll has been prepared totaling $3,930.72, which sets forth the individual assessments to be levied on each of the parcels of land within Assessment District 22 No, 1012 for the fiscal year 2002/2003; and 23 24 WHEREAS, Article XIII 0 of the California Constitution requires that any and all 25 Assessment Districts existing on the effective date of said Article XIII D shall comply with the 26 procedural and approval process as set forth in Section 4 of said Article XIII D, except as set 27 forth in Section 5 therein. 28 05/31/02 2002-205 1 2 3 4 5 RESOLUTION CONFIRMING 2002/2003 ASSESSMENT ROLL NO, 1012 (MILL STREET AND BURNEY STREET AREA LANDSCAPING MAINTENANCE) BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION I. That the Mayor and Common Council do hereby find and determine that 6 the assessments as set forth on said Assessment Roll No. 1012 are hereby exempt from the 7 procedural and approval requirements of Article XIII 0 of the California Constitution, as 8 9 10 11 12 13 provided for under Section 5(b) of said Article XIII D, and that the assessment amounts as set forth on said Assessment Roll are equal to or less than any prior approved assessments. SECTION 2.
